Docko, Inc. on behalf of HAROLD WILMERDING & ALEX WILMERDING request a Wetland
Permit and a Coastal Erosion Permit to construct a 47LF. x Oft. wide fixed wood pile and timber
pier including 4 tie-off piles; an associated 3.5'x24' hinged ramp; a 8'x16' float; and restraint
pilings, all waterward of the apparent high water line. Located: 4997 Equestrian Avenue,
Fishers Island. SCTM# 9-9-3.1
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment
Form submitted to this department, as well as the records available to me, it is my
recommendation that the proposal is INCONSISTENT with LWRP Policies 4.1 (below) and
therefore, INCONSISTENT with the LWRP.
4.1 Minimize losses of human life and structures from flooding and erosion hazards.
The following management measures to minimize losses of human life and structures
from flooding and erosion hazards are suggested:
A. Minimize potential loss and damage by locating development and structures
away from flooding and erosion hazards.
1. Avoid development other than water-dependent uses in coastal hazard
areas. Locate new development which is not water-dependent as far
away from coastal hazard areas as practical.
a. No development is permitted in natura? protective feature areas,
except as specifically allowed under the relevant portions of 6
NYCRR 505.8.
A portion of the proposed dock is within the Coastal Erosion Hazard Area (CEHA). All
development is prohibited in the nearshore area pursuant to § 111-11. unless specifically
provided for by Chapter 111, COASTAL EROSION HAZARD AREAS. Pursuant to § 111-6,
allowable activities in these areas may include open timber wiles or other similar open
work supports with a top surtace area of less than 200 square feet which are removed in
the fall of each year. Therefore, the dock, as proposed, is prohibited in the nearshore area
pursuant to Chapter 111, COASTAL EROSION HAZARD AREAS as it is greater than 200
square feet and not removable.
In the event that the action is improved it is recommended that the Board clarify if the
pilings will be treated with CCA. If so, an alternative to CCA treated pilings is
recommmeded.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in
preparing its written determination regarding the consistency of the proposed action.

` LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete this
CCAF for proposed actions that are subject to the Town of Southold Waterfront
Consistency Review Law. This assessment is intended to supplement other
information used by a Town of Southold agency in making a determination of
consistency. *Except for minor exempt actions including Building Permits and other
ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the prepazer of this form should review
the exempt minor action list, policies and explanations of each policy contained in the
Town of Southold Local Waterfront Revitalization Program. A proposed action will
be evaluated as to its significant beneficial and adverse effects upon the coastal azea
(which includes all of Southold Town).
3. If any question in Section C on this form is answered "yes" or "no", then the
proposed action will affect the achievement of the LWRP policy standazds and
conditions contained in the consistency review law. Thus, each answer must be
explained in detail listin¢ both supportive and non-snouortine falls. If an action
cannot be certified as consistent with the LWRP policy standards and conditions, it
shall not be undertaken.

character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a
coastal location, and minimizes adverse effects of development. See LWRP Section III -Policies;

environmental desien factors published by the NYS DEC. and the DOS Coastal Management Program,

cove which is surrounded by trees The portion of the facility visible from the Kennedv's home the
south will look substantially the same as her own dock facility and Mr. Wilmerding's dock beyond this

This proiect is consistent with this policy because it proposes the elevation of the Hier at an acceptable
heisht above the bottom sediments through which adjacent tidal wetlands vegetation may spread, the
dock site however is so rocky in nature surroundine the west shore of the cove that vegetation alone the
shoreline is minimal The pier spans over a shoreline boulder where no wetlands vegetation crows, and
so no adverse impact on tidal vegetation is anticipated as a result of the proposed project No submersed
aquatic vegetation was observed at the dock site or along the shorefront durins the survey. In addttton,
the NYS DEC prepared a study showing that the proposed pressure-treated Southern Pme tunber
products construction materials are suitable for this type of project in this location, except for deckmg
which will be of untreated woods or composite (or plastic) materials.
As mentioned earlier the design parameters shown on the drawings provides an optimum balance
between acceptable design and access standards without depriving the wetlands vegetation the
opportunity to spread.
