SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated March 19, 2013 stating that this application is considered a matter for local determination as there appears to be no significant county -wide or inter -community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated March 25, 2013. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP, EXCEPT for the Proposed Patio being proposed in the CEHA which is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP. However, the applicant has agreed to reduce the size of the proposed patio to less than 200 square feet, thus making it consistent with the LWRP policy. PROPERTY FACTS/DESCRIPTION: Subject parcel is a non -conforming 3,596 square foot lot in the R-40 zone district. It is improved with a 1 story frame house with attached deck (storm damaged) and an accessory frame garage. It has 27.40 feet of frontage on Rabbit Lane (Private Road), 103.60 feet along the northern property line, 40.96 feet on Gardiners Bay and 113.45 feet along the southern property line as shown on the survey dated January 14, 2013 prepared by John T. Metzger, LLS. BASIS OF APPLICATION: Request for Variances from Article XXIII Section 280-124 and Article XXII Section 280-116B and the Building Inspector's March 1, 2013 Notice of Disapproval based on an application for building permit for construction of a new single family dwelling: 1) less than the code required minimum single side yard setback of 10 feet, 2) less than the code required minimum combined side yard setback of 25 feet, 3) less than the code required minimum rear yard setback of 35 feet, 4) more than the code permitted maximum lot coverage of 20%, 5) less than the code permitted bulkhead setback of 75 feet. RELIEF REQUESTED: The applicant requests a variances to demolish and reconstruct a new single family dwelling with a rear yard setback of 28 feet where the code requires 35 feet, a single side yard setback of 6 feet where the code requires 10 feet, a combined side yard setback of 16 feet where the requires 25 feet and lot 9 0 Page 2 of 3 — April 18, 2013 ZBA Fileg6640 - Frizzi SCTM: 1000-31-18-15 coverage of 29% where the code permits a maximum of 20%. Additionally, the applicant is proposing a 17 foot setback from the bulkhead where the code requires 75 feet. ADDITIONAL INFORMATION: The applicant proposes to build a new two story dwelling to replace the one- story dwelling that was destroyed by hurricane Sandy in October of 2012. This Board asked for comments from the Southold Town Trustees and in a memo dated April 3, 2013, the Trustees stated that the proposed on -grade patio located within the CEHA is not to exceed 200 square feet as per Chapter 111 -Town of Southold Coastal Erosion Hazard Area Law; and it needs to be constructed with pervious material in its entirety to prevent storm -water runoff and erosion. An e-mail was received from an adjoining neighbor with concerns. FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on April 4, 2013, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of pre-existing non -conforming waterfront parcels with dwellings and accessory structures, all of which have multiple non -conformities, similar to the subject parcel and to what the applicant proposes. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than area variances. The pre-existing non -conforming subject parcel is narrow and shallow with a pre-existing non -conforming accessory structure located in the front yard which eliminates any location where a dwelling may be proposed and not require area variances. 3. Town Law 4267-b(3)(b)(3). The five area variances granted herein are mathematically substantial. 1) The proposed rear yard setback of 28 feet represents a 20% relief from the code required 35 feet. This substantiality is mitigated when considering the proposed rear yard setback will be in more conformance with the code than that of the previous pre-existing rear yard setback of 15+/- feet. 2) The proposed side yard setback of 6 feet represents a 40% relief from the code required 10 feet. This substantiality is mitigated when considering the proposed side yard setback will be in more conformance with the code than that of the previous pre-existing side yard setback of 4.5 feet. 3) The proposed combined side yard setback of 16 feet represents a 36% relief from the code required 25 feet. This substantiality is mitigated when considering the proposed combined side yard setback will be in more conformance with the code than that of the previous pre-existing combined side yard setback of 9.2+/- feet. 4) The proposed bulkhead setback of 17+/- feet represents a 77% relief from the code required 75 feet. This substantiality is mitigated when considering the proposed bulkhead setback will be in more conformance with the code than that of the previous pre-existing bulkhead setback of 7.5+/- feet. 5) The proposed lot coverage of 29% represents a 45% relief from the code permitted maximum of 20%. This substantiality is mitigated when considering the proposed lot coverage will be in more conformance with the code than that of the previous pre-existing lot coverage of 36%. 4. Town Law 6267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and additionally, the applicant installed a new bulkhead. 5. Town Law 4267-b(3)(b)(5). Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of constructing a new dwelling, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Schneider, seconded by Member Goehringer, and duly carried, to GRANT, the variances as applied for, and shown on the architectural drawing prepared by Angel B. Chorno, R.A., sheet No. SK/1, dated 2-14-13, last revised 3-4-13, and the survey prepared by John T. Metzger, L.S., dated January 14, 2013, Subject to the following condition: CONDITIONS: The proposed patio in the Coastal Erosion Hazard Area shall be less than 200 square feet and be constructed with pervious materials, so as to mitigate stone water runoff and erosion. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or apossible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. (1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted, because: The existing house was damaged by hurricane Sandy and a new house is proposed further landward than the existing house from the bulkhead and landward of the Coastal Erosion Hazard Zone. The storm destroyed the protective bulkhead to the waterfront homes in this neighborhood, causing significant damage to the community on Rabbit Lane. Rather than try to restore the existing home, which some property owners on the block are doing, Mr. Frizzi will construct a small home which will be elevated against future flooding. As Rabbit Lane is redeveloped the existing homes are becoming flood compliant. The existing home is 4.5 from the westerly property line, 4.7 from the easterly property line, less than 10 feet to the bulkhead (which is under re -construction) and within the Coastal Erosion Hazard Area. Only the front yard of the existing structure is conforming. The proposed house will be 10 feet from the westerly side yard which is the unobstructed side of the house. The east side is 6 feet from the easterly property line. The existing accessory building already blocks the east side of the property, therefore the setbacks are greater on the west side in order to maintain a greater access. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: The property is preexisting nonconforming, as are all the lots on Rabbit Lane. The proposed house was designed to be the minimal size of a "habitable dwelling" (minimum is 850 sq.ft.). The Frizzi family never intended to replace the existing house, Mr. Frizzi has very fond memories with his deceased wife and children enjoying their home, the new house is a matter of necessity due to the Hurricane. (3) The amount of relief requested is not substantial because: The lot is only 3,596 sq. ft. to the MHWM and the Coastal Erosion Hazard Line bisects the property, affecting one third of the buildable square footage of the lot. The lot narrows to 27.40 feet along the road, with 40.96 linear width along the water. The proposed house respects the environmental constraints of the property and maximizes the setbacks to the extent practical. The house remains small but in character with the surrounding neighborhood. The existing house and surrounding homes were developed with closer setbacks. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The house will be raised to FEMA compliance in order to prevent future storm damage.
