SCTM#1000-70-4-15.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my determination that the proposed action is CONSISTENT with the below listed LWRP polices and therefore CONSISTENT with the LWRP provided the Board requires the following best management practices to further the below listed policies. Policy 6.3 Protect and restore tidal and freshwater wetlands. D. Provide adequate buffers between wetlands and adjacent or nearby uses and activities in order to ensure protection of the wetland's character, quality, values, and functions. An undesirable change will not be produced in the CHARACTER of the neighbor or a detriment to nearby properties if granted, because the proposed screen porch and in ground swimming pool are characteristic of residential properties and are both located in the rear yard and will not be seen from the street. 2. The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than the area variance, because the entire rear yard of the property is within the 75' setback line due to the side returns of the bulkheads. The proposed construction would be required to be located in the front yard to meet the setback requirements. This would create an undesirable change in character of the neighborhood. The screen porch is being constructed over an existing deck which is within the 75' setback. There will not be any additional encroachment due to the construction of the screen porch than already exists with the deck. 3. The amount of relief requested is not substantial because the proposed screen porch is being built over an existing deck which is in anon-conforming location. The screen porch is an open structure and will not be enclosed or heated. It is a seasonal use. The pool and terrace design utilizes the existing slope of the property to create multiple terrace levels. This allows the pool to be located as far from the bulkhead as possible by splitting the two terraces. It also allows the height of the pool waH to be Tess than if the lower terrace didn't exist. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because the proposed construction will retain all water on site via new drywells and the swimming pool will have a separate drywell for backwash discharge. All pool equipment will be located beyond the 75' setback and be state of the art environmentally responsible and energy efficient. 5. The alleged difficulty has NOT been self created because it is the result of a pre- existing situation where the bulkhead returns have substantially diminished the use of the rear yard.
