Proposed Wetland Permit and Coastal Erosion Permit for EUGENE L. DANERI

A permit (6428) for a similar action was issued in 2006. The bulkhead was not included within
the permit issued. A LWRP Coastal Consistency review was also conducted in 2006 and the
action was recommended as INCONSISTENT. At that time reviews were conducted differently
citing setbacks as the reason an action was recommended as INCONSISTENT.
EUGENE L. DANERI requests a Wetland Permit to demolish existing dwelling and existing accessory
wood framed structure and construct 44'x60' two-story dwelling with 10'x44' pomh attached to southern
side; install a new sanitary system; construct a 24'x36' detached garage; construct approximately 68
linear feet of vinyl bulkhead in-place of and up to 18" higher than existing timber bulkhead; construct 10'
westedy and easterly returns; backfill storm damaged area with approximately 150 cubic yards of clean
sand/loam fill; and install a 10' wide non-turf buffer landward of the bulkhead. Located: 200 Terry Path,

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
'Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposal is
CONSISTENT with the LWRP provided the Board considers the following:
1. The entire parcel is located within Flood Zone and therefore there is no ability to relocate the
structure outside of the flood zone (See Figure 1 ).
2. It is recommended that the drywells be relocated to increase the distance from the bulkhead
and outside of the VE flood zone.
3. The survey references two high water lines. One along bulkhead and one further seaward. It is
recommended that the Board establish the correct wetlands line.

A. INSTRUCTIONS
All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Watexfront Consistency Review Law. This
assessment is intended to supplement other inforraation used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt action~ including Building Permits
and other mini, terial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local

beneficial and adverse effects upon the coastal area (which includes all of Southold Town).

conditions on the lot. This improvement is in the living conditions, as well as the use of the lot
area. The proposed dwelling is located more'landward of the situate Wetlands than the existing
dwelling. The proposed sanitary system will also be located more landward of the situate wetlands
than the existing system and be brought up to current code. The proposal also involves the demolition
of an existing dilapidated accessory structure and is consistent with the character of the community.

Dear Mr. Lohn:
The Board of Town Trustees took the following action dudng its regular meeting held on
Wed., August 23, 2006 regarding the above matter:
WHEREAS, Suffolk Environmental Consulting, Inc. on behalf of EUGENE DANERI
applied to the Southold Town Trustees for a permit under the provisions of Chapter 275
of the Southold Town Code, the Wetland Ordinance of the Town of Southold,
application dated August 1, 2006, and,
WHEREAS, said application was referred to the Southold Town ConServation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the Board of Trustees has furthered Policy 6 of the Local Waterfront
Revitalization Program to the greatest extent possible through the imposition of the
following Best Management Practice requirements: the installation of gutters and
.drywells, a row of staked hay bales with silt retention fencing to be in place pdor to the
start of construction, and a 10' non-turf buffer landward of the bulkhead, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on August 23, 2006, at which time all interested persons were given an
opportunity to be heard, and,

WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be

of the Southold Town Code, and,

have ~efore you an application, ~hich application seeks to
[4 demolish an extstlng single-family dwelling, zt is now
located 2S-and-a-half feet of the wetland ~oundary. The
~5 wetland boundary in this case ts the mean h~gh water mark as
shown on the survey, so w? would demolish that house and
16 while beyond th~s board's 3ur~sd~ction, we would demollsh a
second house. There are two houses on the property. .T~.e
17 house tn the rear is in disrepair, zt st~11 carries w~th it a
building ~Ight. zt is extinguished here. And it's served by
18 two ex~st~ng cesspools which do not meet current Health
Department regulations. And they would be removed, de facto.
19 and you would have a compliant septic s~stem.
The new dwel~tng would be 60 feet from the wetland but tt

an area that contains multqple dwellings, none of which meets
24 your L00-foot setback rule. ! can tell you this is the second
one we have done ~n recent times and in each and every case we
25 sought to move them back, um0 to the extent we feel
reasonable.

1 NOW we don't really.want to move them back too far
because he reasonably en3oys the view and we feel there is no
2 reason to ruin that view and also because the property narrows
from the waterside from the southern lot line to the northern
3 lot line so the further we move it back the more serious our
zoning problems become.
4 As it stands today we w~ll have to go to the zoning board
for zoning relating to the side yard boundaries. You should
5 know that there would be no relief required for bulkhead
~etbacks because the code concerning zoning was built into it
6 is to encourage to relocate people further from the bulkhead
that is existing, so we would comply with t~at.
7 And I think the upgraded septic system ~s consistent with
what this board is trying to do ~n this area.
8 AS a final matter, I would anticipate runoff control by
way of gutters into the drywells. [ would anticipate that
9 there would be suitable erosion control by ~ay of sil~ fence
and hay bales that would surround the activity Including the
l0 demolition of the existing but]dings on the property and z'11
ask for any questions you may have.

MR. SMITH: My name is Thornton Smith and I'm a neighbor
13 of Mr. Oaneri's. I known him as long as he has been around.
I am a civil engineer and a registered professional sngineer
14 in the State o~ New York and several other 3urisd3ct~ons. I'm
also joined th3s evening by my sister who is lending me her
15 glasses. We occupy on the drawing that you just received what
are four lots, 19 and 16.
16 Mr. Daneri has the third of ten lots that are all in a
row in this area. They are all characterized by having a
17 short dimension on the bay, a short dimension in the back and
in Mr. Oaneri's case is 68 feet on the bay and 62 feet in the
~8 back, and then a long, 600-foot north/south dimension.
In general, on all of these lots there is almost nothing
19 built on the northern 500 feet of the lots. They are used
merely for driveways w~th almost no exception.
20 My sister is not adjacent to the property. I'm adjacent
to the property with a 600-foot common border to the east and
21 my sister is to the east of me.
we are both here to support the application of Nr. Oaneri
22 to construct a new building, we believe it would be in the

24 ~e have just three items that we would like to bring to
your attention; two of them probably are not within the

structure, which has two sideline setbacks, and the new
3 accessory structure, whtc~ has one, I understand are not in
accordance with the building code setback and I trust that
4 that will probably be an issue for the Building Department and
not for your board.
5 I do believe, however, that they could design a structure
which, two structures, which would be suitable for the
6 property, allow them to have whatever area they might want and
be able to meet the building code requirements and that that
7 will not have to be a violation which they would have to take
to the zoning board.
8 The second issue which I think is, I just think a plus
that could be done here, which I think is under your control.
g My lot reaches to the east on this drawing, shows a nine-foot
contour and then it shows an eight-foot contour going across
10 the lot of the new building. Th~se contours indicate, as is
the case if you are out in the field, that his lot is a little
11 lower than mi~e, particularly where the houses are. ~ think
if this building is demolished he has an opportunity to raise
12 his level by a foot to a foot-and-a-half. In the days of
global warmng, I think that would be a good idea.
13 He has a bulkhead which is probably one of the oldest in the
area. My sister and I have both been on the sites for 70
14 years know the bulkheads don't last for ever. We have,
however, and several other houses to the east of us, have fine
15 bulkheads which I think are going to last for some time.
Mr. Daneri's bulkhead is one of the oldest in the area
16 and it's about 15 inches~ at least, lower than the adjacent
one that I have and my s3ster has. It would seem to me that
17 in raising this area Where the house would be would not
necessarily at this time raising, the bulkhead, you would put
18 yourself in the position where when a new bulkhead is needed
there, it would be.an advantage to the area to have a new
19 bulkhead that is h~gher and that is properly, house is on a
site that is a little higher.
20 The third thing I want to mention, which I think is
outside of your ~ur(sdiction, is that on the northern 500 feet
21 where he has an existing driveway now, he is abandoning about
400 feet of it. He's going to cut down what I would say 4,000
22 square feet of pin~ woods ~n order to put in a driveway right
next to the one whqch already exists.
23 I don't see any reason why he should make a change to the
driveway. He's driven in to t~is site, and his father before
24 him, for 70 years, and I see that he's going to construct a
new garage and he needs to turn around safely. But why he's

AS far as filling the lot, [ don't know that that
6 that's not usually what we do. we usually, if you fill a lot
too much it might cause a drainage problem to others. So
7 that's not something we usually do. We are not opposed to it.
TRUSTEE HOLZAPFEL: Bruce, j~st as a question. A lot of
8 the new construction has a certain height that the first floor
has to be above, zs the foundation up higher?
g MR. ANDERSON: well, it's a good question because if
you'll see --
l0 TRUSTEE HOLZAPFEL: Let me just -- I don't have a problem
with any of it. what I'm saying is if the foundation sticks
11 two, three, four feet above the ground, it might be a chance
to fill in and ~- you know, how some of the new houses, they
12 are built because of the flood plane, have a foundation that
sticks four, five feet above the ground level and it makes the
13 house stand out rather uniquely. That's a11, it's just an
observation.
~4 MR. ANDERSON: I don't think we designed the foundation
yet. I can tell you that down the road where we went through
15 that we did pile-type foundations. It's different. We did it
for flood plane reasons.
16 TRUSTEE DICKERSON: If it's something that they feel they
need to bring fill in, they could always come in for an
17 amendment.
MR. SMITH: 3ust a comment. The suggestion, I would not
~8 suggest raising the existing floor plan more than L5 inches;
Z8 at the top. Essentially to make the land where the new
19 house is going to be at the same elevatfon as the land on my
property right next door. .
20 I might add that there is on this plan also a small, what
is called wood wall on the west side of this:property. It's
21 only about eight.to ten inches high. 5o ths property to the
west is also a.llttle higher than the Daner~ property and
22 think filling in, incidentally, right where the house is,
Whether you fill in the rest of the property. 600 feet, I have
23 no intention of doing anything there. Even back where the
accessory building !s, I'm not sure that would be a need to

13 attached to the southern side and to install a new sanitary
system and detached 24x36 foot garage with drywells to contain
14 all the roof runoff, hay bales in front of the bulkhead, at
the line of the bulkhead all the way across, during
15 construction.
I want to say that we appreciate that you moved the
16 house, the structure back, as far as you did, and with that we
feel that it is not to be inconsistent with LWRP. SO I think
17 that was all the stipulations we have on it and that,s the
motion I make. And ten-foot, non-turf -- we would l~ke to
18 request also if you could put a ten-foot non-turf buffer
behind the bulkhead head. If that lawn is going to be
19 disturbed when you replant, not to replant all the way up to
the bulkhead. We don't want lawn all the way up to the
20 bulkhead, zf you could leave a ten-foot non-turf; it could be
stone, just not lawn all the way up to the bulkhead.

5. Backfilling All peripheral berms, cofferdams, rock revetments, seawalls, gabions, bulkheads or
other approved shoreline stabilization structures shall be completed prior to placement of any fill
material behind such structures.
6. Equipment Operation Equipment operation below the high tide line is strictly prohibited. The
storage of construction equipment and materials shall be confined to the project work area and areas
more than 100 feet from the high tide line.
7. Sanitary Systems This permit does not authorize filling or re-grading of exposed sanitary systems.
Landowners must apply for separate permits to perform repairs or reconstruction to sanitary systems.
8. Hydraulically-filled Sandbags, Sand Cubes and Geotubes Hydraulically-filled sandbags, sand
cubes and geotubes are strictly prohibited.
9. Beach Excavation Prohibited for Fill Excavation of the beach or dune for the purpose of obtaining
fill material is prohibited. Sandbags may not be filled using sand from the beach or dune areas.
Sandbags must be filled with clean sand; no debris or deleterious materials are allowed.
10. Sandbag and Sand Cube Installation Sandbags and sand cubes must be installed no more than
four rows deep and a maximum of three rows high.
!1. Removal of Sandbags and Sand Cubes Sandbags and sand cubes must be removed within 120
days of installation, or a separate DEC permit to allow the structures to remain permanently must be
obtained.
12. Tidal Wetland Vegetation There shall be no disturbance or damage to vegetated tidal wetlands or
dune vegetation as a result of the work performed under this permit. All necessary precautions must be
taken to prevent damage or disturbance to these vegetated areas.
13. Construction Debris All construction debris shall be cleaned up at the end of each work day and
disposed properly. No debris is permitted in tidal waters or the beach areas.
14. Asian Longhorned Beetles Any tree debris within New York City, Nassau or Suffolk counties
shall be disposed of by chipping to less than 1 inch in any two dimensions, then used as mulch, erosion
control, building agent, or fuel. Wood may only be moved from Asian Longhomed Beetle quarantine
areas under a permit from the NYS Department of Agriculture and Markets
(http://www.agriculture.ny.gov/PI/alb.html).
15. Least Terns and Piping Plovers All recovery and repair work occurring in open, sandy beach
areas must cease on March 31,2013 to protect potential habitat for Least Tern and Piping Plover, unless
otherwise authorized in writing by the Department.
16. No Dredging or Excavation No dredging, excavating or other alteration of shoreline or
underwater areas is authorized by this permit, nor shall issuance of this permit be construed to suggest
that the Department will issue a permit for such activities in the future.
17. No Interference With Navigation There shall be no unreasonable interference with navigation by
the work herein authorized.

The permittee shall provide a person to accompany the Department's representative during an inspection
to the permit area when requested by the Department.
A copy of this permit, including all referenced maps, drawings and special conditions, must be available

the permit upon request by a Department representative is a violation of this permit.
2. Relationship of this Permit to Other Department Orders and Determinations Unless expressly
provided for by the Department, issuance of this permit does not modify, supersede or rescind any order
or determination previously issued by the Department or any of the terms, conditions or requirements
contained in such order or determination.
3. Applications For Permit Renewals, Modifications or Transfers The permittee must submit a
separate written application to the Department for permit renewal, modification or transfer of this
permit. Such application must include any forms or supplemental information the Department requires.
Any renewal, modification or transfer granted by the Department must be in writing. Submission of

4. Submission of Renewal Application The permittee must submit a renewal application at least 30

5. Permit Modifications, Suspensions and Revocations by the Department The Department
reserves the right to exercise all available authority to modify, suspend or revoke this permit. The
grounds for modification, suspension or revocation include:
a. materially false or inaccurate statements in the permit application or supporting papers;
b. failure by the permittee to comply with any terms or conditions of the permit;
c. exceeding the scope of the project as described in the permit application;
d. newly discovered material information or a material change in environmental conditions,
relevant technology or applicable law or regulations since the issuance of the existing permit;
e. noncompliance with previously issued permit conditions, orders of the commissioner, any
provisions of the Environmental Conservation Law or regulations of the Department related to
the permitted activity.
6. Permit Transfer Permits am transferrable unless specifically prohibited by statute, regulation or
another permit condition. Applications for permit transfer should be submitted prior to actual transfer of

Item A: Permittee Accepts Legal Responsibility and Agrees to Indemnification
The permittee, excepting state or federal agencies, expressly agrees to indemnify and hc
Department of Environmental Conservation of the State of New York, its representative
and agents ("DEC") for all claims, suits, actions, and damages, to the extent attributable
permittee's acts or omissions in connection with the permittee's undertaking of activitie~
with, or operation and maintenance of, the facility or facilities authorized by the permit
compliance or not in compliance with the terms and conditions of the permit. This inde

The permittee is responsible for informing its independent contractors, employees, age
their responsibility to comply with this permit, including all special conditions while acl
