An amendment to the permit to allow a 10'x15' gazebo was approved on April 17, 2013. Request for Variance from Article XXII Code Section 280-116(6) based on an application for building permit and the Building Inspector's April 24, 2013 Notice of Disapproval concerning a permit for a 10'X15' covered deck/gazebo, at; 1) proposed structure at less than the code required bulkhead i setback of 75 feet, located at: 8630 Peconic Say Boulevard, (adj. to Great Peconic Bay and Private Road) Laurel, NY. SCTM#1000-126-5-1 A site inspection was conducted on June 26, 2013. The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my determination that the proposed action is INCONSISTENT with the below listed LWRP policy and therefore INCONSISTENT with the LWRP: Policy 4.1. "Minimize losses of human life and structures from flooding and erosion hazards." The following management measures to minimize losses of human life and structures from h flooding and erosion hazards are recommended: specifically A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 2. Avoid reconstruction of structures, other than structures that are part of a water- dependent use, damaged by 50% or more of their value in coastal hazard areas. I The covered deck/ azeb g o were severely damaged during Tropical Storm Sandv due to the location of the structure in a vulnerable area. 3. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas maybe warranted for. a. structures which functionally require a location on the coast or in coastal waters. The structure does not functionally require a location on the coast and is not water dependent. 5. Manage development in floodplains outside of coastal hazard areas so as to reduce adverse environmental effects, minimize the need for future structural flood protection measures, or expansion of existing protection measures and to meet federal flood insurance program standards. The gazebo is located iust landward of the the VE (velocity hazard) Flood Zone. The covered deck is located within the VE zone (Figure 1). The entire structure is located within the SLOSH mapped Category 2 zone (Figure 21. SLOSH stands for Sea, Lake, and Overland Surge from Hurricanes. It is a computer model developed by the National Weather Service (NWS) to estimate stone surge heights and winds resulting from historical, hypothetical, or predicted hurricanes. Astronomical tides can add significantly to the water height. The model accounts for tides by specifying the initial tide level. The SLOSH model does not include rainfall amounts or wind-driven waves. These need to be combined with the model results in the final analysis of at-risk areas. SLOSH is best used for defining the potential flooding from storm surge for a location from a threatening hurricane, rather than as a predictor of the specific areas that will be inundated during a particular event. Accuracy for the SLOSH model is generally within plus or minus 20% of the peak storm surge. If the model calculates a peak storm surge of 10 feet for the event, you can expect the observed peak to range from 8 to 12 feet. The accuracy of plus or minus 20% is fora known hurricane track, intensity, and size, based on looking at surge measurements (primarily high water marks) from past hurricanes (NOAA) Accessory structures located within these areas have the potential to suffer high repeatable rate of loss and pose hazards to life and propefir during storm surge events. I Pursuant to Chapter 268, the Board shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action.
