Located: 2235 Cedar Lane, East Marion. SCTM# 37-4-7 It is my recommendation that the proposed action is INCONSISTENT with LWRP Policy 6.3 (below) and therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and Other lands under their jurisdiction Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The installation of an elevator boat lift is not a permissible action pursuant to Chapter 275-11 Construction and operation standards (2.) DeLucca, R.A. on behalf of MARY HUETTERMOSER requests a Wetland Permit to replace the existing wood bulkhead with vinyl sheet bulkhead with approximately 4.5' penetration into the soil after maintenance dredging; maintenance dredging with the removal of approximately 45 cubic yards of material in front of the proposed replacement bulkhead 10' out to a depth of -3.75'; dredged material will be spread on front yard of existing site. Located: 2235 Cedar Lane, East Marion. SCTM# 37-4-7 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP provided that the Board considers the following: In the event that the action is approved the following BMP is required pursuant to: § 275-11. Construction and operation standards. A. General. The following standards are required for all operations within the jurisdiction of the Trustees: (2) Erosion control. Installation of an erosion control structure is necessary during any building, grading, landscaping or site work activity within Trustee jurisdiction. This structure may include, but is not limited to, installation of a silt fence, hay bales, wood chip berm and silt booms. The placement of the erosion control structure(s) shall be determined by the Trustees or their designee. All intertidal construction and excavation requires the installation of a silt boom that will retain all suspended sediments within the immediate project area. Require the installation of a silt boom in areas where practicable. The action indicates that the dredge spoil will be spread out on the front lawn of the property. This is not recommended. An alternative site should be identified. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Cc: Lori Hulse, Assistant Town Attorney BOARD OF SOUTHOLD TOWN TRUSTEES SOUTHOLD, NEW YORK PERMIT NO. 7914 DATE: SEPTEMBER 19, 2012 ISSUED TO: MARY HUETTERMOSER PROPERTY ADDRESS: 2235 CEDAR LANE, EAST MARION SCTM# 37-4-7 AUTHORIZATION Pursuant to the provisions of Chapter 275 of the Town Code of the Town of Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on September 19, 2012, and in consideration of application fee in the sum of $250.00 paid by Mary & James Huettermoser and subject to the Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees authorizes and permits the following: Wetland Permit to replace the existing wood bulkhead with vinyl sheet bulkhead with approx. 4:5' penetration into the soil after maintenance dredging; maintenance dredging with the removal of approx. 45 cy. of material in front of the proposed replacement bulkhead 10' out to a depth of-3.75'; with the conditions of installation of a silt-boom in all intertidal construction and excavation areas; establish and subsequently maintain a 10' wide non-turf buffer from top of bulkhead landward on both sides; and dredge spoil to be deposited to an approved upland source; and as depicted on the project plans prepared by James V. de Lucca, R.A., received on October 23, 2012 and stamped approved on November 30, 201,2. IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed, and these presents to be subscribed by a majority of the said Board as of this date.
