referred to as "DECLARANT(S) " :

WHEREAS, DECLARANT(S) is/are the owner(s) of certain real property located
4245 Bay Shore Road, Greenport, Town of Southold, County of Suffolk, State of New
York, described in the Suffolk County Tax Map as District 1000, Section 53, Block
06, Lot 23 which is more particularly bounded and described as set forth in
Schedule "A" annexed hereto, hereinafter referred to as the Property;
WHEREAS, the Property is situated on lands within the jurisdiction of the
Board of Trustees of the Town of Southold (hereinafter the "Trustees") pursuant
to Chapter 275 of the Town Code of the Town of Southold or its successor, and
various activities conducted upon the property may thus be subject to the
regulation and approval of the Trustees prior to being conducted;
WHEREAS, the DECLARANT(S) therefore made application to the Trustees for a
permit pursuant to the Wetlands Law of the Town of Southold to undertake certain
regulated activities; and
WHEREAS, as a condition of the granting of a Wetlands Permit to undertake
such regulated activities, the Trustees required the area on seaward side of the
dwelling is to remain a stone "non-turf buffer" adjacent to and landward of top
of slope;
NOW, THEREFORE, the DECLARANT(S) do/does hereby covenant and agree as
follows:
1) Upon the substantial completion of the aforementioned permitted
activities there shall be established and subsequently maintained as a
"non-turf buffer" as defined by Chapter 275 of the Town Code; and as
depicted on the survey plan dated September 9, 2012 and stamped approved
on May 15, 2013, see Exhibit A attached; and
2) These covenants shall run with the land and shall be binding on the
DECLAR.ANT(S) , his/her/their heirs, assigns, purchasers, or successors in
interest and may only be modified after a public hearing and upon
resolution of the Trustees.

Dear Mr. Bredemeyer,
It has come to my attention that Authorization received from the Board of Southold Town
Trustees, permit 8192; dated May 15, 2013 for property located at 4245,Bay Shore Road,
Greenport, include a descriptior(„regarding the,protection of oak trees located on the seaward
side of the property. I am writing to you to advise that, while 3 oak trees are located on the
northeast side of the property, only one tree isactually located on my property. The other 2
trees are on the property of my neighbor to the north as shown in the site plane and
photographs attached to this letter. I want to make sure you are aware of this error so that
your file can be properly documented.
I already created a stone barrier around the oak.tree on my property; as required. Please
feel free to visually inspect the site,,40"confirm the location of the trees and stone barrier.

Pursuant to the provisions of Chapter 275 of the Town Code of the Town of Southold and in
accordance with the Resolution of the Board of Trustees adopted at the meeting held on May 15,2013,and in
consideration of application fee in the sum of$250.00 paid by Richard&Susan Meyerholz and subject to the
Terms and Conditions as stated in the Resolution,the Southold Town Board of Trustees authorizes and permits
the following:
Wetland Permit to demolish existing dwelling,foundation, driveway and septic
system and construct new foundation for a new two-story t2,325sq.ft. dwelling with
attached garage, and a 401 sq.ft. deck; new hot tub; new sanitary system on landward
side of dwelling with approximately 6'6" high concrete retaining walls; new pervious
driveway; add±27 cubic yards of clean fill to existing beach area within 15' of
foundation to raise the elevation and protect oak trees; and a retaining barrier will be
put in place to protect the three oak trees on the beach; with the conditions that the
area on seaward side of dwelling is to remain a stone non-turf buffer; and project
conforms with Chapter 236 of the Town Code-Stormwater Management; and as
depicted on the site plan prepared by Robert I. Brown,Architect, P.C., last dated
February 21,2012, and stamped approved on May 15,2013.
IN WITNESS WHEREOF,the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee Richard& Susan Meverholz, residing at 4245 Bay Shore Road,Greenport,New
York as part of the consideration for the issuance of the Permit does understand and prescribe
to the following:
I. That the said Board of Trustees and the Town of Southold are released from any and all
damages,or claims for damages,of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit,and the said Permittee will,at his or her own
expense,defend any and all such suits initiated by third parties,and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 24 months,which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely,or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized,or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation,the said Permittee will be
required, upon due notice,to remove or alter this work project herein stated without
expenses to the Town of Southold.

WHEREAS, RICHARD & SUSAN MEYERHOLZ applied to the Southold Town Trustees
for a permit under the provisions of Chapter 275 of the Southold Town Code, the
Wetland Ordinance of the Town of Southold, application dated April 19, 2013, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings

more conformity with the code. The applicant, on May 24, 2012, submitted a plan increasing the front yard
setback to 32.5 feet,the single side yard setback to 5 feet,the combined side yard setback to 10 feet, and reducing
the lot coverage to 26.9%.The applicant also removed the proposed spa on the southerly side and re-located it to a
seaward posititm toward the north of the property The Board finds that this amended plan still requires significant
varisnces for the aide yard,combined side yard and lot coverage.At the July 5,2012 public bearing the applicant
was asked to bring the plan into mora conformity with the code for the setbaeks and lot coverage,and, to mitigate
potential adverse environmental impacts,to comply with the recommendations Grade by the LWRP coordinator in

The Zoning Board of Appeals held a public hearing on this application on May 3,2012,Juae 7,2012 and July 5,
2012,at which time written and oral evideam ware presented. Based upon all testimony,documcirtation,personal
inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the
following facts to be true and relevant and makes the following findings:
1. Iawn&W 4267-b(MM YI Grant of the requested side yard variance will produce an undesirable change in
the character of the neighborhood or a detriment to nearby properties. What the applicant proposes in design and
scope is not uncharacteristic of this neighborhood in which many homes have been renovated sad enlarged over
time. However, most 2 story dwellings along the waterfront side of Bay Shore. Road are on larger lots with
eonfom:ing lot coverage and setbacks. Bemuse of the size and shape of the applicant's small parcel, and the size
and location of the proposed now two story dwelling indicated in the amended pians, the Board finds that the
proposed close proximity that would be created by a 5 foot southerly side yard setback ffom the existing agjaoent
two story dwelling to the south, would cause a detriment to both dwellings. The Board also notes that the
applicant's lot is among rho smallest in the area and that the demolition of-the existing one story dwelling with a
conforming 19.3%,lot coverage, and replacement with the proposed two story dwelling at 26.9% lot coverage per
the amended site plan,Will substantially increase the degra of non-conformance on the subject parcel.
2. Town Law 6267-bOWMne benefit sought by the applicant cannot be achieved by some method,feasible
for the applicant to purm, other than an area variance. The parcel is nonoonfornhfng at 7,526 square feet with a
front yard width of 45 feet The proposed demolition and reconstruction of a larger dwelling than what exists

SPECIAL CONDITIONS
1. Notice of Commencement At least 48 hours prior to commencement of the project, the permittee and contractor
shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of, and
understand all terms and conditions of,this permit. Within 30 days of completion of project,the bottom portion of the
form must also be signed and returned, along with photographs of the completed work.
2. Concrete Leachate During construction, no wet or fresh concrete or leachate shall be allowed to escape into
any wetlands or waters of New York State, nor shall washings from ready-mixed concrete trucks,mixers, or other
devices be allowed to enter any wetland or waters. Only watertight or waterproof forms shall be used. Wet concrete
shall not be poured to displace water within the forms.
3. No Construction Debris in Wetland or Adjacent Area Any debris or excess material from construction of this
project shall be completely removed from the adjacent area (upland) and removed to an approved upland area for
disposal. No debris is permitted in tidal wetlands or protected buffer areas.
4. No Disturbance to Vegetated Tidal Wetlands There shall be no disturbance to vegetated tidal wetlands or
protected buffer areas as a result of the permitted activities.
5. Storage of Equipment,Materials The storage of construction equipment and materials shall be confined within the
project work area and/or upland areas greater than 75 linear feet from the tidal wetland boundary.
6. Clean Fill Only All fill shall consist of clean sand, gravel or soil (not asphalt, slag, flyash, broken concrete or
demolition debris).
7. No Beach Excavation For Fill No excavation of the beach is authorized for the purpose of obtaining fill or
stone materials.
8. Straw Bales or Other at Tidal Wetland A row of staked haybales or other approvable erosion control devices
shall be placed 35 linear feet from the tidal wetland boundary,prior to commencement of any regulated activities and
remain in place and in good,functional condition until the project is completed and all disturbed areas are stabilized
with vegetation.
9. Roof runoff shall be directed into dry wells a minimum of 75 linear feet landward of the tidal wetland boundary
for immediate on-site recharge.
10. No Drywells in or near Wetland Dry wells for the hot tub shall be located a minimum of 65 linear feet
landward of the tidal wetland boundary.
11. No Hot Tub Discharges to Wetland There shall be no draining of hot tub water directly or indirectly in tidal
wetlands or protected buffer areas.
12. Driveway/Parking Area of Pervious material Driveways and parking areas shall be constructed of
NYSDEC-approved pervious materials.

13. Direct Runoff Away from Tidal Wetland and Buffer Roads,driveways, and parking areas shall be graded
to direct runoff away from tidal wetlands and protected buffer areas.
14. Sanitary System above Groundwater Sanitary systems (bottom of the tank and leaching pools) shall be
located a minimum of 2 feet above seasonal high groundwater.
15. Seeding Disturbed Areas All areas of soil disturbance resulting from the approved project shall be stabilized
with appropriate vegetation (grasses, etc.) immediately following project completion or prior to permit expiration,
whichever comes first. If the project site remains inactive for more than 48 hours or planting is impractical due to
the season, then the area shall be stabilized with straw or hay mulch or jute matting until weather conditions favor
germination.

1. Facility Inspection by the Department The permitted site or facility, including relevant records, is subject to inspection at
reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation(the Department)
to determine whether the permittee is complying with this permit and the ECL. Such representative may order the work suspended
pursuant to ECL 71-0301 and SAPA 401(3).The permittee shall provide a person to accompany the Department's representative
during an inspection to the permit area when requested by the Department. A copy of this permit, including all referenced maps,
drawings and special conditions, must be available for inspection by the Department at all times at the project site or facility.
Failure to produce a copy of the permit upon request by a Department representative is a violation of this permit.
2. Relationship of this Permit to Other Department Orders and Determinations Unless expressly provided for by the
Department, issuance of this permit does not modify, supersede or rescind any order or determination previously issued by the
Department or any of the terms,conditions or requirements contained in such order or determination.
3. Applications for Permit Renewals or Modifications The permittee must submit a separate written application to the
Department for permit renewal, modification or transfer of this permit. Such application must include any forms or supplemental
information the Department requires. Any renewal, modification or transfer granted by the Department must be in writing.
Submission of applications for permit renewal, modification or transfer are to be submitted to: Regional Permit Administrator,
Region 1, SUNY @ Stony Brook,50 Circle Road, Stony Brook, NY 11790.
4. Submission of Renewal Application The permittee must submit a renewal application at least 30 days before permit
expiration for Freshwater Wetlands,Tidal Wetlands and Rivers' permits.
5. Permit Modifications,Suspensions and Revocations by the Department The Department reserves the right to modify,
suspend or revoke this permit. The grounds for modification, suspension or revocation include:
a. materially false or inaccurate statements in the permit application or supporting papers;
b, failure by the permittee to comply with any terms or conditions of the permit;
C. exceeding the scope of the project as described in the permit application;
d. newly discovered material information or a material change in environmental conditions, relevant technology or applicable
law or regulations since the issuance of the existing permit;
e. noncompliance with previously issued permit conditions,orders of the commissioner, any provisions of the Environmental
Conservation Law or regulations of the Department related to the permitted activity.
6. Permit Transfers Permits are transferrable with the approval of the department unless specifically prohibited by statute,
regulation or another permit condition. Applications for permit transfer should be submitted prior to actual transfer of ownership.
NOTIFICATION OF OTHER PERMITTEE OBLIGATIONS
Item A: Permittee Accepts Legal Responsibility and Agrees to Indemnification
The permittee, excepting state or federal agencies, expressly agrees to indemnify and hold harmless the Department of
Environmental Conservation of the State of New York, its representatives,employees, and agents("DEC")for all claims, suits,
actions, and damages,to the extent attributable to the permittee's acts or omissions in connection with the permittee's undertaking
of activities in connection with,or operation and maintenance of,the facility or facilities authorized by the permit whether in
compliance or not in compliance with the terms and conditions of the permit. This indemnification does not extend to any claims,
suits, actions,or damages to the extent attributable to DEC's own negligent or intentional acts or omissions, or to any claims,suits,
or actions naming the DEC and arising under Article 78 of the New York Civil Practice Laws and Rules or any citizen suit or civil
rights provision under federal or state laws.
Item B: Permittee's Contractors to Comply with Permit
The permittee is responsible for informing its independent contractors, employees, agents and assigns of their responsibility to
comply with this permit, including all special conditions while acting as the permittee's agent with respect to the permitted activities,
and such persons shall be subject to the same sanctions for violations of the Environmental Conservation Law as those prescribed
for the permittee.
Item C: Permittee Responsible for Obtaining Other Required Permits
The permittee is responsible for obtaining any other permits,approvals, lands, easements and rights-of-way that may be required
to carry out the activities that are authorized by this permit.
Item D: No Right to Trespass or Interfere with Riparian Rights
This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any rights,title,or interest in real or personal property
held or vested in a person not a party to the permit.

1. If future operations by the State of New York require an alteration in the position of the structure or work herein
authorized,or if,in the opinion of the Department of Environmental Conservation it shall cause unreasonable obstruction
to the free navigation of said waters or flood flows or endanger the health,safety or welfare of the people of the State,or
cause loss or destruction of the natural resources of the State,the owner may be ordered by the Department to remove or
alter the structural work,obstructions,or hazards caused thereby without expense to the State,and if,upon the expiration
or revocation of this permit,the structure,fill,excavation,or other modification of the watercourse hereby authorized shall
not be completed,the owners,shall,without expense to the State,and to such extent and in such time and manner as the
Department of Environmental Conservation may require,remove all or any portion of the uncompleted structure or fill
and restore to its former condition the navigable and flood capacity of the watercourse. No claim shall be made against
the State of New York on account of any such removal or alteration.
2. The State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized
which may be caused by or result from future operations undertaken by the State for the conservation or improvement of
navigation, or for other purposes, and no claim or right to compensation shall accrue from any such damage.
3. All necessary precautions shall betaken to preclude contamination of any wetland or waterway by suspended solids,
sediments,fuels,solvents,lubricants,epoxy coatings,paints,concrete,leachate or any other environmentally deleterious
materials associated with the project.
4. Any material dredged in the conduct of the work herein permitted shall be removed evenly, without leaving large
refuse piles,ridges across or along the bed of a waterway or floodplain,deposits within any regulatory floodway,or deep
holes that may have a tendency to cause damage to navigable channels or to the banks of a waterway.
5. There shall be no unreasonable interference with navigation by the work herein authorized.
6. If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the
applicant shall, without expense to the State, and to such extent and in such time and manner as the Department of
Environmental Conservation may require,remove all or any portion of the uncompleted structure or fill and restore the
site to its former condition. No claim shall be made against the State of New York on account of any such removal or
alteration.
7. If granted under 6NYCRR Part 608,the NYS Department of Environmental Conservation hereby certifies that the
subject project will not contravene effluent limitations or other limitations or standards under Sections 301,302,303,306
and 307 of the Clean Water Act of 1977 (PL 95-217)provided that all of the conditions listed herein are met.
8. At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top
portion of the enclosed notification form certifying that they are fully aware of and understand all terms and conditions of
this permit. Within 30 days of completion of project,the bottom portion of the form must also be signed and returned,
along with photographs of the completed work and, if required, a survey.
9. All activities authorized by this permit must be in strict conformance with the approved plans submitted by the
applicant or his agent as part of the permit application.

The attached plan, when duly signed by a representative of the Department, constitutes a permit to construct a water
supply and/or collection system for the property as depicted. The applicant should take note of any conditions of
approval, which may be indicated on the plan or enclosed herein. Construction must conform with applicable
standards including "Standards for Approval of Plans and Construction for Sewage Disposal Systems for
Single Family Residences" and "Standards and Procedures for Private Water Systems." Omissions, errors or
lack of details on the plan does not release the applicant from the responsibility of having the construction done in
conformance with applicable standards.
The permit (plan) expires three (3) years after the approval date. Any modifications which may affect the proposed
sewage disposal or water supply systems requires submission of a revised plan and additional fees (if applicable) for
reapproval prior to construction. No inspections will be performed by the Department on expired
permits.
Permits may be renewed, extended, transferred or revised in accordance with the procedures described in
"Submission Requirements for Approval of Sewage Disposal and Water Supply Facilities for Single Family
Dwellings"(Form WWM-041).
It is the applicant's responsibility to call the department at 852-5754, in advance, to arrange inspections of the
sewage disposal and/or water supply facilities prior to backfilling. These include inspections of the sewage
collection and disposal systems, water supply system components and piping, and final grading as shown on the
approved plans. In certain cases, inspections of the soil excavation may be required to determine the acceptability of
the soils for sewage disposal systems. The Department must be notified at least 24 hours in advance to schedule
an inspection and excavation inspections must be confirmed by calling 852-5700 prior to 9.30 A.M., the morning
of the inspection. Article VII of the Suffolk County Code, "Septic Industry Businesses,"requires that all installers
of septic systems within Suffolk County shall possess a valid license from the Suffolk County Wice of Consumer
Affairs. This office can refuse to perform inspections or grant final approval for the construction ofprojects that are
installed by an unlicensed individual. It is, therefore, in your best interest to utilize a cesspool contractor with a
valid license to avoid substantial delays in your project.

It is the applicant's responsibility to call the Department to arrange inspections of the sewage disposal system and water
supply facilities prior to backfilling. These include inspections of the soil excavation for the sewage disposal system,
when required, and inspections of the water supply well,well lateral,public water supply line, disposal system, piping and
final grading. Other inspections may be required.
Following satisfactory construction and inspections:
1. The applicant must submit 4 prints of an as-built plan (up to and including 11"x17"), by a licensed design
professional,of the subject property showing the following:
a. the lot location and metes/bounds description;
b. the lot number(s)and the name of the subdivision,if applicable;
c. permanent structures(i.e.,buildings,driveways,walkways, swimming pools, decks,retaining walls, etc.)
d. the exact location of the private well and lateral, if applicable (give at least 2 dimensions measured from the
comers of the building to the well);
e. the exact location of the public water line, if applicable;
f. the exact location of the septic tank and leaching pool(s), if applicable (give at least 2 dimensions measured
from the corners of the building to the covers of the septic tank and each leaching pool);
g. the exact location of the sewer line from the dwelling to the street; if applicable; and
h. have a clear area at least 3" x 5" for the Department's approval stamp.
2. If any new subsurface sewage disposal system components have been installed, the applicant must submit a
certificate(Form W WM-078 or equivalent) from the licensed sewage disposal installer, attesting that the system has
been constructed according to the criteria of the Department. If a certificate from the installer cannot be obtained,
form W WM-073 completed by a licensed architect or engineer may be submitted.
3. If a well has been installed as the potable water supply, then the applicant must submit a well water analysis
completed within one(1) year by a certified lab, and a well driller's certificate completed by a licensed well driller.
If the well or water quality does not conform to standards,corrective measures will be required as described in the
Department's "Private Water System Standards." Please note: water treatment units may not be installed without
prior approval of the Department.
4. If any pre-existing subsurface sewage disposal system components have been abandoned or removed, the applicant
must submit a Certificate of Abandonment (Form W WM-080) from a licensed contractor attesting that the previous
system has been abandoned according to the criteria of the Department. If a certificate from the contractor cannot be
obtained, form W WM-073 completed by a licensed architect or engineer may be submitted.
5. If public sewers are utilized for the dwelling, the applicant must also submit one(1)copy of the sewer line inspection
approval from the sewer district. In districts operated by Suffolk County, one(1)original of Form S-9, duly executed
by the Suffolk County Department of Public Works, and one (1) copy of a Suffolk County Department of Public
Works field sketch are required.
6. If public water is utilized, a tap letter from the appropriate water district indicating that service has been completed to
the dwelling will be required.
7. In certain cases, the applicant will be required to submit a certification from a licensed design professional, attesting
that all components of the sewage disposal system, retaining wall or sewage collection system have been properly
inspected and constructed according to the approved plans and permit conditions. Refer to "Certification of
Constructed Works" (Form W WM-073). Other documents may be required as indicated on the permit to construct.

A Zoning Board of Appeals decision (File# 6556) was issued on July 12, 2012.
RICHARD & SUSAN MEYERHOLZ request a Wetland Permit to demolish existing dwelling,
foundation, driveway and septic system and construct new foundation for a new two-story t2,325sq.ft.
dwelling with attached garage, and a 401sq.ft. deck; new hot tub; new sanitary system on landward
side of dwelling with approximately 66" high concrete retaining walls; new pervious driveway; add ±27
cubic yards of clean fill to existing beach area within 15' of foundation to raise the elevation and protect
oak trees; and a retaining barrier will be put in place to protect the three oak trees on the beach.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my determination that the proposed action is
INCONSISTENT with the below listed LWRP polices and therefore INCONSISTENT with the LWRP:
Policy 1. "Foster a pattern of development in the Town of Southold that enhances community character,
preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal
location, and minimizes adverse effects of development."
Policy 4.1 "Minimize losses of human life and structures from flooding and erosion hazards." The
following management measures to minimize losses of human life and structures from
flooding and erosion hazards are recommended: specifically
A. Minimize potential loss and damage by locating development and structures away from
flooding and erosion hazards.
3. Move existing development and structures as far away from flooding and erosion
hazards as practical. Maintaining existing development and structures in hazard areas
may be warranted for:
a. structures which functionally require a location on the coast or in
coastal waters.
d. sites where relocation of an existing structure is not practical
Based upon the newly published FEMA maps (published September 25,
2009) the parcel is at risk of flooding and storm surge. More specifically
the parcel is located in a Moderate Wave Action Area (the approximate
landward limit of the 1.5 foot breaking wave) and AE EL 6 Flood Zone.
The expansion of an existing structure 28.9%; 8.9% over the permitted
20% lot coverage by code is inconsistent with the above policy—the area
is subject to potential storm surge and/or flooding.
Further, the residential structure does not functionally require a location
on the coast and is not water dependent. Although due to lot size,
configuration and area of unbuildable lands located on the lot the
relocation of the existing structure is not feasible.
In the event that the action is approved it is recommended that the Board reiterate the Zoning Board of
Appeals conditions outlined in the File# 6556 in permit conditions.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

General Description of work— Demo the existing 3 bedroom, 1.5 baths home,
including existing foundation, driveway and septic system. Additionally, we will remove
only the necessary trees to accommodate the new foundation, septic system and 2
drywells. We will border the site with hay bales to prohibit soil erosion and runoff into
the street and adjacent property. The existing one story home is approximately 1052sf
and the deck is 401st.
The planned new residence is a 2 story, 3 bedroom, 31/2 bath home with a one car
garage. The driveway leading from the street to the garage will have a pervious surface
to allow water to absorb naturally into the ground. With DEC approval, we will add 27cy
or natural beach material to the existing beach within 15 of the foundation. The plans
require landscape protection around the three oak trees on the beach side prior to
adding the new beach material. The proposed residence with also have a small hot tub
located on the NE corner of the home. The new total living space with be 2325sf with a
401 sf deck.
The dimension of the existing home is 34'11" x 42' and the new residents will be 34'11"
x 53'2". The lot coverage will increase from 19.3% to 25.3% but the total side-yard
distance will increase from 10' to 14'6"under the new plan approved by the Southold
Zoning Board.
How will the work be done?
Foundation — The existing foundation will be excavated and a new foundation poured
to 8' elevation to conform to the DEC flood elevation code. The crawl space under the
house will be graded to the same elevation as the land to the NE side (water side) of the
foundation wall. The graded crawl space will have a concrete skim coat to inhibit
moisture and proper flood baffles will be added as required.
Structure —The new plan calls for 2x6 frame construction with a ceiling height at 9'
throughout the first floor and 8' on the second floor of the house. Gutters will be
attached to the base of any descending roof slop to capture rain water. All runoff water
will be channeled to the drywell in the NW corner or SE corner of the house.
Additionally, the drain water from the outside shower and/or the hot tub will be piped to
the SE corner drywell.
Attached Garage - The existing structure does not have a garage. A new garage will
be constructed using 2x6 framing. The foundation of the garage will be constructed to

support the living space above the garage. The floor of the garage will be a poured
concrete slab set at 6'6" elevation.
Deck—The existing deck will be replaced with a new deck with the same dimensions.
The foundation will be 8'diameter concrete piers. This will eliminate CCA wood from
coming in contact with the beach. The deck will be raised to accommodate the new
elevation of the house based on the DEC specifications.
Hot Tub—The hot tub will rest on grade with the required foundation to support the
weight. The hot tub will have access to a drain connected to the SE drywell to capture
water from the tub.
Beach replenishing - During the early stages of the construction process, the new
beach material will be brought to the site by truck then delivered onto the beach via
backhoe or wheel barrel. The material will be hand raked to the proper elevation
approved by the DEC. A retaining barrier will be put in place to protect the three oak
trees on the beach.
Septic System —The septic system will be installed in accordance with the Suffolk
County Health Department permit issued for this project. The septic system installation
will require that the top elevation of the land will be approximately 6'6". The current
elevation of the property in the vicinity of the proposed new septic system is 47.5". The
septic system will have a concrete retaining wall built to specification by the engineer on
the west side and north side of the leaching pools. The south side of the property
already has a septic system retaining wall for the leeching pools installed by the
homeowner to the south.

General Description of work— Demo the existing 3 bedroom, 1.5 baths home,
including existing foundation, driveway and septic system. Additionally, we will remove
only the necessary trees to accommodate the new foundation, septic system and 2
drywells. We will border the site with hay bales to prohibit soil erosion and runoff into
the street and adjacent property. The existing one story home is approximately 1052sf
and the deck is 401sf.
The planned new residence is a 2 story, 3 bedroom, 31/2 bath home with a one car
garage. The driveway leading from the street to the garage will have a pervious surface
to allow water to absorb naturally into the ground. With DEC approval, we will add 27cy
or natural beach material to the existing beach within 15 of the foundation. The plans
require landscape protection around the three oak trees on the beach side prior to
adding the new beach material. The proposed residence with also have a small hot tub
located on the NE corner of the home. The new total living space with be 2325sf with a
401 sf deck.
The dimension of the existing home is 34'11" x 42' and the new residents will be 34'11"
x 53'2". The lot coverage will increase from 19.3% to 25.3% but the total side-yard
distance will increase from 10' to 14'6"under the new plan approved by the Southold
Zoning Board.
How will the work be done?
Foundation — The existing foundation will be excavated and a new foundation poured
to 8' elevation to conform to the DEC flood elevation code. The crawl space under the
house will be graded to the same elevation as the land to the NE side (water side) of the
foundation wall. The graded crawl space will have a concrete skim coat to inhibit
moisture and proper flood baffles will be added as required.
Structure —The new plan calls for 2x6 frame construction with a ceiling height at 9'
throughout the first floor and 8' on the second floor of the house. Gutters will be
attached to the base of any descending roof slop to capture rain water. All runoff water
will be channeled to the drywell in the NW corner or SE corner of the house.
Additionally, the drain water from the outside shower and/or the hot tub will be piped to
the SE corner drywell.
Attached Garage - The existing structure does not have a garage. A new garage will
be constructed using 2x6 framing. The foundation of the garage will be constructed to
support the living space above the garage. The floor of the garage will be a poured
concrete slab set at 6'6" elevation.
Deck—The existing deck will be replaced with a new deck with the same dimensions.
The foundation will be 8'diameter concrete piers. This will eliminate CCA wood from
coming in contact with the beach. The deck will be raised to accommodate the new
elevation of the house based on the DEC specifications.
Hot Tub —The hot tub will rest on grade with the required foundation to support the
weight. The hot tub will have access to a drain connected to the SE drywell to capture
water from the tub.
Beach replenishing - During the early stages of the construction process, the new
beach material will be brought to the site by truck then delivered onto the beach via
backhoe or wheel barrel. The material will be hand raked to the proper elevation
approved by the DEC. A retaining barrier will be put in place to protect the three oak
trees on the beach.
Septic System —The septic system will be installed in accordance with the Suffolk
County Health Department permit issued for this project. The septic system installation
will require that the top elevation of the land will be approximately 6'6". The current
elevation of the property in the vicinity of the proposed new septic system is 47.5". The
septic system will have a concrete retaining wall built to specification by the engineer on
the west side and north side of the leaching pools. The south side of the property
already has a septic system retaining wall for the leeching pools installed by the
homeowner to the south.
