Emerv 1999 Revocable Trust and subject to the Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees authorizes and permits the following: Wetland Permit to construct a t98' upper retaining wall with two (2) t3' returns using vinyl sheathing; construct a f98' mid-bluff wood retaining wall with two (2) fi' returns; add clean fill to re-establish the entire bluff area as needed; construct a platform at top of bluff leading to 4' wide bluff stairs and a 10'x10' observation platform along the mid-bluff retaining wall; re-vegetate all disturbed bluff areas using native plantings; and as depicted on the site plan prepared by Seacoast Construction Inc., received on May 28, 2013 and stamped approved on June 19, 2013. IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed, and these presents to be subscribed by a majority of the said Board as of this date. ~4~g~P0( J.c ~3 o TERMS AND CONDITIONS The Permittee, Ellen F Emerv 1999 Revocable Trust, residing at 5925 Nassau Point Road, Cutchoeue, New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: l . That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Pertnittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Peirnittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. James F. EMERY 1999 REVOCABLE TRUST 5925 NASSAU POINT ROAD, CUTCHOGUE SCTM# 111-13-6 Dear Mr. Lark: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, June 19, 2013 regarding the above matter: WHEREAS, Lark & Folts, Esqs. on behalf of ELLEN F. EMERY 1999 REVOCABLE TRUST applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated May 28, 2013, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on June 19, 2013, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 2 ~ • WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees approve the application of ELLEN F. Again, it is my fault in not properly informing you, but due to the confusion caused by the tremendous loss of my bluff in April and May as a result of Superstorm Sandy, as well as my health in not being able to come to the property on a regulaz basis, I never followed up on this with your workers. I am enclosing an outline of what is proposed in order to save your bluff in the future from further erosion. As you know, Seacoast has already constructed the bulkhead at the shoreline and is in the process of replacing the failed retaining wall. This work is being performed under the permits received from the DEC and from the Southold Town Trustees. The work to be done, which will require permits, is as follows: 1. Construct an "Upper Retaining Wall" across the width of the bluff, 98' t in length with a 3't return on each end to the property line. This retaining wall will be located approximately 3' to 4' below the crest of the existing bluff on the northerly side, and on the southerly side a 3' to 4' distance from the existing retaining wall. Construction will consist of 10" by 20' poles placed 6' on center. The sheathing will be Shoreguazd 425 Vinyl Series, 36" by 12'. Whalers will also be installed which will be 6' by 8' structural timber. Pile penetration will be 12' to 14't. 2. Construct a "Mid-Bluff Retaining Wall", which will be 98'f in length with 3' t returns on each end to the property line. This Mid-Bluff Retaining Wall will be located approximately 20't seawazd of the upper retaining wall. Construction will consist of piles 8" by 20', installed 6' on center. The sheathing will be 3' by 10' structural wood. Whalers will be 6' by 8' structural wood. The pile penetration will be 14' to 16't. ~ti1 ~ ~ ~ ~ i 3. After the erection of the two retaining walls, approximately 600 cubic yazds of clean fill will be brought in landwazd via a conveyor belt on a Telebelt. The fill will be put in place landwazd of the bulkhead to the first retaining wall to obtain a level azea between the bulkhead and the retaining wall; and then fill will be placed from the lower retaining wall to the mid-bluff retaining wall on an angle of approximately 60 ° . Fill will then be placed from the mid-bluff retaining wall to the upper retaining wall trying to maintain an angle not to exceed 60 ° . Finally, the clean fill will be tamped down. 4. After settlement of the fill has been achieved, stairs will be constructed starting from the bottom of the bluff. The stairs will be 4' wide and will consist of 3' by 12" stringers attached to 8" by 16' piles. The railings, supports and stair treads will be Timbertech. The depth of the piles along the stairway will be 10't. 5. A 10' by 10' observation platform will then be constructed adjacent to the stairs on the northerly side at the Mid-Bluff Retaining Wall, which will support the majority of its weight. The platform will be recessed back onto the hill with 8" by 20' piles. The pile penetration will be 14'f. 6. Hazdwaze: All fasteners to structural timbers and piles will be hot dipped galvanized. The fasteners for the decking and stair treads will be #10 x 2.5" stainless steel screws, which will be predrilled and countersunk. 7. Within six months of the completion of the above construction, there will be planted on the bluff azea between the retaining walls the following: American Beach Grass, Rugosa Rose and Russian Olive. Emery 5925 Nassau Point Road Cutchogue, NY 11935 (516) 746-4038 Deaz Ms. Emery: Due to the severe erosion that the bluff on your property suffered after Superstorm Sandy, I was required to rethink the entire project. I am enclosing an outline of what is proposed in order to save your bluff in the future from further erosion. As you know, Seacoast has already constructed the bulkhead at the shoreline and is in the process of replacing the failed retaining wall. This work is being performed under the permits received from the DEC and from the Southold Town Trustees. The work to be done, which will require permits, is as follows: 1. Construct an "Upper Retaining Wall" across the width of the bluff, 98' f in length with a 3't return on each end to the property line. This retaining wall will be located approximately 3' to 4' below the crest of the existing bluff on the northerly side, and on the southerly side a 3' to 4' distance from the existing retaining wall. Construction will consist of 10" by 20' poles placed 6' on center. The sheathing will be Shoreguazd 425 Vinyl Series, 36" by 12'. Whalers will also be installed which will be 6' by 8' structural timber. Pile penetration will be 12' to 14'f. 2. Construct a "Mid-Bluff Retaining Wall", which will be 98't in length with 3' t returns on each end to the property line. This Mid-Bluff Retaining Wall will be located approximately 20'f seaward of the upper retaining wall. Construction will consist of piles 8" by 20', installed 6' on center. The sheathing will be 3' by 10' structural wood. Whalers will be 6' by 8' structural wood. The pile penetration will be 14' to 16't. 3. After the erection of the two retaining walls, approximately 600 cubic yazds of clean fill will be brought in landwazd via a conveyor belt on a Telebelt. The fill will be put in place landwazd of the bulkhead to the first retaining wall to obtain a level azea between the bulkhead and the retaining wall; and then fill will be placed from the lower retaining wall to the mid-bluff retaining wall on an angle of approximately 60 ° . Fill will then be placed from the mid-bluff retaining wall to the upper retaining wall trying to maintain an angle not to exceed 60 ° . Finally, the clean fill will be tamped down. 4. After settlement of the fill has been achieved, stairs will be constructed starting from the bottom of the bluff. The stairs will be 4' wide and will consist of 3' by 12" stringers attached to 8" by 16' piles. The railings, supports and stair treads will be Timbertech. The depth of the piles along the stairway will be 10't. 5. A 10' by 10' observation platform will then be constructed adjacent to the stairs on the northerly side at the Mid-Bluff Retaining Wall, which will support the majority of its weight. The platform will be recessed back onto the hill with 8" by 20' piles. The pile penetration will be 14't. 6. Hazdwaze: All fasteners to structural timbers and piles will be hot dipped galvanized. The fasteners for the decking and stair treads will be # 10 x 2.5" stainless steel screws, which will be predrilled and countersunk. 7. Within six months of the completion of the above construction, there will be planted on the bluff azea between the retaining walls the following: American Beach Grass, Rugosa Rose and Russian Olive. I am enclosing an outline of what is proposed in order to save your bluff in the future from further erosion. As you know, Seacoast has already constructed the bulkhead at the shoreline and is in the process of replacing the failed retaining wall. This work is being performed under the permits received from the DEC and from the Southold Town Trustees. The work to be done, which will require permits, is as follows: 1. Construct an "Upper Retaining Wall" across the width of the bluff, 98' f in length with a 3't return on each end to the property line. This retaining wall will be located approximately 3' to 4' below the crest of the existing bluff on the northerly side, and on the southerly side a 3' to 4' distance from the existing retaining wall. Construction will consist of 10" by 20' poles placed 6' on center. The sheathing will be Shoreguard 425 Vinyl Series, 36" by 12'. Whalers will also be installed which will be 6' by 8' structural timber. Pile penetration will be 12' to 14't. 2. Construct a "Mid-Bluff Retaining Wall", which will be 98't in length with 3' t returns on each end to the property line. This Mid-Bluff Retaining Wall will be located approximately 20'f seaward of the upper retaining wall. Construction will consist of piles 8" by 20', installed 6' on center. The sheathing will be 3' by 10' structural wood. Whalers will be 6' by 8' structural wood. The pile penetration will be 14' to 16't. LC 11'1 ~ ~i 3. After the erection of the two retaining walls, approximately 600 cubic yards of clean fill will be brought in landwazd via a conveyor belt on a Telebelt. The fill will be put in place landward of the bulkhead to the first retaining wall to obtain a level azea between the bulkhead and the retaining wall; and then fill will be placed from the lower retaining wall to the mid-bluff retaining wall on an angle of approximately 60 ° . Fill will then be placed from the mid-bluff retaining wall to the upper retaining wall trying to maintain an angle not to exceed 60 ° . Finally, the clean fill will be tamped down. 4. After settlement of the fill has been achieved, stairs will be constructed starting from the bottom of the bluff. The stairs will be 4' wide and will consist of 3' by 12" stringers attached to 8" by 16' piles. The railings, supports and stair treads will be Timbertech. The depth of the piles along the stairway will be 10't. 5. A 10' by 10' observation platform will then be constructed adjacent to the stairs on the northerly side at the Mid-Bluff Retaining Wall, which will support the majority of its weight. The platform will be recessed back onto the hill with 8" by 20' piles. The pile penetration will be 14't. 6. Hazdwaze: All fasteners to structural timbers and piles will be hot dipped galvanized. The fasteners for the decking and stair treads will be #10 x 2.5" stainless steel screws, which will be predrilled and countersunk. 7.
