IN REGARD TO THE ABOVE REFERENCED PROPERTY, I HAVE VISITED
THE JOB SITE AND OBSERVED THE CONSTRUCTION:
1. THE CONTRACTOR HAS R&BUH.T THE EXISTING REAR DECK
TO THE SAME DIMENSIONS AS THE PREVIOUS STORM DAMAGED
DECK. ADDITIONALLY, A HANDICAP RAMP HAS BEEN BUILT W
CONFORMANCE WITH MY APPROVED PLANS, THUS ALLOWING
WHEEL CHAIR PATRONS TO ACCESS THE REAR DECK AND BUILDING
FROM EITHER THE FRONT OR REAR DOORS. THIS WAS NOT POSSIBLE
BEFORE.
2. THE CONTRACTOR HAS INSTALLED OUTDOOR SEATING AT THE FRONT
OF THE BUILDING COMPLETE WITH A HANDRAHJ BARRIER TO PREVENT
PATRONS FROM FALLING OFF THE DECK. THE PREVIOUS OUTDOOR
WAITING AREA IN THE FRONT HAD NO SUCH SAFETY BARRIER-
3 . THE OWNER/ CONTRACTOR HAS INSTALLED 3 DRAINAGE RINGS IN
THE FRONT PARKING LOT AS DIRECTED BY THE BOARD OF TRUSTEES
TO HANDLE THE RAINFALL BECAUSE OF THE PAVED, IMPERVIOUS
SURFACE OF THE PARKING LOT.
4. THE CONTRACTOR HAS COMPLETED THE COSMETIC REPAIR OF THE
INTERIOR OF THE RESTAURANT WHICH CONSISTS OF REMOVAL AND
REPLACEMENT OF FLOOD DAMAGED GYP. BD., FLOOR COVERINGS,
AS WELLAS WOOD PANELING.
5. THE CONTRACTOR HAS INSTALLED THE NEW SLIDING GLASS DOORS
ON THE REAR OF THE BUILDING, LEADING OUT TO THE REAR DECK AS
PER MY APPROVED PLANS.
6. THE BATHROOMS HAVE BEEN UPDATED WITH NEW GYP. BD, PAINT, FLOOR
TILE AND BATHROOM FIXTURES. HOWEVER; I HAVE INFORMED THE
OWNER/
CONTRACTOR THAT THE HANDICAP GRAB BARS THAT I HAVE INCLUDED

SIDE OF THE BUILDING IN THE SAME LOCATION AS THE OLD FLOOD

AUTHORIZATION
Pursuant to the provisions of Chapter 275 of the Town Code of the Town of Southold and in
accordance with the Resolution of the Board of Trustees adopted at the meeting held on June 19, 2013, and in
consideration of application fee in the sum of $250.00 paid by Formulal Motorsoorts. Inc. and subject to the
Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees authorizes and permits
the following:
Wetland Permit for repairs to the existing restaurant; remove the existing
1,215sq.ft. wood deck on southerly and easterly side, and construct in its place a new
raised concrete platform with steps to grade and railings with no increase in size;
replace handrail on existing handicap ramp; and replace existing outdoor walk-in-
freezer box in-place; with the condition of the installation of gutters to leaders to
drywells and in accordance with Chapter 236 of the Town Code-Stormwater
Management; and as depicted on the site plan prepared by Joseph Michael Gratzer,
Architect, received on May 8, 2013, and stamped approved on June 19, 2013.
IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.

TERMS AND CONDITIONS
The Permittee, WJI Holding Corp. C/O Walter Illigasch located at 400 Old Main Road,
Southold, New York as part of the consideration for the issuance of the Permit does understand
and prescribe to the following:
l . That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
8. That the said Board will be notified by the Permittee of the completion of the work
authorized.
9. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Mr. Gratzer:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, June 19, 2013 regarding the above matter:
WHEREAS, Joseph Michael Gratzer on behalf of WJI HOLDING CORP. C/O WALTER
ILLIGASCH applied to the Southold Town Trustees for a permit under the provisions of
Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of
Southold, application dated May 8, 2013, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, in accordance with Chapter 268, said application was found to be Exempt
from the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on June 19, 2013, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approve the application of WJI HOLDING
CORP. C/O WALTER ILLIGASCH for repairs to the existing restaurant; remove the
existing 1,215sq.ft. wood deck on southerly and easterly side, and construct in its place
a new raised concrete platform with steps to grade and railings with no increase in size;
replace handrail on existing handicap ramp; and replace existing outdoor walk-in-
freezer box in-place; with the condition of the installation of gutters to leaders to drywells
and in accordance with Chapter 236 of the Town Code-Stormwater Management; and

Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the

Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

At the meeting of the Southold Town Conservation Advisory Council held Wed., June 12,
2013 the following recommendation was made:
Moved by Peter Young, seconded by Jack McGreevy, it was
RESOLVED to SUPPORT the application of WALTER ILLIGASCH to rebuild rear deck,
repair flood damage to building including new sliding glass doors, flooring, appliances, ice
box, light fixtures and railings for existing ramp.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
determination that the actions are EXEMPT from LWRP review pursuant to:
§ 268-3. Definitions. MINOR ACTIONS item "A" and "B" which state:
A. Maintenance or repair involving no substantial changes in an existing structure or
facility.
B. Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the
same site (inplace), including upgrading buildings to meet building or fire codes, except
for structures in areas designated by the Coastal Erosion Hazard Area (CEHA) law
where structures may not be replaced, rehabilitated or reconstructed without a permit
and shoreline erosion control structures (including, but not limited to, groins, jetties,
bulkheads, filled piers) located within Great Peconic Bay, Cutchogue Harbor, Little
Peconic Bay, Hog Neck Bay, Noyack Bay, Southold Bay, Shelter Island Sound, Pipes
Cove, Orient Harbor, Gardiners Bay, Long Island Sound, Fishers Island Sound and
Block Island Sound (excluding all creeks);
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

In regard to the above referenced property, the building owner wishes to rebuild the existing restaurant
that was damaged as a result of Hurricane Sandy. With regard to the exterior, the owner wishes to
remove the existing storm damaged wood deck at grade on the southerly and easterly side and install in
its place a new raised concrete platform w/ steps to grade according to the same dimensions with no
increase in size. The existing handicap ramp will have a new handrail installed according to code as will
the deck.
Of further import, the owner will be replacing the walk in freezer box on the exterior right (west) side of
the building which was damaged by the hurricane.

1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its sigmfcant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).

affect the achievement of the LWRP policy standards and conditions contained in the consistency

In regard to the above referenced address, the homeowner has sustained non-structural
damage to the interior of the restaurant as a result of hurricane Sandy. The damage is essentially
cosmetic in nature (i.e. new gypsum board walls, new plywood subfloor, new finished flooring), but also
contains exterior work such as re-building the rear deck which was destroyed as a result of the flooding.
Of further import, the scope of work also includes replacement of kitchen appliances in the food prep
area, recharge/replace the existing ANSUL fire suppression system, hot water heater and walk in ice box.
The existing handicap ramp will also have a new hand rail conforming to the State code for guards and
height.
All work included in this application will be confined to replacing/ rebuilding items already existing in
the restaurant; no new work is included in this application. The rear deck will be re-built within the
confines of the existing footprint with no additional square footage.
