Located: 400 Old Main Road, Southold. SCTM# 56-6-7 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my determination that the actions are EXEMPT from LWRP review pursuant to: § 268-3. Definitions. MINOR ACTIONS item "A" and "B" which state: A. Maintenance or repair involving no substantial changes in an existing structure or facility. 8. Replacement, rehabilitation or reconstruction of a structure or facility, in kind, on the same site (inp/ace), including upgrading buildings to meet building or fire codes, except for structures in areas designated by the Coastal Erosion Hazard Area (CEHA) law where structures may not be replaced, rehabilitated or reconstructed without a permit and shoreline erosion control structures (including, buf not limited to, groins, jetties, bulkheads, filled piers) located within Great Peconic Bay, Cutchogue Harbor, Little Peconic Bay, Hog Neck Bay, Noyack Bay, Southold Bay, Shelter Island Sound, Pipes Cove, Orient Harbor, Gardeners Bay, Long Island Sound, Fishers Island Sound and Block Island Sound (excluding all creeks); Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. With regard to the exterior, the owner wishes to remove the existing storm damaged wood deck at grade on the southerly and easterly side and install in its place a new raised concrete platform w/ steps to grade according to the same dimensions with no increase in size. The existing handicap ramp will have a new handrail installed according to code as will the deck. Of further import, the owner will be replacing the walk in freezer box on the exterior right (west) side of the building which was damaged by the hurricane.
