THIS INDENTURE, made the i~-rW~day of December, 2012, between Roberta Lee,
residing at 26850 Main Street, Cutchogue, New York 11935, as Surviving Tenant by the
Entirety of Manfred Lee, who died a fesident of Suffolk County on November 11,2011,
party of the first part, and
Jessica Lee, Trustee of The Roberta Lee Irrevocable Property Trust, of 26850 Rt 25 Main
Road, Cutchogue, New York 1 t935, ~
party of the second part,
WITNESSETH that the party of the first part, in consideration of ten ($10.00) dollars
and other valuable consideration paid by the party of the second part, does hereby grant and
release unto the party of the second 'part, the heirs or successors and assigns of the party of
the second part forever,
All that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at Cutchogue, in the Town of Southold, County of
Suffolk,and State of New York, bounded and described as follows:
BEGINNING at a point marked by a concrete monument in the southerly side of Main Road
at the point where the westerly line of land of Presbyterian Parsonage intersects said
southerly side of Mail Road and which point or place of beginning is distant westerly 290.24
feet from the comer formed by the intersection of the westerly side of Cases Lane and the
southerly side of Main Road; ~
RUNNING THENCE along said land of Presbyterian Parsonage, South 14degrees 18
minutes 50 seconds East 343.77 feet to a concrete monument and land of Horton; ~
THENCE along said land South 71 degrees 40 minutes 50 seconds West ~ feet to a
concrete monument and other land of Horton; ~
THENCE along said land and land of Merdo, North 18 degrees 37 minutes 20 seconds West
321.09 feet to a concrete monument;
THENCE along the southerly side of Main Road, North 68 degrees 40 minutes 30 seconds
East 326.40 feet to a concrete monument;
THENCE still along the southerly side of Main Road, North 58 degrees21 minutes 40
seconds East 20.60 feet to the point or place of BEGINNING.
BEING the same premises transferrei:l to the Grantor by deed dated October 29th, 1987 and
recorded at the Suffolk County Clerk's Office on December 2, 1987 at Liber 10482, Page
501.
TOGETHER with all right, title, and interest, if any, of the party of the first part of, in, and to
any streets and roads abutting the above-described property to the center lines thereof;
together with the appurtenances and ,all the estate and rights of the party of the first part in
and to said property; To Have and to Hold the property herein granted unto the party of the
second part, the heirs or successors and assigns of the party of the second part forever.
And the party of the first part c6venants that the party of the first part has not done or
suffered anything whereby the said property has been encumbered in any way whatsoever,
except as aforesaid.
And the party of the first part, in Compliance with N.Y. Lien Law § 13, covenants that the
party of the first part will receive the consideration for this conveyance and will hold the
right to receive such consideration as a trust fund to be applied first for the purpose of paying
the cost of the improvement and will apply the same first to the payment of the cost of the
improvement before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this
indenture so requires.
