Located: 335 South Drive, Mattituck. SCTM# 106-11-19 The proposed action has been reviewed to Chapter 268, Watertront Consistency Review of the Town of Southold Town Code and the Local Watertront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my determination that the action is EXEMPT from LWRP review pursuant to: § 268-3. Box 1179 Southold, NY 11971 MAY 2 8 2613 Re: Veliko and Steahanie Krstulovic, 335 South Drive Mattituck utholdTown r h e Deaz Mr. Terry: Attached please find a copy of an application being filed with the Board of Trustees for a Town Wetlands Permit to add sheathing to the landwazd side of a small portion of an existing timber bulkhead to remain and also to add sheathing below the lower waler on the seaward side of the the structure as needed, all for the purpose of maintaining the integrity of the existing bulkhead, as depicted on the project plan prepared by En-Consultants, dated May 22, 2013. I have attached an LWRP Consistency Application Form with all polici n ica "Not Applicable" due to our understanding that the proposed work constitute a "minor action' not subject to waterfront consistency review pursuant to §268-5, "Review of A 'ons: ' Spe ' >cally, the work appears to conform to the following definition of minor action "A" liste er §286-3: "Maintenance or repair involving no substantial changes in an existing structure or facility." Because the bulkhead is located in Mattituck Creek, minor action "GG" would appear to exempt from review the complete replacement of the bulkhead, but since only the above described maintenance and repair work is proposed at this time, I am not sure this definition would be applicable.
