WITNESSETH,that the party of the first part, in consideration of Ten Dollars and other valuable consideration
paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate,
lying and beingincsbo: at Indian Neck Lane, near Peconic, in the Town of Southold,
County of Suffolk, State of New York, bounded and described as follows:
BEGINNING at a point on the southerly line of Indian Neck Road at the northwesterly
corner of land of Guy Heater, and running thence along said land of Heater and along
land of Richard Allen s. 240 04' 10" E. 858.46 feet; thence continuing along said
land of Allen N. 650 55' 50" E. 34.81 feet to land of Dr. Samuel Cohen; thence
along said land of Cohen S. 270 05' 50" E. 500 feet, more or less, to ordinary
high water mark of Peconic Bay; thence southwesterly along said high water mark
221 feet, more or less, to land of Seagyan Club, Inc. ; thence along said land of
Seagyan Club, Inc. N. 230 25' 20" W. 775 feet, more or less, to land of Nicholas
Bernhardt; thence along said land of Bernhardt 2 courses:
1) N. 660 34' 40" E. 133.07 feet; thence
2) N. 240 04' 10" W. 622.0 feet to the southerly line of Indian Neck Road; thence
along said line of Indian Neck Road N. 750 22' 20" E. 16.22 feet to the point of
BEGINNING. _
Subject to rights of way over a strip of land 16 feet in width, the easterly line
of which is the westerly line of said lands of Heater and Allen and the northerly
portion of said land of Cohen; and the westerly line of which is the easterly line
of said land of Bernhardt and its extension southerly for about 250 feet to the
southerly line of a 16 foot right of way running easterly about 55 feet to said
land of Cohen.
BEING AND INTENDED TO BE the same premises conveyed to the party of the first part
by deed dated September 24, 1992 and filed in the Office of the Clerk of Suffolk
County on October 23, 1992 in Liber 11560 at page 590.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all
the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the
TAX MAP second part forever.
DESIGNATION
D"t' AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
$M. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the
first part will receive the consideration for this conveyance and will hold the right to receive such consideration
BIR. as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same
first to the payment of the cost of the improvement before using any part of the total of the same for any other
Lot(.): purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
