Dear Mr. Herrmann:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, May 15, 2013 regarding the above matter:
WHEREAS, En-Consultants on behalf of MARILYN ANGELSON applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated April 23, 2013, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on May 15, 2013, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of MARILYN
ANGELSON to construct approximately 258 linear feet of vinyl bulkhead in-place of
existing timber bulkhead; remove and replace existing +52' timber return with +68' vinyl
return; remove and replace fence along top of return; install +2.5'x14' removable metal
steps to beach; and backfill with approximately 100 cubic yards of clean sand fill to be
trucked in from an approved upland source; with the condition to establish and
subsequently maintain a non-turf buffer from top of bank to bulkhead; and as depicted
on the site plan prepared by En-Consultants, last dated April 19, 2013 and stamped
approved on May 15, 2013.
Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

2013 the following recommendation was made:

return; remove and replace fence along top of return; install 2.5'X 14' removable metal

A permit (5629) was issued for a bulkhead on the property in 2002.
En-Consultants on behalf of MARILYN ANGELSON requests a Wetland Permit to construct
approximately 258 linear feet of vinyl bulkhead in-place of existing timber bulkhead; remove and
replace existing +52' timber return with +68' vinyl return; remove and replace fence along top of return;
install +2.5'x14' removable metal steps to beach; and backfill with approximately 100 cubic yards of
clean sand fill to be trucked in from an approved upland source. Located: 950 Park Avenue, Mattituck.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
CONSISTENT with the Policy Standards and therefore is CONSISTENT with the LWRP.
In the event the action is approved it is recommended that the Board require a non-turf buffer pursuant
to Chapter 275 Wetlands and Shorelines regulations.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

The project seeks to replace an existing, permitted (see Town Wetlands Permit No. 5629) timber bulkhead with a vinyl
bulkhead in the same location to maintain the property's historical method of protection against erosion and flooding; and
to replace and extend the existing return adjacent to the road end to prevent erosion resulting from outflanking of the
existing return as occurred during Hurricane Sandy. Other than the ecological benefit of replacing a treated timber
bulkhead with untreated vinyl sheathing, the project will effectively maintain the historically preexisting conditions along
this bulkheaded shoreline without any change in or significant adverse impact on the adjacent unvegetated wetlands area
or tidal waters of the Town, as the proposed return extension will occur at the landward end of the existing return and
landward of the intertidal & wetland areas.
