The last wetlands permit (8010) was issued on January, 2013 and approved the "reconstruction of the variable width deck". The cabana was not applied for in the application and was not included in the permit. A site inspection was constructed on May 23, 2013. ~i Request for Variances from Article XXII Section 280-116 (B)and Article III, Section 280-15 and the Building Inspector's March 21, 2013 Notice of Disapproval based on an application for building permit for demolition and re-construction of a cabana/shower and decking, at; 1) less than the code required bulkhead setback of 75 feet, 2) less than the code required 10 foot setback for accessory structures, 3) the proposed cabana is not a permitted accessory use, located at: 7725 Nassau Point Road (adj. to Little Peconic Bay) Cutchogue, NY. SCTM#1000-118-4-5 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my determination that the proposed action is INCONSISTENT with the below listed LWRP policy and therefore INCONSISTENT with the LWRP: Policy 4.1. "Minimize losses of human life and structures from flooding and erosion hazards." The following management measures to minimize losses of human life and structures from flooding and erosion hazards are recommended: spec~cally ~ A. Minimize potential loss and damage by locating development and structures away from Flooding and erosion hazards. 2. Avoid reconstruction of structures, other than structures that are part of a water- dependent use, damaged by 50% or more of their value in coastal hazard areas. Site inspection and photos in the Board of Trustees file determine that the cabana and deck were heavily damaged during Tropical Storm Sandv. The deck was "washed away" and heave wave damage to the cabana is evident. 3. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas maybe warranted for. a. structures which functionally require a location on the coast or in coastal waters. The structures do not functionally require a location on the coast and is not water dependent. 5. Manage development in floodplains outside of coastal hazard areas so as to reduce adverse environmental effects, minimize the need for future structural flood protection measures, or expansion of existing protection measures and to meet federal flood insurance program standards. The action is located in the VE (velocity hazard) Flood Zone - EI 9' (Figure 11. VE zones are defined as areas with special flood hazards associated with high-velocity waters generated by tidal surges and hurricane wave wash. Accessory structures i located within these areas have the uotential to suffer high rate of loss and pose hazards to life and property during storm surge events. Subject parcel showing cabana (in part) and deck located within the VE (Velocity hazard) EI 9 Flood Zone. ~ Further, this proposal includes shifting a newly constructed cabana to the west which would encroach into the bank/bluff (a protected natural feature). The shift would result in additional removal of bluff vegetation and overall area. A 4' x 6' drywell is proposed on the bank/bluff sloce further compromising the stability of the bluff (once restored). Pursuant to Chapter 268, the Board shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. AMENDED APPLICATION: A revision to this application with the October 31, 2005 by Fairweather-Brown Design Associates map (proposed floor plan and elevations) was received from the applicant with the Building Inspector's October 28, 2005 revised Notice of Disapproval reelecting changes, adding a half bathroom (toilet and utility sink). FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this appliptlon on December 15, 2005 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE RELIEF REQUESTED: The applicant wishes to alter the existing garage by adding dormers, creating an open second-story room with head space, for use as an artist studio workshop, as shown on the plans revised 10/31/05 by Fairweather-Brown Design Associates, Inc. with a ZBA date stamped November 3, 2005. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. The existing height of the garage from ground to the top of the ridge is 20' 3'/." with the mid-ridge height al 14' 3-1/8". The proposed mid-ridge height will be 15' 9" and the proposed height from existing ground to the new ridge will be 21' 8 Y,". The dormer addition will be at the front edge of the garage roof, with four columns added. The accessory building will remain as a two-car garage and the applicant is not requesting sleeping or living area, limiting the plumbing to a half bathroom and utility sink(s) as shown on the revised October 31, 2005 plans. For these reasons, grant of the variance will not produce an undesirable change in the character of the neighborhood or a deViment to nearby properties. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant wishes to convert the existing attic above their two-car garage for their own artist workshop with dormers and half bathroom, which is not permitted for accessory buildings without some type of relief from the code resVictions. 3. The variance granted herein is not substantial. 4. The difficulty was created when the homeowner planned changes to re-design the existing two-car garage and convert the existing attic for more headroom and facilities for a private artist work area. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an addition and alteretions, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
