CHISHOLM 200 MACDONALD CROSSING, LAUREL 1000-145-4-16 Dear Mr. Herrmann: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wednesday, October 19, 2016: RESOLVED that the Southold Town Board of Trustees APPROVE the Administrative Amendment to Wetland Permit#8207 for the construction of approximately 58 linear feet of vinyl bulkhead; a +/-54' vinyl return in lieu of proposed 100 linear feet of Hesco Barriers; backfill/re- nourish area landward of new bulkheading with approximately 215 cubic yards of clean sand fill to be trucked in from an approved upland source; plant the 15'wide non-turf buffer with Cape American beach grass 18" o.c.; construct a shore-parallel 4'x6' landing and 4'x6' steps to beach _ off bulkhead in lieu of proposed shore-perpendicular platform with stairs to beach; replace as needed +/-16'x20' on-grade masonry patio; eliminate the proposed replacement of existing retaining wall; and to correct the dimensions of the existing wood deck to be replaced from 13'x23' to a 10'x22'wood deck attached to dwelling; and as depicted on the site plan prepared by En-Consultants, dated September 15, 2016, and stamped approved on October 19, 2016. After the bulkhead was destroyed during Hurricane Sandy,the NYSDEC issued an emergency permit for its replacement(copy attached). After later being approached by a salesman, however, Mrs. Chisholm was talked into proposing"HESCO barriers" in place of the destroyed bulkhead and obtained a permit from the Trustees accordingly. That permit presently remains valid through June 19,2017. Because Mrs. Chisholm could not finance the installation of the bulkhead or the stone baskets at the time, however,she unfortunately had'to delay taking any action to restore her property until now. The DEC has indicated to me verbally that because of the historically existing nature of the bulkhead and the bulkheaded nature of the surrounding shorelines,they would issue a permit for its reconstruction presently. In fact, had their 2013 approval been issued as a standard permit rather than as an emergency permit,that permit would still be valid. The Army Corps of Engineers has similarly indicated that the bulkhead may be reconstructed presently pursuant to their Nationwide General Permit No. 3,which allows for the in-place reconstruction of a historically existing shoreline structure destroyed during a storm event. Thank you. Randy Piersol The only other regulatory hurdle for Mrs. Chisholm is the modification of her Trustees permit to authorize reconstruction of a bulkhead rather than installation of the previously approved HESCO baskets. With installation of either device,the effect will be the re-hardening of the subject shoreline in the same location as the prior bulkhead and backfilling of the property,so really the only question before for the Board is which is the more appropriate structure to install,a traditional bulkhead or HESCO baskets. I have attached a picture of HESCO baskets,which occupy a much larger footprint than a bulkhead;are unsightly;and if installed would be the only such installation along the neighboring shoreline. Further,they are not to my knowledge engineered for long term erosion control purposes and designed to protect residential homes from intense beach erosion during avulsive storm events like Hurricane Sandy. Rather,in addition to other military installations, it appears they are engineered primarily for flood control,e.g., holding back the flood waters of a rising river. They are essentially steel mesh baskets filled with sand,gravel,or rock that sit on existing beach grade and have no below grade penetration. Therefore, unlike vertically driven bulkhead sheathing, if the beach grade elevation drops over time or there is reflective scour at the base of the wall that occurs during a storm,the baskets have no sub-grade penetration to protect their integrity. In short, I don't believe these baskets are a desirable or effective solution as a shoreline protection structure in place of a traditionally constructed bulkhead at this location. Rather, like all the other bayfront homeowners who were permitted to reconstruct their legally preexisting bulkheads that were damaged or destroyed during Hurricane Sandy, I believe that Mrs.Chisholm should be granted the same right and should not be effectively punished for having been talked into a bad deal or not having had the finances to replace her shoreline protection structure three years ago. By twice renewing her permit,she has maintained her intent to proceed with restoring her shoreline protection, so I believe the Board should allow her to do so in a manner that will be effective rather than forcing her to pursue installation of the HESCO baskets,which upon failure would place both her dwelling and property and her neighbors' dwellings and property at serious risk of flood and erosion damage during the next major storm event. Finally,with respect to how the application is being processed,you will recall that after you suggested that the amendment request could be processed administratively, I asked you to confirm that with Jay because I did not want to risk having the application tabled at the October meeting. Mrs.Chisholm is anxious to start work as soon as we can complete the permit process, and the recent destruction caused to the Southeast coastline during Hurricane Matthew has only increased her anxiety about her home remaining unprotected any longer. Therefore, it is my sincere hope that given the above information and circumstances that the Board will see fit to approve the modification request as applied for.
