NAME OF APPLICANT: Roman Catholic Church of the Sacred Heart

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its
reply dated April 15, 2013 stating that this application is considered a matter for local determination as there
appears to be no significant county-wide or inter-community impact.
LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the
Minor Actions exempt list and is not subject to review under Chapter 268.
PROPERTY FACTS/DESCRIPTION: Parcel 10: Lot is improved with a single family dwelling and accessory
garage, it has 91.50 feet on Depot Lane, 405.13 feet along the northern property line, 248.68 feet along the eastern
property line and 240.99 feet along the southern property line. Parcel 12.1: Lot is an irregular shape with a
cemetery and nursery stock on the property with 417.00 feet on Depot Lane, 867.44 feet along the Long Island Rall
Road, 1377.03 feet along the eastern property and 939.76 feet on the southern property line as shown on the survey
dated November 25, 2012 prepared by John C. Ehlers, LLS.
BASIS OF APPLICATION: Request for Variance under Article IV Section 280-14 and the Building Inspector's
January 28, 2013 Notice of Disapproval based on an application for building permit for a lot line change, at:
Proposed Lot #10 - I) less than the code required minimum lot size of 80,000 sq. ft.
RELIEF REQUESTED: The applicant requests a variance to reduce the square footage of a 75,664 square foot
nonconforming parcel (SCTM#1000-96-05-10) to 54,929 square feet by the way of a tot line change with an
adjoining conforming parcel (SCTM# 1000-96-05-12.1). All as shown on the Survey of Lot Line Modification
prepared by John C. Ehlers, L.S. dated November 25, 2012.
ADDITIONAL INFORMATION: At the public a neighbor spoke with concerns regarding possible change in the
view.

FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on May 2, 2013, at which time written and
oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and
surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant
and makes the following findings:
1. Town Law §267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of
the neighborhood or a detriment to nearby properties. The proposed lot line change will expand the cemetery and
decrease the size of the subject residential parcel, which will still be characteristic in size to other residential
parcels in this neighborhood.
2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible
for the applicant to pursue, other than an area variance. Grave sites were placed close to residential property lines
and the best feasible way to expand this cemetery is to acquire adjoining lands.
3. Town Law §267-b(3}(b)(3). The variance granted herein is mathematically substantial, representing 3 I% relief
from the code. However, the proposed lot line changes are proposed to continue the permitted uses of the subject
parcels without creating any new non conformity.
4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential
community will have an adverse impact on the physical or environmental conditions in the neighborhood. The
applicant must comply with Chapter 236 of the Town's Storm Water Management Code.
5. Town Law ~267-b(3)(b){5). The difficulty has been self-created. The placement of grave sites close to the
property line is self created.
6. Town Law 1~267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of lot line changes while preserving and protecting the character of the neighborhood
and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Goehringer, and
duly carried, to
GRANT., the variance as applied for, and shown on the Survey of Lot Line Modification prepared by John C.
Ehlers, L.S. dated November 25, 2012.
CONDITIONS:
1. Approval by the Planning Board.
2. Planting of evergreen privacy screening for 82 feet +/-along the property line adjoining the residential
parcel to the west.
Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays
and/or a possible denial by the Building Department of a building permit, and may require a new application and
public hearing before the Zoning Board of Appeals.
Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey
cited above, such as alterations, extensions, or demolitions, are not authorized under this application when
involving nonconformities under the zoning code. This action does not authorize or condone any current or future
use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action.

Thank you for the opportunity to review this application. This lot line modification
is currently before the Planning Board. However, we must wait for a decision
from the ZBA on the variance request for Lot 10 to become more non-
conforming in size.
Although the Planning Board does not typically support a decision to create a
more non-conforming lot, this lot line modification appears beneficial in that it
will allow for additional space for the existing grave sites on the easterly
property line of Lot 10. Additionally, the area of land being transferred from Lot
10 is relatively small and will not affect its functionality. The Planning Board
supports a variance to accomplish the movement of the lot line to accommodate
the existing grave sites.
The Planning Board does have a concern about the proposed new location of
the southern lot line potentially having an impact on the adjacent property
owner, and will be considering whether a buffer or screening might be Used to
mitigate those impacts.

REQUESTED, to all owners of property (tax map with property numbers enclosed), vacant or
improved, which abuts and any property which is across from any public or private street.
Use the current owner name and addresses shown on the assessment rolls maintained by the
Southold Town Assessors' Office, or Real Property Office at the County Center, Riverhead. If
you know of another address for a neighbor, you may want to send the notice to that address as
well. If any letter is returned to you undeliverable, you are requested to make other attempts to
obtain a mailin.q address or to deliver the letter to the current owner, to the best of your ability,
and to confirm how arran.qements were made in either a written statement, or durin.q the
hearin.q, providing the returned letter to us as soon as possible;
