Pursuant to the provisions of Chapter 275 and/or Chapter 111 of the Town Code of the Town of
Southold and in accordance with the Resolution of the Board of Trustees adopted at the meeting held on
December 13, 2006, and in consideration of application fee in the sum of $250.00 paid by Nancy Carroll and
subject to the Terms and Conditions as stated in

IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.

TERMS AND CONDITIONS
The Permittee, Nancy Carroll, 350 West Lake Drive, Southold, as part of the consideration for
the issuance of the Permit does understand and prescribe to the following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Department of Real Properties Office as a notice
covenant and deed restriction to the deed of the subject parcel. Such evidence shall be
provided within ninety (90) calendar days of issuance of this permit.
That the said Board will be notified by the Permittee of the completion of the work
authorized.

supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Ms. Carroll:
The Board of Town Trustees took the following action during its regular meeting held on
Wed., December 13, 2006 regarding the above matter:
WHEREAS, NANCY CARROLL applied to the Southold Town Trustees for a permit
under the provisions of Chapter 275 of the Southold Town Code, the Wetland
Ordinance of the Town of Southold, application dated November 17, 2006, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the Board of Trustees has furthered Policy 6 of the Local Waterfront
Revitalization Program to the greatest extent possible through the imposition of the
following Best Management Practice requirements: the installation of drywells to contain
the roof run-off, the installation of a hay bale line during construction, and a non turf
buffer, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on December 13, 2006, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirements imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees approve the application of NANCY CARROLL to

Dear President King
and Board:
Assistant Town Attorney, Lori Montefusco suggested that I discuss a resolution of the
criminal charges with an "ACOD", adjournment in contemplation of dismissal. In support ofthis
position I would provide the Trustees with the following:
The owner has a wetland permit for construction on her property, this permit was issued for
the same building envelope and improvements after four separate applications to the Trustees:
On January 23, 2002, after a public hearing, Permit #5481 was issued, on February 26, 2003
the Trustees granted an amendment to the permit to add the front porch.
On January 19, 2005 the Board reviewed this application again and granted a one year
extension to the permit. Same site plan submitted.
In 2006 the applicant asked to extend the permit, the Board refused the extension and
required the applicant to re-apply for a new permit. The same site plan was submitted.
On March 22, 2006 the Trustees granted permit #6316 for the footprint of the house with the
same conditions of a non-turf buffer and dry-wells.
On August 8, 2006 a building permit was issued: the construction plans specifically
identified demolition of most of first floor walls. The plans also described replacement of
damaged "Floor Joist", as needed.
Prior to construction the builder installed the haybales and requested an inspection of the staking.
The builder was then authorized to begin.
On or about October 12th, 2006 construction was started. Shortly atter construction began the
builder began to see problems with the existing structure. The degree of damage could not be
ascertained until the floor joists were exposed during construction (the first floor covered the floor
joist). Once the floor joists were exposed, the general contractor Franz Fenkl, Shelter Island Design
& Build, Inc, who is an experienced builder from Shelter Island and along the waterfront recognized
the need to alert the building department to the existing conditions. On or about October 12th, he
immediately went to the building department to identify the unanticipated structural problem.
The Problem: The floor joist of the existing house had evidence of rot. Also, the foundation
is a concrete block foundation, there was displacement of the masonry blocks (shifting and
falling into basement). These conditions make the existing structure unsound.
As soon as the excavator uncovered these conditions Mr Fenkl reported this problem to Damon
Rallis. Damon advised that if the structure was unsound then replacement was necessary and
appropriate. However, because of the wetland permit he directed Mr. Fenkl to the Trustees office
to report the problem. He left the building department and reported to the Trustees office. Lauren
properly advised Mr. Fenkle to apply for an amendment to the permit due to the unforseen
structural condition of the joist and foundation. The contractor cleaned up the site and ceased
further construction. An application for an amendment to the permit was filed immediately.
The work was stopped the same day as the builder reported the problem to the Town.
The architect provided to the building department and Trustees amended plans for the repair to the
foundation and new first floor structure.
The existing house has a 6' 8" basement and a concrete basement floor, three of the basement walls
and the basement floor remain. The walls and slab of the existing garage could not be reused. The
structural repairs which will be required to the existing foundation are shown on the attached
drawing: the first two courses (16") out of the 10 courses of the existing foundation will need to be
replaced, the existing block walls will be filled with cement and vertical bars.
The existing footprint of the foundation of the proposed house has not changed throughout the
permit process: the footprint has always included (1) the basement of the existing house, (2) the
removed old slab under the existing garage (the area is part of the footprint of the proposed house)
(3) a new garage and (4) new front & back porch.
The property has bulkhead, drywells will be added to catch all water runoff, the sanitary is in the
front yard, and a 10' nonturf buffer is shown on the plans.
A criminal violation was issued on November 14, 2006 after the owner and builder had voluntarily
stopped the work, notified the town and applied to the Trustees for an "amendment to the permit"
for repairs to the existing foundation. All in good faith and as directed by Damon & Lauren. The
owner did not intentionally demolish a house and have a new foundation dug. The area dug is the
slab of the old garage (part of the main house) and the new garage. All work was consistent with
the site plan.
This owner had a valid permit, the work was in accordance with the permit but the condition of the
foundation had to be exposed and reinforced. The owner requested an amendment before continuing
the work. The construction remains within the footprint of the existing house, the excavation is for
the new structures as shown on the permit (the garage& front porch) as shown on the permit since
2003. Three full walls of the existing house (South wall ~48, west wall ~34' and north wall ~36'-
orange highlighter) remain and the basement floor of the existing house remain. The new garage
was excavated and the exterior walls of the front porch were excavated (as shown on the permit).
The Trustees jurisdiction is to review the permit for impact to the wetlands. The wetland permits
have been issued and reissued three times because the property was developed, is protected by
bulkhead and jetties. The lot is small, the house is in line with all the other homes on West Lake
Drive, the rear deck was made smaller than the original deck and drywells and gutters are required.
A nonturfbuffer is provided along the bulkhead. The sanitary is in the front yard. The owner got
all the appropriate permits before construction. At the hearing for the amendment, the Trustees
directed the owner to obtain a full permit. The construction has been stopped since October. A
violation should never have been issued and an amendment to the existing permit should have been
issued at the November meeting.
We have proposed to the town attorney an ACOD "adjournment in contemplation of dismissal".
We hope that given the efforts by the owner to obtain a permit to make the necessary repairs to the
foundation, the Trustees will agree to an equatable resolution of the criminal charge.

The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, March 22, 2006 regarding the above matter:
WHEREAS, Robert Tast as agent for NANCY CARROLL applied to the Southold Town
Trustees for a permit under the provisions of Chapter 97 of the Southold Town Code,
the Wetland Ordinance of the Town of Southold, application dated February 17, 2006,
and
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council for their findings and recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on March 22, 2006 at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the proposal complies with the standards set forth in Chapter 97 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
RESOLVED, that the Board of Trustees approve the application of NANCY CARROLL to
construct a front porch, one-car garage and second floor over existing dwelling, and renovate
and alter existing first floor within existing footprint with the condition of a 10' non-turf buffer
landward of the bulkhead, drywells to contain roof runoff, pervious driveway and all as per plans
drawn by Young and Young last dated February 16, 2006.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

NANCY CARROLL requests a Wetland Permit to demolish the existing dwelling and construct a new dwelling
with a second-floor addition, new 16'X 24' garage, 8'X 58.3' front porch and 13'X 39' raised patio, and repair
foundation. Located: 350 West Lake Dr., Southold. SCTM#90-1-21
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold
Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the
information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the
records available to me, it is my recommendation that the proposed action is INCONSISTENT with the denoted
following Policy Standards and therefore is INCONSISTENT with the LWRP.
Policy 6 Protect and restore the quality and function of the Town of Southold ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and
regulations for all Andros Patent and other lands under their jurisdiction
Comply with Trustee regulations and recommendations as set forth in Trustee permit
conditions.
The proposed distance to the deck from the marine wetland boundary is 43.3 feet. The distance to the garage
from the marine wetland boundary is 63 feetl a minimum setback distance of 100 feet is required pursuant to
Chapter ~ 275-3. Findingsl purposel iurisdictionl setbacks. The proposed 58.30' x 8' porch proposed on the
landward side of the house is an minor exempt action and not subiect to review. Please require that the
applicant amend the application to meet the above policy to the greatest extent possible.

NANCY CARROLL requests a Wetland Permit to construct a front porch, one-car garage and
second floor over ex!sting dwelling, and renovate and alter existing first floor within existing
footprint. Located: 350 West Lake Dr., Southold. SCTM#90-1-21. The proposed action is
located in the Flood Zone X.
The proposed action has been reviewed to Chapter 95, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation
that the proposed action is INCONSISTENT with the denoted following Policy Standards
and therefore is INCONSISTENT with the LWRP.
Policy 6 Protect and restore the quality and function of the Town of Southold
ecosystem.
6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in
Trustee permit conditions.
The proposed setback of the structure from the wetland system is proposed at 43'.3" feet; a
minimum separation distance of 100' is required pursuant to Chapter 97. Please require
that the applicant amend the application to meet the above policy to the greatest extent
possible,
Additionally~ if the action is approved and to further Policy 5: Protect and Improve Water
Quality in the Town of Southold:
1. Require that the relocated driveway be constructed of pervious material.
2. Require a planting plan for the 10' non-turf buffer including native, disease-
resistant and drought-tolerant vegetation to minimize irrigation and fertilizer
applications.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
All applicants for perm/ts* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus~ each answer must be explained in detail~ listing both supporting and non-
suoDortin~, facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.
A copy of the LWRP is available in the following places: online at the Town of Southold ' s
website (southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all

The proposed construction is to alter the first floor and add a second
floor Master Bedroom and Sitting Room, construct a garage addition to the
east, a raised patio/terrace on the south and a front porch on the north. All
of this work was previously approved by the Board and a Zoning Board of
Appeals Variance has been granted for the front porch.
