King, President Board of Trustees • • ~ ~~~IV~ Memorandum of Law Goldman Family Irrevocable Trust, Southold JUN I g P013 FACTS ~ ~ An application was filed on May 21, 2013 requesting to restore, repair and replace "Sandy" storm damage to existing house: including but not limited to, cut pocket into existing foundation wall to support new girders, replace supports to enclosed porch, as needed. Remove and rebuild storm damaged masonry foundation under existing house and chimney which was undermined by storm; install new 12" concrete footings, full size, and framing; remove part of decking, as required, to access under the house and replace decking when completed; repair existing deck supports, as required due to storm damage. Plans showing the scope of work were prepared by Joseph Fischetti, PE and were filed with the application. The Sandy storm caused extensive damage in Southold Town to private property. This and many other homeowners have experienced great financial hardship restoring their properties to pre-storm conditions with limited insurance recovery, mostly at their sole cost, and without assistance from FEMA. Emergency permits for Sandy storm damage were issued by the Trustees only if the structures had previously been permitted. Owners with the same degree of damage, whose structures "predated" Trustee jurisdiction, were asked to apply for a permit for all existing structures, whether the structures required repairs or reconstruction, or were merely pre-existing. The subject property pre-dates zoning, pre-dates DEC and Trustee jurisdiction. However, the house and decks have certificates of occupancy. The DEC issued a permit authorizing the owner to repair "the lawfully existing single family dwelling, decks, and walkways, including foundation walls in the same location and footprint, with no additional structures, and with no footings and modifications to the existing septic system." LEGAL ISSUE May a condition be imposed on a land use approval permit (wetland permit or coastal erosion permit which requires a property owner to surrender a recognized and authorized pre-existing nonconforming structure? No, the Trustees are not authorized to demand that a legally existing pre-existing structure be removed. PERMIT CONDITION REQUIRING REMOVAL OF A FUNCTIONING PREEXISTING STRUCTURE VIOLATES ORDINANCE PROTECTIONS FOR NONCONFORMING STRUCTURES AND CONSTITUTES AN UNLAWFUL TAKING OF PROPERTY WITHOUT JUST COMPENSATION It is well established, as a general rule, that a nonconforming use or structure that is in existence when a zoning or land use ordinance is enacted is constitutionally protected and must be permitted to continue, despite contrary provisions in the ordinance. See e.g. Glacial Aggregates LLC v. Town of Yorkshire, 14 NY3d 127, 135 (2010); Jones v. Town of Carroll, 15 NY3d 139, 143 (2010)(and cases cited), rearg. denied, 15 NY3d 820 (2010). The Southold Town Code certainly acknowledges the rule. The provisions of the Town's Zoning code set forth in chapter 280 of the Town Code define a nonconforming structure as one which was legally existing at the time the ordinance, or any amendment thereto was adopted, which fails to conform to the present regulations. Southold Town Code §280-4. Structure is defined as an "assembly of materials, forming a construction framed of component structural parts for occupancy or use." Id. The Town Code also provides that nonconforming uses may be continued indefinitely, so long as they are not enlarged, moved, or discontinued. Southold Town Code §280-122. Under the provisions governing structures within Trustees jurisdiction, similarly, a structure is defined to include inter alia, a building and deck. Southold Town Code §275-2. Under those provisions, nonconforming structures are defined as those that are not otherwise permitted, but are allowed to continue because they were lawfully existing prior to the enactment restricting them. Southold Town Code §275-2. Under the Coastal Erosion Hazard regulations, both maintenance of existing structures and restoration of existing structures is specifically permitted Southold Town Code § 111-6: Normal maintenance is permitted and does not require a permit. Maintenance is defined as "periodic replacement or repair of same-kind structural elements or protective coatings which do not change the size, design or function of a functioning structure. A "functioning structure" is one which is fully performing as originally designed at the time that normal maintenance is scheduled to begin. "Normal maintenance" of a structure does not require a coastal erosion management permit. The existing structures remain functional but require repairs. Even if the repairs to the foundation are considered more than "maintenance", restoration is also permitted and is defined as "the reconstruction without modification of a structure, the cost of which equals or exceeds 50% of the estimated full replacement cost of the structure at the time of restoration. Modifications, however, may be allowed if they do not exceed preexisting size limits and are intended to mitigate impacts to natural protective features and other natural resources. As such, it is clear that the Goldman Family Irrevocable Trust has a protected right in the continuance of their building and deck which has the benefit of a certificate of occupancy from the Town of Southold Building Department. The Trustee's may not impose a condition which requires a property owner to remove legally permitted preexisting structures into conformance with the code as a condition of repairing storm damaged structures. Such a condition constitutes an unlawful taking of owner's property without just compensation. The Trustees have no authority to require any owner to give up their right to continue the nonconforming structure, a right protected under the Town's local ordinances and under the Constitution. CONCLUSION We request that the permit for repair to the lawfully existing single family dwelling, decks and walkways, including foundation walls in the same location and footprint, damaged by storm damage be granted. Such approved plans were prepared by John T. Metzger 4/16/2013. 2. No Changes to Septic System 'I'bis permit does not authorize any alteration, expansion or replacement of existing septic systems. 3. Notice of Commencement At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top portion of the enclosed notification form certifying that they are {ally aware of and understand all terms and conditions of this permit. Within 30 days of completion of project, the bottom portion of the form must also be signed and returned, along with photographs of the completed work. Post Permit Sign The permit sign enclosed with this permit shall be posted in a conspicuous location on the worksite and adequately protected from the weather. 5. No Disturbance to Vegetated Tidal Wetlands There shall be no disturbance to vegetated tidal wetlands or protected buffer areas as a result of the permitted activities. 6. Concrete Leachate During construction, no wet or fresh concrete or leachate shall be allowed to escape into any wetlands or waters of New York State, nor shall washings from ready-mixed concrete trucks, mixers, or other devices be allowed to enter any wetland or waters. Only watertight or waterproof forms shall be used. Wet concrete shall not be poured to displace water within the forms. 7. No Construction Debris in Wetland or Adjacent Area Any debris or excess material from construction of this project shall be completely removed from the adjacent area (upland) and removed to an approved uplvtd area for disposal. No debris is permitted in wetlands and/or protected buffer areas. s. Area of Disturbance for Structures Disturbance to the natural vegetation or topography greater than 25 feet seaward of'the approved structure is prohibited. v. Storage of Equipment, Materials The storage of construction equipment and materials shall be confined within the project work area and/or upland areas greater than 751ineaz feet from the tidal wetland boundary. io. Contain Exposed, Stockpiled Soils All disturbed areas where soil will be temporarily exposed or stockpiled for longer than 48 hours shall be contained by a continuous line of staked haybales /silt curtains (or other NYSDEC approved devices) placed on the seaward side between the fill and the wetland or protected buffer area. `tarps are authorized to supplement these approved methods. n. No Unauthorized Fill Fill shall be strictly limited to that shown on the NYSDEC approved plans. No fill or backfill is otherwise authorized by this permit without further written approval from the department (permit, modification, amendment). 12. Clean Fill Only All fill shall consist of clean sand, gravel, or soil (not asphalt, slag, flyash, broken concrete or demolition debris). 13. Straw Bales or Other at Tidal Wetland A row of staked straw bales or approvable erosion control devices shall be placed at the landward edge of any approved buffer areas or the seawazd edge of the limit of clearing and ground disturbance, or as per the NYSDEC-approved plan, prior to commencement of any regulated activities and remain in place and in good, functional condition until the project is completed and all disturbed areas are stabilised with vegetation. 14. Install, Maintain Erosion Controls Necessary erosion control measures, i.e., straw bales, silt fencing, etc., are to be placed on the downslope edge of any disturbed area. This sediment barrier is to he put in place before any disturbance of the ground occurs and is to be maintained in good and functional condition until thick vegetative cover is established. i5. Seeding Disturbed Areas All areas of soil disturbance resulting from the approved project shall be stabilized with appropriate vegetation (grasses, etc.) immediately following project wmpletion or prior to permit expiration, whichever comes first. If the project site remains inactive for more than 48 hours or planting is impractical due to the season, then the area shall be stabilized with straw or hay mulch or jute matting until weather conditions favor germination. No interference With Navigation There shall be no unreasonable interference with navigation by the work herein authorized. t7. State Not Liable for Damage The State of New York shall in no case be liable for any damage ar injury to the structure or work herein authorized which maybe caused by or result from future operations undertaken by the State for the conservation or improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such damage. IR. State May Order Removal or Alteration of Work If future operations by the State of New Yark require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the people of the State, or cause loss ar destruction of the natural resources of the State, the owner maybe ordered by the Department to remove or alter the structural work, obstructions, or hazards caused thereby without expense to the State, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other modification of the watercourse hereby authorized shall not be completed, the owners, shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood capacity of the watercourse. No claim shall be made against the State of New York on account of any such removal or alteration. 19. State May Require Site Restoration If upon the expiration ar revocation of this permit, the project hereby authorized has not been completed, the applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservatian may lawfully require, rccnove all or any portion of the uncompleted structure or fill and restore the site to its former condition. No claim shall be made against the State of New Yark on account of any such removal or alteration. 211. Precautions Against Contamination of Waters All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project. ~-GENERAL CONDITIONS -Apply to ALL Authorized Permits: I. Facility Inspection by The Department The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals by an authorized representative ofthe Department of F.nviromnental Conservation (the Department) to determine whether the permittee is complying with this permit and the ECL. Such representative may order the work suspended pursuant to ECL 71- 0301 and SAPA 401(3). The permittee shall provide a person to accompany the Department's representative during an inspection to the permit area when requested by the Department. Relationship of this Permit to Other Department Orders and Determinations Unless expressly provided for by the Department,rssuance of this permit does not modify, supersede or rescind any order or determination previously issued by the Department or any of the terms, conditions or requirements contained in such order or determination. 3. Applications For Permit Renewals, Modifications or Transfers The permittee must submit a sepazate written application to the Department for permit renewal, modification or transfer of this permit. Such application must include any forms or supplemental information the Department requires. Any renewal, modification or transfer granted by the Department must be in writing. Submission of Renewal Application The permittee must submit a renewal application at least 30 days before permit expiration for the following permit authorizations: Tidal Wetlands. 5. Permit Modifications, Suspensions and Revocations by the Department The Department reserves the right to exercise all available authority to modify, suspend or revoke this permit. The grounds for modification, suspension or revocation include: a. materially false or inaccurate statements in the permit application or supporting papers; b. failure by the permittee to comply with any terms or conditions of the permit; c. exceeding the scope of the project as described in the permit application; d. newly discovered material information or a material change in environmental conditions, relevant technology or applicable law or regulations since the issuance of the existing permit; e. noncompliance with previously issued permit conditions, orders of the wmmissioner, any provisions of the Environmental Conservation Law or regulations of the Department related to the permitted activity. 6. Permit Transfer Permits are transferrable unless specifically prohibited by statute, regulativn or another permit condition. Applications for permit transfer should be submitted prior to actual transfer of ownership.
