That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized,or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90) calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. SCTM# 1000-53-6-18 Dear Trustees: James and Nancy Clous have applied to reconstruct and extend a dock at the referenced address. The reconstruction is necessary as the storm surge from Hurricane Sandy stripped and destroyed the catwalk and two sets of stairs to the beach. One of the pilings holding the floating docks broke off and the other pilings from the original structure remain. However, all the pilings for the catwalk and floating docks are old and in need of replacement. A bulkhead has also been in place along the entire shoreline of the property with a 20 foot return on the north end of the bulkhead. The bulkhead needs minor repairs and, as such, the bulkhead and return have been included in this application. The catwalk, floating dock and bulkhead were at this location from at least 1974, as recorded by New York State Department of Environmental Conservation aerial photographs taken in that year (see attached). A 1954 aerial photograph clearly shows the bulkhead in-place at its current location. A structure appears perpendicular to the shoreline as well and may have been the original location of the dock. In a 1971 survey contained in the property's Town Building Department files, a structure appears perpendicular to the shoreline as well. It occurs at the location where the existing dock occurs. At those times, a Trustees' permit for a dock or bulkhead was not required. Thus, the original dock is "Unpermitted" per Chapter 275-2 of the Town Code. The same is true of the bulkhead. While the structures are "unpermitted", they are not unlawful as permits for such structures, for example docks, were not required until 1991. The Clous' application also seeks to extend the fixed portion of the dock from 22 to 40 feet to place the floats in deeper waters at low tide. They also had originally applied to add four (4) pilings offset from the floats to allow boats to more readily tie up. That request is hear-by reduced to two (2) pilings. CLSSHD01-Env Rpt ENVIROME UAL REPORT As author of this report, I have been a wetland consultant since 1980. I was personally aware of the existence of the original dock and bulkhead on this property since approximately 1982 or 1983. The reconstructed and proposed, extended dock has not had and will not have a significant impact upon Pipe's Cove. The existing, fixed portion of the dock measures approximately 22 feet long and is 4 feet wide. With the proposed extension, it will extend 18 feet easterly. It has occurred in this pelagic, tidal system for at least some 40 years. In 1974, the dock was some 48 feet long and had at least one float at the easterly end some 12 feet wide by 16 feet long. The dock extends over a sandy/gravelly beach with no wetland vegetation. Eel grass has not been observed on the benthic substrate. The area in and around the dock is still occupied by benthic organisms. Portions of the structure itself have also become encrusted with such species. The reason for this is twofold. First, the fixed structure is narrow enough and high enough that light penetrates well beneath it. The floats are also narrow (i.e., half the width of the 1974 end float). Photosynthetic thresholds occur at approximately 100 foot-candles of light intensity. This level of light does not occur until a location is 12 feet from the ambient light's edge. Since the entire dock is only 4 feet wide at its maximum, it is also only 2 feet to its center, thus, in its existing condition, more than sufficient light enters from both sides as to allow photosynthetic activity and so, the marine environment thrives. Depths at mean low water were measured by B. Laing Associates, Inc. on April 10, 2013 at 5:15 to 6:00 PM. There was a new moon and minimal wave action. Winds wee southwesterly at 10 to 12 MPH. This combination of factors provides a conservatively, shallow low tide. The depth at mean low water at the close/western end of the floating dock is 19 inches and at the far/eastern end is 32 inches . With the 18 foot extension, the close/western end of the floating dock will be 28 inches and at the far/eastern end is 37 inches . At this time, the Clous' have agreed to add a mitigating feature to the reconstructed and extended dock. That is, they will add a grated decking (e.g., Thru-flo® or equivalent) on the fixed portion of the catwalk. This revised feature will allow even greater penetration of light beneath the structure. Secondly, the pilings represent a vertical extension of the habitat. Some vertical habitat is desirable in a marine system. Many marine organisms are sessile and require a firm attachment as they develop. The pilings provide such habitat. The new pilings will be untreated hardwoods. This will be an improvement verses the existing condition, where several of the pilings are older, CCA-treated wood. CLSSHD01-Env Rpt The proposed reconstructed and extended dock will meet the Operational conditions as set forth in Chapter 275-11 C (2) as follows: 1. No vegetated tidal wetland was or will be crossed by the original or proposed structure. No habitats will be fragmented by the original or proposed structure. 2. Public beach access will not be impaired by the by the original or proposed structure as it will have a stairway on either side. 3. Public navigation will not be impaired by the original or proposed structure. 4. The structure will be much shorter than the one, existing dock northward along the shoreline. 5. The extended structure will allow the floats to remain above the bottom during ordinary low tides. 6. The dock will be constructed of durable materials to resist loadings as a result of ordinary use and tides. 7. The facility will be reconstructed of untreated lumber in all locations where new materials are to be used. Tropical hardwoods will only be of the specified, certified or equivalent version. 8. The original or proposed structure will be centered on the 100 foot width of the property and more than 15 feet from adjacent property lines. 9. No structure will be placed on or above the dock. 10. The applicant is the full owner of the abutting, upland property providing access to the original or proposed structure. 11. No electrical or water utilities are proposed for the dock. 12. The original or proposed structure will not exceed one third of the width of Pipe's Cove or Shelter Island Sound. 13. No mesh or other exclusions will extend beneath the deck and pilings will not exceed a height of three feet above the fixed dock's deck. 14. No machine excavation will occur in tidal areas. 15. The floats will not exceed a width of 6 feet. 16. The fixed pier's deck will not exceed a width of 4 feet. 17. Any new pilings will be driven and so, turbidity will be minimized during construction/reconstruction. 18. The number of tie-off pilings requested has been dropped to two (2) to allow for only one boat to use them. 19. The original structure has existed for at least 42 (and possible 69) years. With the proposed extension, it will not impair any significant public vistas. 20. The original structure is only one of two existing docks along the western shoreline of Pipe's Cove. Therefore, no cumulative impact would result from an affirmative decision. 21. The dock owners have more than sufficient lands and facilities to properly service and maintain the boat(s) or watercraft the facility could accommodate when constructed. CLSSHDOI-Env Rpt In summary, the proposed dock reconstruction with a minimal extension will meet the criteria established in Town Code Chapter 275-11 C (2) for issuance of the permit. The existing dock has been in place (including a larger end float in 1974) since at least 1971 and perhaps since 1954 (69 years). It was constructed some 20 to 40 years prior to the Town Trustees' requirement to permit such structures. Although its impact is de- minimus at present, the re-constructed and extended dock will add some mitigating features such as Thru-flo decking and added water depth for the floats. The changes we were asked to consider include; shortening the overall dock,reduce the number of floating docks from two to one and adding a non-turf buffer. We have attached two alternative plan options for your consideration. We have labelled the original plan as Plan A and the two options are Plan B and Plan C. Plan B: The first option achieves the objective of having a single floating dock. However,to get that dock into deep enough water to use for a boat and approximate the DEC suggested depth,the fixed pier had to be extended to 58'. The overall dock structure is 5'shorter than the original Plan A submitted. Plan C: Since the fixed pier in Plan B was significantly longer than the 40'fixed pier in the original Plan A,the Plan B fixed pier would be more in view for my neighbours and it has more length exposed to winter storms,we are submitting a Plan C alternative that has a 33'fixed pier and two floating docks. Only the second seaward floating dock will almost meet the DEC suggested depth for a boat. The advantage of this plan is that there is less of a fixed pier in the view of our neighbours and less risk from exposure to winter storms as the floating docks and ramp are stored elsewhere in the winter for six months of the year. If possible,I would like to discuss these two new options with the Trustee who is presenting my file at the next meeting. I will call the Trustee office to see if I can arrange a call or meeting. We also lost a piling. The original floating docks,ramp and pilings are old and need to be replaced(floating docks were towed into Brick Cove Marina before the storm and are still in tact). Also,as these docks are on Pipe's Cove which can get some wave action,we plan to add four pilings set apart from the docks to better secure our boat. Detailed Plan: Rebuild and replace the existing floating docks,ramp,fixed pier,stairs to beach,stairs from top of bulkhead to fixed pier and related pilings. Two changes will be made to the original structure which include extending the fixed pier from 22'to 40'to move the floating docks to deeper water(West end of floating docks is close to the bottom at mean low water) and we plan to add four new pilings set apart from the floating docks(two on each side of the floating docsk)to provide more secure tie up of our boat(keeps the boat off the dock). In addition,cap boards on the top of the loo foot bulkhead were washed away and plan to be replaced. These are 2 x 12"boards. Also,there was some damage to approximately 1$'of a 4 x 4 transverse beam on the bulkhead where the fixed pier was ripped off in the storm that has to be fixed. The original structure was washed away in Hurricane Sandy. The attached plans are to reconstruct the docks as they originally were built,with two changes. The first change was to extend the fixed pier from 22'to 40'to move the floating docks into deeper water. The second was to add four pilings set apart from the floating docks so that our boat can be tied up and held off the dock.
