WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs
or successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and being in the
Village and Town of Southold, County of Suffolk and State of New York,
bounded southerly by the Main South Road, Westerly by land of John Nierodzik and wife, Northerly
by land of the Long Island Railroad Company, and Easterly by land of Lucy C.G. Brown, said
premises being more particularly bounded and described as follows:
BEGINNING at the southwesterly corner of herein described premises, said point being distant
South 40 degrees 33 minutes 40 seconds East, 303.98 feet from the intersection of the southwesterly
corner of land now or formerly of Moelius with the northerly side of Main Road;
THENCE North.40 degrees 33 minutes 40 seconds West along land now or formerly of Town of
Southold, 2214.17 feet to the southerly line of the Long Island Railroad Co.;
THENCE North 47 degrees 39 minutes 30 seconds East along said Railroad, 317.94 feet to a
monument and land formerly of Lucy Brown, later of M. Surozenski;
RUNNING THENCE along said last mentioned land, the following four courses:
1. South 40 degrees 42 minutes 50 seconds East, 514.80 feet;
2. South 40 degrees 11 minutes 50 seconds East, 530 feet;
13. South 39 degrees 59 minutes 30 seconds East, 660 feet;
4. South 40 degrees 20 minutes 20 seconds East, 519.30 feet;
THENCE South 49 degrees 26 minutes 20 seconds West along land now or formerly of Moelius a
distance of 307.23 feet to the point or place of BEGINNING.
THE GRANTORS herein being the same persons as the named Grantees in deed dated 1/8/89
recorded 1/23/89 in Liber 10783 cp. 76
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances
and all the estate and rights of the party of the first part in and tD said premises; TO HAVE AND TO
HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that. the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture 3o requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
written.
