HomeMy WebLinkAboutTR-8188 Michael J.Domino,President ��rf SOUjy� Town Hall Annex John M.Bredemeyer III,Vice-President ,`O 01 0 54375 Route 25 P.O.Box 11 Charles J.Sanders J�[ Southold,New York 11971 Glenn Goldsmith G • O Telephone(631) 765-1892 A.Nicholas Krupski 'O Fax(631) 765-6641 �y�DUiVT`1,�� BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD August 16, 2017 Steven & Yvette Einczig PO Box 1338 Southold, NY 11971 RE: 3055 WELLS AVENUE, SOUTHOLD SCTM#: 1000-70-4-11 " Dear Mr. & Mrs. Einczig: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wednesday, August 16, 2017: WHEREAS, on June 30, 2017 an-application for an'Administrative Amendment was submitted for a proposed reduction of the existing' 15' wide non-turf buffer along the landward edge of the bulkhead down to 7' in width; and WHEREAS, on August 8, 2017 the Board of Trustees inspected said property for the proposed modification; and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area; and, WHEREAS, the Board has considered all of the documentation submitted concerning this application; and, - WHEREAS, on May 15, 2013 as part of the approval under Wetland Permit#8188, the Board of Trustees conditioned the installation of a 15' wide non-turf buffer along the landward edge of the bulkhead which is to be subsequently maintained, and that on August 15, 2014 said buffer was added to the deed under covenants and restrictions; and WHEREAS, the 15' wide non-turf buffer was in fact installed; and WHEREAS, the Board of Trustees determined that the existing buffer should not be modified as the need to reduce the width of the buffer has not been demonstrated, and that there is no justification for altering the prior actions of the Board to provide a buffering area to protect surface waters; and THEREFORE BE IT RESOLVED, that the Southold Town Board of Trustees DENY WITHOUT PREJUDICE the Administrative Amendment to Wetland Permit#8188 to reduce the width of the existing 15' wide non-turf buffer along the landward edge of the bulkhead down to 7' in width. Any other activity within 100' of the wetland boundary requires a permit from this office. This is not a determination from any other agency. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90) calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. James F. Page 2 o 3-April 18,2013 • • ZBA File#6637-Einezig SCTM: 1000-70-4-11 FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 4,2013 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant alternative relief will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The majority of the neighborhood consists of year round homes that were built more than 50 years ago. The exceptions to this neighborhood are the newly renovated home, several of which required variances from this Board. The applicant's dwelling is currently located at 47 feet from the bulkhead and includes an at grade patio on the seaward side. In order to make the newly constructed first floor level with an outdoor area, an attached deck is proposed to be added which will decrease the existing non- conforming bulkhead setback to 39.1 feet. Alternative relief will increase the proposed bulkhead setback from the deck to 43.1 feet. 2. Town Law &267-b(31(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Although the applicant can achieve greater code compliance by reducing the depth of the rear deck, the existing foundation is currently located at 47 feet from the bulkhead, while the code requires a 75 foot bulkhead setback. Any proposed construction that utilizes the existing foundation or additions seaward thereto would require a bulkhead setback variance. 3. Town Law. 267-b(3)(b)(3) The original variance requested is mathematically substantial representing 48% relief from the code requirement. With the deck reduction the percentage will be reduced to approximately 44% which is also substantial. However, non-conforming bulkhead setbacks are characteristic of this older neighborhood 4. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and shall provide a 15 foot wide landscaped buffer, including existing large trees, landward of the bulkhead as recommended in the LVW report. i 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of more code compliant dwelling while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Weisman (Chairperson), and duly carried, to DENY, the variance as applied for, and to GRANT ALTERNATIVE RELIEF as follows: No portion of the attached seaward/rear deck shall be closer than 42 feet to the bulkhead.
