Request for Variances Article XXII Section 280-116 (B) and Article III, Section 280-15F the Building Inspector's April 29, 2013 Notice of Disapproval based on an application for building permit to demolish existing single family dwelling, construct new single family dwelling and accessory garage at; 1) proposed construction at less than the code required bulkhead setback of 75 feet, 2) accessory garage proposed in location other than code required rear yard or in the case of waterfront property may be located,in the front yard provided it meets the principal setback, located at: 640 West Shore Drive (adj. to Southold Bay) Southold, NY. SCTM#1000-80-1-47.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my determination that the proposed action is CONSISTENT with the below listed LWRP polices and therefore CONSISTENT with the LWRP provided the Board requires the following best management practices to further the below listed policies. Policy 6.3 Protect and restore tidal and freshwater wetlands. D. Provide adequate buffers between wetlands and adjacent or nearby uses and activities in order to ensure protection of the wetland's character, quality, values, and functions. The oroaertv is sloped towards the tidal water body. In the event that the actlon is approved it is recommended that a 10' wide landscaped buffer be established landward of the too of bank " top slope" to further this poiiv. Chapter 268 of the Southold Town Code defines a landcaped buffer as - "A land area of a certain length and width which is planted with indigenous, drought-tolerant vegetation similar to that found within the immediate proximity of the parcel. Vegetation shall be installed in sufficient densities to achieve 95% ground cover within two years of installation. Survival of planted .vegetation shall be 90% for a period of three years. Maintenance activities within the buffer are limited to removing vegetation which is hazardous to life and property, trimming tree limbs up to a height of 15 feet to maintain viewsheds, replanting of vegetation and establishing afour- foot-wide access path constructed of pervious material for access to the wafer body." Pursuant to Chapter 268, the Southold Town Zoning Board of Appeals shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. All applicants for pemmts* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law.
