Re: Proposed Wetland Permit for RALPH VIVINETTO
SCTM#1000-70-4-17
Carl Governale on behalf of RALPH VIVINETTO requests a Wetland Permit to construct a
4'x75' fixed catwalk, a 4'x12' hinged ramp; and a 6'x20' floating dock with two (2) 6" diameter
mooring piles. Located: 2595 Wells Avenue, Southold. SCTM# 70~-17
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposed action is INCONSISTENT with the LWRP listed policy
standards provided below.
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
(b) Dock locations and lengths. (Amended 10-11-2005 by L.L. No. 17-2005]
(1] No dock shall be erected or extended if, in the opinion of the Trustees, such structure
would adversely affect navigation, fisheries, shell fisheries, scenic quality, habitats or wetland
areas.
(2] Within creeks and other narrow waterways, no dock length shall exceed 1/3 the total width
of the water body. Determination of the length of the dock must include the dimensions of the
vessel.
1. The dock structure may exceed the 113 total width of the creek; the
dimensions of a vessel are not shown.
9.3 Preserve the public interest in and use of lands and waters held in public trust by
the state and the Town of Southold.
A. Limit grants, leases, easements, permits or lesser interest in lands underwater in
accordance with an assessment of potential adverse impacts of the proposed use,
structure, or facility on public interest in public lands under water.
7. The dock structure will extend into public water and result in a net
decrease in public access to/on public underwater lands.
In the event that the action is approved, it is recommended that anon-disturbance
buffer be established landward of the wetland line.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.
