This application must be filled in by typewriter or ink and submitted to the Building Department with the following:
For new building or new use:
1. Final survey of property with accurate location of all buildings, property lines, streets, and unusual natural or
topographic features.
2. Final Approval from Health Dept. of water supply and sewerage-disposal (S-9 form).
3. Apprnval of electrical iustallation from Board of Fire Underwriters.
4. Sworn statement from plumber certifying that the solder used in system contains less than 2/10 of 1% lead.
Commercial building, industrial building, multiple residences and similar buildings and installations, a certificate
of Code Compliance from architect or engineer responsible for the building.
6. Submit Planing Board Approval of completed site plan requirements.

Dear Mr. Gitlen;
An inspection of repair work was conducted at the above referenced project on Wednesday,
September 6, 2006. The repairs that have been made are shown on the enclosed photographs
and outlined below.
Poured concrete haunch footing 4~c~ exterior frame wall on the far east side of the barn.
Recommendation to install 4' by 4' steel L-brackets ~ 2'-0' max. bolted to 2'x 6' ledger board
and top of concrete haunch footing. (See Photo No.1,
No.2, & No.3)
Framinu of exterior door on far north wall.
Recommendation to install (2) 2" x 6" header above door. (See Photo No.4)
Poured concre~ haunch foot, no on center east wall.
Verification of size and depth of haunch footing. (See Photo No. 5)
South wall of east oaraue
Recommendation to install 4" by 4" steel L-bracket bolted to bottom ledger and top of concrete
haunch footing (See Photo No. 6 & No. 7)
Roof rafters on east side of barn.
Recommendation to install joist hangars on 2' x 8' roof rafters and ledger board bolted to wall
studs for additional support at end of roof rafters. (See Photo No. 8)
It is my professional opinion that the repairs made to the existing structure are structurally
adequate and in substaotial compliance with the Residential Code of New York State.

INSTRUCTIONS
a. This application MUST be completely filled in by typewriter or tn iuk and submitted to the Building Inspector with 4
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises Or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a permit
shall be kept on the premises available For inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoning amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereafter, a new permit shall be required.

After investigation and inspection the Board finds that
the appli~ant requests permission to reinstate the nonconforming
use of the premises as a public garage. The findings of the Board
ere that it was previously used as a public garage, and such use
had only recently been discontinued.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;

2. Entrance and exit driveways shall have an unrestricted
width of not less than twelve (12) feet and not more than
thirty (.30) f~et and shall be located not less than ten (10)
feet from any property line and shall be so laid out as to
avoi~ the necessity of any vehicle backing out ac~oss any
public right-of-way.
3. Vehicle lifts or pits, dismantled automobiles and all
parts or supplies shall be located within a building.
4. All service Or repair of motor vehicles, other than such
minor servicing as change of tires or sale of gasoline or
oil, shall be conducted in a building.
5. The storage of gasoline er fla~able oils in bulk shall
be located fully underground and not less than thirty-five
(~5) feet from any property line other than the street line.
6. No gasoline or ~uel pumps or tanks shall be located less
than fifteen (15) feet from any street or property line.
7. No motor vehicle sales, used car lots, gasoline service
within three hundred (300) feet of a church~ public school,
library, hospital, orphanage or a rest home.

WHEREAS, a public hearing was held on July 16, 1987
and continued on August 20, 1987, at which time the hearing
was concluded, in the Matter of the Application of FREDERICK
WIGHTMAN/DAVID FREY/JOSEPH REINHART under Appi. No.~644, and
WHEREAS, at said hearing all those who desired to be heard
were heard and their testimony recorded; and
WHEREAS, the Board has carefully corrsidered all testimony
and documentation submitted concerning this application; and
WHEREAS, the Board Members have personally viewed and are
familiar with the premises in question, its present zoning, and
the surrounding areas; and
WHEREAS, the Board made the following findings of fact:

Decision Rendered October 8, 1987
1. The premises in question is a described parcel of land
containing an area of 43,560± sq. ft., lot width (frontage) of
185± ft., lot depth of 2402 feet, and is more particularly
identified on the Suffolk County Tax Maps as District 1000,
Section 75, Block l, Lot 16.
2. The subject premises is improved with three buildings,
all as depicted by sketch prepared by barre~ A. Strang, Arch~ect
and survey prepared by ?etonic Surveyors and Engineers, P.C.
dated November 8, 1986:

(b) .~_Buildin~ "2", a two-stor~ brick and frame build-
lng, containing a total first floor ar(,a of 1200 sq. ft., of
which 450± sq. ft. was used as office area 464± sq. ft. for
retail-sales area, and 286 sq ft. storage area incidental to
the retail and office uses. Both uses have existed as legal
nonconforming uses conLinuously since before the inception of
zoning until about 1977. During 1977, the westerly 286± sq.
ft. portion of the building was converted from storage area to
a car wash, and then back to accessory ~torage area. The
second floor of this building contains, a 900± sq. ft. single-
family apartment, a legal conforming u,~e in this Zone District.
(c) Building "3", a one-story masonry building
conta ning a total floor area of 1656± sq. ft. located
approximately 24 feet from the east side of Building

having received a Variance under Appeal-No. 2210 on Novem-

4. It is also noted for the record that Building "1"
was partly converted from warehousing of potatoes to
warehousing of antiques about 1978 and was discontinued
during about 198~. No variances were found of record
permitting the conversion from agricultural warehousing
to commercial or wholesale-sales warehousing.
5. The property is nonconforming also as to lot area
(having an area of less than the curren£ two-acre zoning
requirement), and is located in the "A-40" Residential and
Agricultural Zoning District. The buildings were built
prior to the enactment of zoning in 19B7, and front along
a State Highway.
6. No record has been found of ti~e issuance of any
building permits, Certificates of Occupancy, or Site Plan
approvals by the Town concerning the premises, building
conversions, and changes of uses since the inception of
zoning in 1957.

7. Article XI, Section 1OO-llB, Subsection (El of the
Zoning Code provides that:
"...A nonconforming building may not be
reconstructed or structurally altered during its
life to an extent exceeding in aggregate cost
fifty percent (50%) of the fair value of the
building, unless the use of such building is
changed to a conforming use .... *'
Subsection (Al reads:
~'...The lawful use of a building or premises
existing on the effective date of this chapter...
may be continued although such use does not con-
form to the provisions of this chapter, and such
use may be extended through the building lawfully
acquired to said date .... "
8. Appellants have requested a use variance to permit
the expansion of "...preexistln9~ nonconforming business by
nature of converting existing garage bays to business use
and linking same via an addition to existing westerly
building..." end/or interpretation on the term "use"
verses ~'tenancy."
9. There are a total of three buildings upon the
subject premises, and the bui)dings referred to in the
preceding paragraph hereof are the two front buildings,
Buildings "2" and "3".
Accordingly, on motion by Mr. Grigonis, seconded by
Mr. Doyen, it was
RESOLVED, that this Board make the following deter-
mination:
(al that the use referred to as "garage bays"
~existing in Building #3 is a use in conformity with the
1976 variance, rather than a preexisting nonconforming
business use.
(b) that only the first floor area of 1200:
sq. ft. of Building "2" has continuously since before the
~Nenactment of zoning been maintained and used for retail and
office areas, and
(c) that the Town may permit expansion of such
area as regulated by Section lO0-118(E) of the Zoning Code
within stated limitations (also see Cordes vs. Moore 1955,
308 N.Y. 761), and that such an expansi'~n would be
permitted provided it does not exceed 50% of this 1200±
sq. ft. area of Building "2".
(d) that the Town has not restricted the
premises to certain tenants or owners, and accordingly
has considered only the area and use of the premises and
buildings.
(el that such an expansion of the preexisting
nonconforming use of Building "2" from 1200+ sq, ft, to

1800± sq. ft. shall be permitted [o those uses which will
not require higher standards with respect to yards, parking,
and similar requirements [such as restaurants, etc,],
(fl that the existing use of the single-family
900± sq. ft. dwelling unit on the second floor of Building "2"
and the use of Building "1" for storage shall be permitted to
continue and shall not be permitted to be converted to a
~....nonconforming commercial use.
(gl that the existing use of the garage bays
for storage in Building ~3 shall be permitted to continue
and shall not be permitted to be converted to a nonconforming
use [except that the storage use may be income-producing].
(h) that any portion of the square footage of
the buildings nlay be utilized for the requested retail or
office use provided same does not exceed the maximum
permitted 1,800 sq. ft, [1200 sq. ft. existing plus 50%
as permitted under lO0-118E of the Zoning Code] and
provided further that the remaining portions of the buildings
shall be permitted for the existing "garage bays," for
commercial or accessory storage use, and any other uses
permitted in this "A-40" Residential and Agricultural Zoning
District.
(il That by the grant of this variance, this Board
hereby revokes any other variance(s) which may have been
previously granted for the use of these promises.
(j) That a proposal to expand the nonconforming
retail/office area in excess of that permitted by the Code
should be via application to the Town Board for consideration
on a change of zone or other legislaCive action since the
extent of the use variances permitted on this property has
been utilized to the maximum possible under our jurisdiction.
(k) that there be no storage of vehicles, materials,
or any othe~, items in the open yard areas.
Vote of the Board: Ayes: Messrs. Goehringer, Douglass,
Grigonis, and Doyen. (Absent was: Member Sawicki.) This
resolution was duly adopted.
