Gitlin 1180 Smith Drive South Southold, NY 1197 June 17`n. 2013 Board of Trustees Town of Southold Re.: Goose Neck Property Owners Association, Lot 76-3-15.1, ( the" Lot" ) Request for Wetlands Permit for Docks ( the" Amended Application" ) Dear Board Members, My wife, Helga M Potter, and I, are the owners of the adjacent lots east of the above referenced Association Property. We are writing to you to express our objection to the request for the variance applied for in the Amended Application. We enclose a copy of Mr. King's letter to the Association dated June 15`n, 2012, in which he states that any repair or replacement for the Association's docking facility would require a Wetland Permit, and further, that " the docks are infringing on the neighbor's property and should be addressed as well". In the years prior to the submission of the Amended Application, the Docks have not complied with Chapter 275, Wetlands and Shoreline, Section ( 2 ) Paragraph ( 5 ) of the Town Code, which states, " all docks including any vessel tied to the dock shall have a minimum clearance of 15 feet of the seaward extension of any property line from adjacent property parcels ". The Amended Application presents the Trustees the opportunity to see that the placement of the new docks fulfills the minimum clearance requirement specified in paragraph 5. The Amended Application proposes the placing of a 26 foot wide U-shaped Dock for four vessels, on the 50 foot wide shoreline of Lot 15.1. With the vessels each tied to the east and west sides of the dock, the facility would fill 42 feet of the shoreline, ignoring the 15 foot minimum clearance provision of Paragraph 5, and infringes by eleven feet, to within four feet, of both our property line and the Rousseau-Yeh Property line on the west. This is in contrast with the provisions for the 100 foot wide shoreline of the west marina for the placement of a 48 foot wide dock facility for 6 vessels, which including the vessels tied to the east and west sides would be 64 feet wide. So that this facility provides for an 18 foot clearance of the property lines of the adjacent eastern and western parcels, and avoids placing any burden on the owners of those parcels. We feel the request for a variance is inappropriate considering the significant infringement it creates. We support the suggestion for the construction of a centrally placed 4 foot wide dock attached to Lot 15. 1, which with a vessel tied to it on each side would conform exactly with the 15 foot clearance required in Paragraph 5. Historically the Association's docking facilities provided for 4 vessels in each marina. This practice of providing space for 8 vessels in total continues with this modification. In our view it equitably resolves the infringement issue and the resulting over -crowding conditions created by the placement of 4 vessels in the 50 foot wide shoreline of Lot 15.1. Due to a business trip, we will not be able to attend the hearing on. Tune 19, 2013 with regard to the request of the Goose Neck Property Owners Association (GNPA) for the repair/replacement of the two docks on the GNPA property — the East Marina adjacent to our property and the West Marina.. We are writing this letter to express our objection to a proposed variance by the GNPA Dock Committee for placement of a new U-shaped dock on the East Marina. In the original. Application submitted by Mr. Carwa.y on behalf of the GNPA, the two GNPA marinas were to accommodate 7 vessels — 4 in the East Marina, although infringing on neighbors property, and 3 in the West Marina. In the Amendment to the Application of Mr. Carway, a new comprehensive plan from the GNPA Dock Committee is proposed to expand the capacity of the two association marinas to accommodate 10 vessels — 4 vessels in the 50 ft wide East Marina and 6 vessels in the approximatly100 feet wide West Marina. The new proposed U-shaped docking system in the East Marina is visually more appealing. However, with 8 foot wide vessels on both sides of the proposed 26 feet wide dock, it occupies 42 feet of shoreline in the 50 ft wide GNPA property, leaving ONLY 4 feet to our property line and 4 feet to the Gitlin/Potter property line; the 4 ft distance is way below the 15 ft rule in section (2): "Docks," item #5 of the Town Code, Chapter 275, as indicated in our letter submitted for the May 15, 2013 hearing. Hence, we are strongly opposed to allowing the variance requested by GNPA. We believe that the 15 ft rule in the Town Code is meant to preserve the relaxing nature and good neighbor policy of the shoreline, which should be respected. We support the construction of a single 4 ft wide dock in the center of the 50 ft shore line in the East Marina, accommodating 2 vessels. This way the dock will not be congested with vessels; in addition, it will leave exactly 15 feet away from each of our and the Gitlin/Potter property lines and therefore it will not violate the Town Code. With the reduction of 4 to 2 vessels in the East Marina, the GNPA will still be able to increase its docking capacity from 7 vessels to 8 vessels in total, based on their proposed increase in the docking capacity in the West Marina. Box 1179 Southold, NY 11971-0959 Dear Mr. King and Members of the Board of Town Trustees: Re: Goose Neck Property Owners Association request for a wetland permit for existing docks—to be discussed at your 6/19/13 meeting. SCTM#76-3-15.1 & 27: We are homeowners in the mapped neighborhood of Goose Neck Estates and former members of the Goose Neck Property Owners Association (GNPOA). We urge you to grant a permit for repairs on the GNPOA docks in accordance with the current town code. The lack of permits for these docks and the state of disrepair of the docks and marinas jeopardizes insurance coverage for them and increases the risk of liability for all fifty-five homeowners in the neighborhood. Proper permits and repairs would therefore benefit all neighborhood homeowners. As part of code compliance, the GNPOA docks should not continue to encroach on the adjacent properties. The Board of Trustees should in no way allow such encroachment. Any permit granted should require that the GNPOA docks be placed at the regulatory distance from adjacent properties. Thank you for your attention to this matter. Goose Neck Property Owners Association Docks Dear Board Members, We will be unable to attend the meeting on May 15, 2013 with regard to the request of the Goose Neck Property Owners Association for the repair and the placement of the two docks on the Association property (Lot 76-3-15.1) adjacent to our property on 970 Smith Drive South (1000-76-03-16.1). One of the docks on the Association property is in disrepair and the other had a new ramp installed recently. However, it is unclear if that ramp will survive high tides as it does not appear to be properly anchored to the ground. We are particularly sensitive to this issue as boats docked there ended up on our back yard and destroyed our dock during hurricane Sandy. We are also concerned about the placement of the Docks. One is currently 10 ft from our property line. In the application by W. Carway, he states that the Dock will be moved by an additional 5 feet. However, as we understand the Town Code, Chapter 275: "Wetland and Shorelines," section (2): "Docks," item #5, the Dock and any vessel attached to it must be 15 feet from the adjacent property line. Specifically as written in this section of the Town Code: "All docks, including any vessel tied to the dock, shall have a minimum clearance of 15 feet of the seaward extension of any property line from adjacent parcels". Therefore, in addition to the 5 ft movement, the dock should be moved another 8 feet (Le moved 13 ft from its present position) to account for the beam of any vessel attached to the dock. On this basis, only one dock should be permitted in the 50 ft frontage of the Association property to comply with the Town Code regarding the distances of the dock from both the Gitlin/Potter property and our property. This is a modular system constructed of molded white polyethylene. The same configuration will be used at each location and will consist of a U shaped floating dock that is 16 feet by 26 with a center open space of 12 feet by 18 feet. The base sections and the finger extensions will each be 4 feet wide for stability. There will be a 2 feet by 4 feet section at the center point of the base station which will accommodate the travel of the hinged ramp. Each of these configurations will accommodate four boats, each with a maximum beam of 8 feet. The entire project will be done in two stages. For Lot 27, The West Marina, we would like to request docking for six boats altogether. The first stage will for 4 boats, exactly the same as for the East Marina, Lot 15.1. The second stage will add an additional base flotation and one additional finger for 2 more boats. Each docking system will have a single ramp which will be 24 feet by 3 feet and will be salvaged from the existing docking system. One ramp is newly constructed of non -treated wood. The second ramp will be constructed from new or salvaged non treated wood. The ramps will each be hinged to a platform 5 feet by 8 feet that is elevated 2 feet above ground level and will incorporate one step. The platforms will be constructed in part from existing non -treated wood dock elements with Trex decking. The Platforms will be placed with 4 feet of its length on the shore and with two legs submerged in the canal bottom 4 feet from the shoreline. The entire system will be anchored into the canal bottom using six 2 inch galvanized pipes which will be attached to the docks with molded polyethylene pole connectors. A variance from the required 15 feet setbacks on each side of the water front of SCTM # 76-3-15.1 is also requested for the following reasons: 1. The area has historically been used to accommodate 4 boats for at least 40 years. 2. The docks will and have historically been placed so as not to interfere with access and navigation of any boat from the docks of the contiguous properties, 3. The requested fingers of the U are four feet wide. They are manufactured in 2 and four foot widths.
