MARGARET PISANI requests a Wetland Permit to remove existing cinder block cabana; reconstruct existing 21'x17' deck and 4'x5' stairs. Located: 7180 Great Peconic Bay Boulevard, Laurel. SCTM# 126-11-9.1 The proposal to remove the cabana is recommended as CONSISTENT with the LWRP. The proposal to reconstruct existing 21 'x17' deck and 4'x5' stairs are INCONSISTENT with LWRP Policies 6.3 (below) and therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The structures were constructed without Board of Trustee review or a Wetlands Permit. Further, pursuant to Chapter 275 Wetlands and Shorelines, the proposal to reconstruct the 315 square foot unpermitted deck is not a permissible action pursuant to 275-11 Construction and operation standards(below). The unpermitted deck is oversized and is located seaward of the top of bank/bluff (figure 1) 275-11 Construction and operation standards. A. General. The following standards are required for all operations within the juriSdiction of the Trustees: (6) Platforms. [Amended 10-11-2005 by L.L. No. 17-2005; 10-9-2012 by L.L. No. 12-2012] (b) Platforms may not exceed 200 square feet and must be landward of the t~p of bluff. Figure 1. Subject parcel showing deck.
