Located: 3300 Sound Drive, Greenport. SCTM# 33-1-6 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed actions are CONSISTENT with the LWRP Policies and therefore, CONSISTENT with the LWRP. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Ehlers Land Surveyor, last dated May 1, 2013. I have attached a LWRP Consistency Application Form with all policies indicated as "Not Applicable" due to our understanding that the proposed activities constitute "minor actions" not subject to waterfront consistency review pursuant to §268-5, '`Review of Actions." Specifically, the proposed 200 square-foot swimming pool and 50 square foot hot tub would each (or even together) appear to meet the following definition of a minor action listed under §286-3, "Definitions:" "CC. Structures less than 250 square feet in size that are accessory to existing permitted primary structures, and which accessory structures are greater than 50 feet from a boundary of a natural protective feature and freshwater or tidal wetlands." However, should you determine the project not to be exempt from waterfront consistency review and require additional from me, please let me know.
