Any other activity within 100' of the wetland boundary requires a permit from this office. This is not a determination from any other agency. Box 24 East Marion, NY 11939 Re: 420 Lakeview Terrace SCTM#31-9-11 Dear Mr. Hussain: The following action was taken by the Board of Town Trustees during a special meeting held on April 27, 1999 regarding the above matter: WHEREAS, ARIF HUSSAIN applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated March 8, 1999 and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on April 21, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 37-18 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees grant a Wetland Permit to ARIF HUSSAIN to repair wood retaining wall within 18", install catwalk and wood stairs a~ indicated on survey dated March 3, 1999, and install a stockade fence along the northwest with the stipulation that existing pipe located landward of the retaining wall be removed and a drywell be installed to contain the roof run-off and pool backwash. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department or Agency which may also have an application pending for the same or similar project. Permit to construct and complete project will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with the below Policy Standards and therefore is INCONSISTENT with the LWRP. The applicant HAS NOT demonstrated that the action could meet or further the below policies. Marion Lake is a 26 acre lake completely surrounded by private residential lots except where Bay Avenue intersects it. In recent years the lake has become eutrophic or polluted and it has been invaded by the common reed (Phragmites sp.). AERIAL PHOTOS INDICATE THAT MARION LAKE CONTAINS NO DOCKS. CORRESPONDINGLY THE APPLICANT ENJOYS ACCESS TO THE WATER VIA AN EXISTING CATWALK. THE USE OF THE DOCK AND/OR PURPOSE HAS NOT BEEN IDENTIFIED. In addition the LWRP states "Piers, docking facilities, and catwalks must not result in an unnecessary interference with use of public trust lands.
