That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to [he Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject [o the inspection and approval of the Board or its agents, and non-compliance with the provisions of [he originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. Domino O~,COU~ ~„p Fax (631) 765-6641 BOARD OF TOWN TRUSTEES May 15, 2013 TowN of souTxoLD Kathleen & David Kilbride 560 Carter Street New Canaan, CT 06840 RE: KATHLEEN & DAVID KILBRIDE 9045 NASSAU POINT ROAD, CUTCHOGUE SCTM# 118-4-14.1 Dear Mr. & Mrs. Kilbride: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, May 15, 2013 regarding the above matter: WHEREAS, KATHLEEN 8~ DAVID KILBRIDE applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated April 24, 2013, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application to repair existing 100 foot long timber bulkhead, stringers and waters; and replace existing bulkhead cap be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the LWRP Coordinator recommended that the proposed application to replace decking surface of existing 11'x22' deck and extend out another 11'x18' to create an 11'x40' deck be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered the Local Waterfront Revitalization Program policy 6.3 to the greatest extent possible through the imposition of the following Best Management Practice requirements: to reduce size of proposed 11'x40' deck to 11'x28'; and, . 2 ~ • WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on May 15, 2013, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees APPROVES the application of KATHLEEN & DAVID KILBRIDE to repair existing 100 foot long timber bulkhead, stringers and waters; replace existing bulkhead cap; replace decking surface of existing 11'x22' deck and extend out an additional 6' north to create an 11'x28' deck; replace 7'x5' bulkhead platform for beach stairs; and replace existing 4'x16' retractable aluminum stairs to beach; and as depicted on the project plan prepared by Kathleen & David Kilbride, received on June 3, 2013, and stamped approved on June 18, 2013. At the hearing, it is our understanding that the Board approved: (1) Repairs to the cap of the existing timber bulkhead and repairs to bulkhead stringers and whalers as needed. (2) Replacement of decking surface (non-treated) of existing 11' x 22' deck. (3) Replacement of T x 5' bulkhead platform (non-treated decking) for beach stairs. Platform to be re-positioned in a location contiguous to deck area. (4) Expansion of existing deck area by an additional 11' x 6' for a final deck area dimension (existing plus newly approved) of 11' x 28'. We believe that the revised site plan as enclosed with this letter reflects these modifications. We thank the Trustees for your consideration, respectfully recognizing the inordinate work load and burden placed on your offices as a result of Storm Sandy in late 2012. Please let us know if there are any additional details that need to be covered before you would be able to provide a permit for the proposed work to be commenced. The permit only references the stair and I could not find a Board approved survey showing the approval of the deck. Note that I also could not find a permit for the bulkhead. SCTM# 118-4-14.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposal I to repair existing 100 foot long timber bulkhead, stringers and waters; replace existing bulkhead cap is CONSISTENT with the LWRP. Further, it is my recommendation that the proposal to replace decking surface of existing 11'x22' deck and extend out another 11'x18' to create an 11'x40' deck is INCONSISTENT with LWRP Policies 6.3 (below) and therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction s • 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. 275-11 Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: (6) Platforms. (Amended 10-11-2005 by L.L. No. 17-2005; 10-9-2012 by L.L. No. 12-2012] (a) Platforms associated with stairs may not be larger than 100 square feet. (Amended 1-29-2013 by L. L. No. 1-2013] Pursuant to Chapter 275 Wetlands and Shorelines, the proposal to; replace decking surface of existing 11'x22' deck and extend out another 11'x18' to create an 11'x40' deck. The total square feet of the proposed deck would equal 440 and is not a permissible action. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
