PROPERTY LOCATION: 1245 Gillette Drive and East Gillette Drive, East Marion, Ny
SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this
application and determines that this review falls under the Type II category of the State's List of Actions, without
further steps under SEQRA.
SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk
County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its
reply dated April 15, 2013 stating that this application is considered a matter for local determination as there
appears to be no significant county-wide or inter-community impact.
LWRP DETERMINATION.' The relief, permit, or interpretation requested in this application is listed under the
Minor Actions exempt list and is not subject to review under Chapter 268.
PROPERTY FACTS/DESCRIPTION: Subject parcel is improved with a one story dwelling with attached garage
and deck. It is a non-conforming lot containing 14,043 sq. fl. in the R-40 zone district. It has 100.00 feet on
Gillette Drive, 141.71 feet on the southem property line, 100.03 feet on East Gillette Drive and 139.16 feet on the
northern property line as shown on the survey dated last revised March, 15, 2013 prepared by John T. Metzger,
LLS.
BASIS OF APPLICATION: Request for Variance from Article Ill, Section 280-15 and the Building Inspector's
March 7, 2013 Notice of Disapproval based on an application for building permit for construction of accessory in-
ground swimming pool, at: l) accessory in-ground swimming pool is proposed in a location other than the code
required rear yard
RELIEF REQUESTED: The applicant requests a variance to locate an in-ground 16'X32' swimming pool in the
front yard, where the code requires a rear yard location.
ADDITIONAL INFORMATION: During the hearing, the applicant was asked to provide information on any other
variances for accessory swimming pools in front yards in the neighborhood. On May 3, 2013, the agent for the
applicant submitted copies of several ZBA decisions granting a front yard location for accessory swimming pools.
FINDINGS OF FACT/REASONS FOR BOARD ACTION:
The Zoning Board of Appeals held a public hearing on this application on May 2, 2013 at which time written and
oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and

surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant
and makes the following findings:
1. Town Law §267-b(3)(b)(l). Grant of the variance will not produce an undesirable change in the character of
the neighborhood or a detriment to nearby properties. This neighbor consists of a majority of homes situated on
two roads. Several other homes have accessory structures in the front yard. The proposed pool is shown in the
technical rear yard in relation to the configuration of the dwelling. A swimming pool is a customary accessory use
in a residential zone. Existing mature evergreen trees along the northern and eastern property lines screen the pool
from the road and adjoining neighbors
2. Town Law §267-bi3)l'b)~2). The benefit sought by the applicant cannot be achieved by some other method for
the applicant to pursue. The property has two front yards and two side yards but no conforming rear yard.
3. Town Law. 267-b(3)(b)(3) The variance requested herein is mathematically substantial representing 100%
relief from the code. However, the applicant's property is located between two roads and the pool is proposed in
the technical rear yard. The applicant must comply with Chapter 236 of the Town's Storm Water Management
Code.
4. Town Law §267-b(3)(b){4) No specific evidence has been submitted to suggest that a variance requested in this
residential community will not have an adverse impact on the physical or environmental conditions in the
neighborhood. The applicant's property has a line of existing evergreen trees along the northern and eastern
property lines which will screen the pool from the road and adjoining neighbors.
5. Town Law §267-b¢3](b)(5). The difficulty has been self-created. The applicant purchased the parcel after the
Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the
limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase.
6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the
applicant to enjoy the benefit of an in-ground swimming pool while preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community.
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under
New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Weisman
(Chairperson), and duly carried, to
GRANT the variance as applied for_and as shown on the survey dated last revised March, 15, 2013 prepared by
John T. Metzger, LLS. Subject to the following conditions;
CONDITIONS:
1. The existing evergreen screening must remain in place and be continuously maintained to reduce the visual
impact of the pool in the easterly side of the front yard property adjacent to East
Gillette Dr.
2. The pool must have a drywell for &watering and a sound deadening enclosure for the mechanical systems.
That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued.
~tny deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays
and/or a possible denial by the Building Department ora building permit, and may require a new application and
public hearing before the Zoning Board of Appeals.
Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey
cited above, such as alterations, extensions, or demolitions, are not authorized under this application when
involving nonconformities under the zoning code. This action does not authorize or condone any current or future

use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action.
The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does
not increase the degree of nonconformity.

All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supple~nent other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the LWRP policy

SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under
consideration in this application and determines that this review falls under the Type II category of
the State's List of Actions, without an adverse effect on the environment if the project is implemented
as planned.
PROPERTY FACTS/DESCRIPTION: The applicant's 13,532.16 sq. ft. lot has 100 ft. frontage along
Gillette Ddve and along East Gillette Drive, and a depth of 134.05 feet along the nodhedy property
line. The lot is improved with a two-story frame dwelling situated 44.7 feet from the westerly front
line facing Gillette Ddve, and 59.9 feet from the front line along East Gillette Drive.
BASIS OF APPLICATION: Building Department's February lg, 2004, Notice of Disapproval, citing
Code Section 100-33 in its denial of a building permit application concaming a swimming pool
proposed in a front yard location rather than a rear yard.
FINDINGS OF FACT
The Zoning Board of Appeals held a public headng on this application on May 20, 2004, at which
time written and oral evidence were presented. Based upon all testimony, documentation, personal
inspection of the property, and other evidence, the Zoning Board finds the following facts to be true
and relevant:
AREA VARIANCE RELIEF REQUESTED: Applicant wishes to locate a new 18' x 36' in-ground
swimming pool wide 9 ft. wide step area, proposed at least 20 feet from easterly front lot line and at
least 23 feet from the north lot line and at least 20 feet from the south lot line, as shown on the 1-2-
2003 survey sketch prepared by Kenneth M. Woychuk, L.S.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1. Grant of the relief requested will not produce an undesirable change in the character of the
neighborhood or a dethment to nearby properties because swimming pools are a customary use in
this residential zone.

3. The variance granted herein is not substantial. The pool will be located behind the house and will
be at setbacks greater than that required for accessory buildings or structures when located in a
defined rear yard, and additional screening on the street side is a condition of this approval.
4. The d~culty was not self-created.
5, No evidence has been submitted during the hearing or in the wdtten record to suggest that a
vadance in this community of single-family homes will have an adverse impact on the physical or
environmental conditions in the neighborhood.
6. Grant of this relief is the minimum action necessary and adequate to enable the applicant to
enjoy the benefit of a swimming pool, while preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community,
RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing
test under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by
Chairwoman Oliva, and duly carded, to
GRANT the variance as applied for, as shown on the 1-2-03 survey sketch prepared by
Kenneth M. Woychuk, L.S. date stamped by ZBA 3/26/04, with the condition that the
applicant plant and continuously maintain landscape Irees along the east side of the property
line running north and south outside of the safety fence, The landscape must fully shield the
pool from the street at all times.
This action does not authorize or condone any current or future use, setback or other feature of the subject
property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly

side of 179+- feet. The property is improved with an existing two-story and one-

REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and
record 5afore the Board and personal inspection the Board makes the following
findings:
1. Grant of the area variance will produce an undesirable change in character of
neighborhood or a detriment to nearby properties. The front yard location of the

required for accessory structures when located in a "rear yard" area.
2. The benefit sought by the applicant cannot be achieved by some method,

4. There is no evidence that the grant of the variance will have an adverse effect or
impact on the physical or environmental conditions in the neighborhood or district.
As stated in paragraph 1 above, this accessory pool will have no impact on the
continuity of the neighborhood. The property has no technical "rear yard."
RESOLUTiON/ACTION: On motion by Member Orlando, seconded by Chairman

Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of
Planning reply dated May 8, 2007 states that the application is considered a matter for local
determination as there appears to be no significant county-wide or Inter-community impact.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on May 31, 2007, at which time
written and oral evidence were presented. Based upon all testimony, documentation, personal
inspection of the property, and other evidence, the Zoning Board finds the following facts to be true
and relevant:
AREA VARIANCE RELIEF REQUESTED: The applicants propose to locate an accessory above-ground
hot tub enclosed within an open gazebo structure in the front yard facing Cedar Lane, at 14 feet from
the easterly lot line.
REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and
personal inspections, the Board makes the following findings:
1, Grant of the variance will not produce an undesirable change In the character of the neighborhood
or a detriment to nearby properties. There are numerous other accessory in-ground swimming pools
and hot tubs on propertlee In the neighborhood that are also located in front yards, since many lots
are like the applicant's in that they also front on both East Gillette Drive and Cedar Lane. Cedar Lane
Is a small, private subdivision road that has moderate residential traffic. The proposed site is in the

applicant's architectural rear yard behind the dwelling and the gazebo with built-in hot tub is well
screened from adjacent properties by vegetation. The applicant testified at public hearing that
additional evergreen $crsenlng would be planted to create more privacy from Cedar Lane. Other
possible non-confomllng locations on the applicant's property are more conspicuous..
2. The benefit sought by the applicants cannot be achieved by some method, feasible for the applicant
to pursue, other than an area variance because the property consists of two side yards and two front
yards, and there Is no defined rear yard. Any proposed location will be non-conforming.
3.' The variance granted herein is not substantial. The hot tub is the smallest available size and the
gazebo Is only 10' in dIsrnstar and 10.5 feet high, 12.5 feet with the cupola. The proposed side yard

to enjoy the benefit of a gazebo with hot tub, while preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community.
