During a site inspection by the Building Department in response to an application for an updated Certificate of Occupancy submitted by the applicants, it was found that during the recent past, the following work was conducted on the dwelling without permits: a 10' x 10' sunroom was added to the waterside of the dwelling less than 75' from the bulkhead and within the Coastal Erosion Hazard Area (CEHA); an approximately 24' x 34' preexisting deck located less than 75' from the bulkhead and within the CEHA was reconstructed and expanded by a 5' x 16' section of deck on the west side of the dwelling outside the CEHA but less than 75' from the bulkhead; and a preexisting 4' x 14' porch on the landward side of the dwelling was reconstructed. In addition to requiring a Wetlands Permit, a proposal to legalize these structures would have required a Coastal Erosion Management Permit (CEMP) for the sunroom addition and deck (whose top surface area exceeds 200 sf) and variance relief from the ZBA for all structures noted above due to setback and lot coverage nonconformities. Therefore, to eliminate all zoning nonconformities and the need for a CEMP and to reduce the wetland setback nonconformity, the applicants propose to remove the sunroom; to replace the front porch with a small stoop; and to replace the deck with a 199 square-foot at-grade masonry patio, an unregulated activity pursuant to Chapter 1 11. Therefore, the only approval required before a Building Permit could be obtained is a wetlands permit for the new 4' x 6' stoop on the landward side of the house and the 199 sf masonry patio with 2 small access stoops on top of it, as described in the project description and depicted on the site plan prepared by Nathan Taft Corwin III, last dated May 17, 2013. Therefore, the effects of the project are a reduction in the size of the dwelling; a reduction in the lot coverage of the property; and an increase in wetlands setbacks, all resulting in a net benefit to the environmental condition of the property and adjacent beach and tidal wetlands as compared to what is presently existing.
