The applicant indicates that the deck was approved by the Board in 2002 under permit 5515.
The permit only references the stair and I could not find a Board approved survey showing the
approval of the deck. Note that I also could not find a permit for the bulkhead.
KATHLEEN & DAVID KILBRIDE request a Wetland Permit to repair existing 100 foot long timber
bulkhead, stringers and walers; replace existing bulkhead cap; replace decking surface of existing
11 'x22' deck and extend out another 11 'x18' to create an 11 'x40' deck; replace 7'x5' bulkhead platform
for beach stairs; and replace existing 4'x16' retractable aluminum stairs to beach. Located: 9045
Nassau Point Road, Cutchogue. SCTM# 118-4-14.1
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
$outhold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposal I to
repair existing 100 foot long timber bulkhead, stringers and walers; replace existing bulkhead
cap is CONSISTENT with the LWRP.
Further, it is my recommendation that the proposal to replace decking surface of existing 11'x22'
deck and extend out another ll'xt8' to create an 11'x40' deck is INCONSISTENT with LWRP
Policies 6.3 (below) and therefore, INCONSISTENT with the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee
permit conditions.
275-11 Construction and operation standards.
A. General. The following standards are required for all operations within the jurisdiction of the
Trustees:
(6) Platforms.

(a) Platforms associated with stairs may not be larger than 100 s(~uare feet.

Pursuant to Chapter 275 Wetlands and Shorelines, the proposal to; replace~decking surface of
existing 11'x22' deck and extend out another 1 t'xt 8' to create an t t'x40' deck. The total square
feet of the proposed deck would equal 440 and is not a permissible acti(~n.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
.written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
All applicants for permits* including Town of Sou;hold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).

affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus~ each answer must be explainLxl in detail~ listing both supporting and non-

Thanks for your feedback. Is this what you need? We will follow up with remaining documents.
Bulkhead: Repairs to existing 100 foot timber bulkhead to include full replacement of Cap and minor repairs, as
required, to Stringers and Whalers, all originating from Storm Damage.
Landing Platform: Reinstall to replacement Landing Platform existing 4' x 16' Aluminum Stairs to beach. Stairs are
equipped with lifting mechanism and are non-permanent.

I have attached the two pages that are needed. Just to reiterate, we will we need you to revise your project description
by including the linear feet of your bulkhead and also what repairs are needed. Is it just the sheathing and/or caps,
deadmen, walers, etc? Please describe. Lastly, please include dimensions of aluminum stairs. Even though they are on
the survey/plans, we still need to have it in the written description. Thank you.
