Maintaining this setback as part of the primarily in-place ~novations .fthe existing dwelling necessitates 5 feet of relief fi, om the 50' rear yard setback under Article IV, Section 280-18, and 30 feet of reiief from the 75' shoreline structure sctIack under Article XXI3[, Section 280-116B. The grant of relief fxom Article IV, Section 280-15 will not cause an undesirable change to the charac :er of the neighborhood or a detrimem to nearby properties because only the replaeemant ~fthe garage roof and cupola within the existing garage footprint (which will simply mainlain the existing 45' rear yard setback) and the addition ora 24 sf outdoor shower 46' f x~m the bulkhead will be nonconforming. As the rear yard on this property is Wnnneweq a Pond, there is no neighboring property or residential structure or use that would or eot ld be impacted by mainmnance of the existing garage location or addition of an outdoor s]tower. The grant of relief from Article XXI], Section 280-116B vail not cause an undesirable change to th~ character of the neighborhood or a detriment to nearby properties because with the exc~ption of the 24 sf outdoor shower (46' bulkhead setback) and 8' x 9.5' (76 sf) ealxy dec]: (62' bulkhead setback) to be added to the waterside nftbe house, such relief would ~nly allow the exisfin~ structures to remain where they are with in-place replacemem ~r ~raovation within the same footprint, as described below: a) New roof and cupola within existing garage footprint (maintains existing nonc~ntbrminE 45' rear yard ~nd 45' shoreline sttuctare setbacks) b) One-:,~ory addition in place of existing breezeway between dwelling and garage (eonf 3rms to required rear yard setback and rnaintaln~ existing nonconforming 62' shore line structure setback) c) New ~cond story and roof wifl~in existing dwelling footprint (conforms to requ~: :ed rear yard s~tback and maintains existing 72' uOnconforming shoreline struclure setback) All of the other newly proposed structural areas will exceed both the required rear yard and shorelirs~ structure setbacks, including the enclosure &the underside of the existing waterside de;k; tho 2' bump-out with new crawl space on the road side of house; and the 7' x 10' porch on the roadside of hou.se. In that case, relief was granted to allow an illegally constructed detached garage to remain 31 feet from the bulkhead on a propers3r located on Wunneweta Pond and 5 properties to thc south of ~e subject parcel. Due to thc e. dsting location of the dwelling 45' from thc bulkhead, it is not possible to expand or al' ~r the dwelling in place without seeking the requested area variances. However, as described in #I above, the renovations and alterations have been designed to mlnlmi?e th~ ~ anlount of relief necessm'y to achieve the applicant' s goals of renovating and imlYmving upon the existing dweUing by limiting all of the renovations to existing footprillts e~ cept for 275 square feet of structure, more than half of which is proposed on the roadside of the house and in eontbmamace with all required setbacks. The 5 feet o~ 10 percent of rear yard setback relief requested from the 50' rear yard setback urt& r Article IV, Section 280-18 is neither mathematically substantial nor substantial h~ fact since relief is required primarily to maintain the location of the existing dwelling. The 30 feet or 40% of relieffi~m the 75' shoreline s-mxcture setback under Article XXI1, Section 280-116B is mathematically substantial bat not substantial in fact since again tae relief is required primarily to maintain the location of the existing dwelling. The project will not have an adverse impact on the physical or environmental conditions because as d ;scribed above, thc majority of thc proposed renovations have been proposed within thc c~ isling footprint and/or toward the road and away from Wunneweta Pond and its associatex[ tidal wetlands. Specifically, Town dffmed lot coverage as a result of the project will only increase by approximately 275 square feet or by 0.36 percent from 4.61 to 4.97 pea'ex nt, and the existing mini'mm wctlaflds setback of 45' will not be further encroached upon. Significant mitigation measures have been included in the project design both 1 o offset any potential impacts of thc proposed construction activities and to improve upon existing site conditiOnS and create a net environmental benefit upon project completion. Most sj~ificantiy, the project will result in an improvement to both groundwater and surface water quality as a result of the replacement of the existing nonconforming sanitary system located less th~n 50 feet from Wnnnew~ta Pond with a Suffolk Con ~Vj Department of Health Services-approved sanitary system located more 05/20/2013 10:59 FAX 6312836135 EN-CONSULTANTS,INC, ~004 Arthur Skelskie and iq,an Molofskv "Area Variance Reasons." See LWRP Section III - Policies Pages 8 through 16 for evaluation criteria ~ Yes [~ No ~ Not Applicable Attach additional sheets if necessary Policy 5. Protect and improve water quality and supply in the Town of Southold. See LWRP Section III - Policies Pages 16 through 21 for evaluation criteria Yes No Not Applicsblc The proposed relocation and upgrade of the nonconforming sanitary system located less than 50' from wetlands to a SCDHS- approved sanitary system located more than 100 feet from wetlands will result in an improvement of groundwater and thus ultimately surface water quality of Wunneweta Pond. The addition ora drainage system of leaders, gutters, and ckywells will reduce the volume of roof runoff; and the permanent establishment of an extensive nonturf buffer will both decrease the potential volume of surface water runoff and improve the quality of mnoffthrough the prohibition of potantially chemically dependent lawn areas and the buffer's ability to act as a sink for fertilizers and other chemicals applied farther upland. Attach additional sheets if necessary Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems including Significant Coastal Fish and Wildlife Habitats and wetlands. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. Yes ~] No ~] Not Applicable However, the renovations and alterations have been designed to avoid any reduction in the existing wetlands setback and to minimize the increase in lot coverage by limiting all of the renovations to the existing structural footprint excerpt for 275 square feet of structure, more than half of which is proposed on the roadside of the house and outside wetlands jurisdiction. Significant mitigation measures have been included in the project design both to offset any potential impacts of the proposed construction activities and to improve upon existing site conditions and create a net environmental benefit upon project completion. Most significantly, the project will result in an improvement to both grotmdwater ~md surface water quality as a result of the replacement of the existing nonconforming sanitary system located less than 50 feet from Wunneweta Pond with a Suffolk County Department of Health Services-approved sanitary system located more than 100 feet from wetlands and outside wetlands jurisdiction. Additionally, the volume of uncollected and un-recharged roof runoff will be decreased and the quality of runoff reaching the surface waters of Wunneweta Pond will be improved as a result of the installation ora presently absent drainage system of leaders, gutters, and drywells and the establishment ora nonturf buffer adjacent to the tidal wetlands with a minimum width of 10 feet and total area of approximately 34,000 square feet, which will serve both to prohibit potential fertilizer dependent lawn areas and filter contaminants from further upland. Ther~fure, the project is consistent with the goals of Policy 6. Attach additional sheets if necessary Policy 7. Protect and improve air quality in the Town of Southold.
