SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated April 15, 2013 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRiPTION.' Subject property is an improved non-conforming lot located in the R-40 zone district. It has a one story framed dwelling with attached garage, deck and accessory storage building. It has 75.00 feet of frontage on Bayview Avenue, 150.00 feet along the northern property line, 75.00 feet along the eastern property line and 150.00 feet along the southern property line as shown on the survey dated December 5, 2012, revised March 20, 2013 prepared by John T. Metzger LLS, Peconic Surveyors. BASIS OF APPLICATION: Request for Variance from Article XXIII Section 280-124 and the Building Inspector's February 27, 2013 Notice of Disapproval based on an application for building permit for "as built" deck addition to existing single family dwelling: 1) more than the code permitted maximum lot coverage of 20%. RELIEF REQUESTED: The applicant requests a variance to maintain lot coverage of 21.8%, where the code permits a maximum of 20%. All as shown on the Survey of Property prepared by John T. Metzger, L.S., dated December 5, 2012, revised March 20, 2013 (lot coverage). ADDITIONAL INFORMATION: A letter in support of the application was received at the public hearing. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on May 2, 2013 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the properly and Page 2 of 3 - May 16, 2013 ZBA File#6648 - Condos SCTM# 1000-52-5-50 surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b{3)(b){l). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. An attached rear deck is a common characteristic of residential properties and would not pose a detriment to nearby properties at its conforming rear yard setback. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The as-built rear deck exists with its as-built non- conforming area and to maintain the area will require a variance. 3. Town Law §267-b{3)(b}{3}. The variance granted herein is not mathematically substantial, representing 9% relief from the code. 4. Town Law §267-b(3){b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant wishes to retain the as built deck addition which was constructed by the previous owner with a non-conforming area and without the benefit of acquiring a building permit. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of retaining an as-built rear deck which creates 21.8% lot coverage, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member Goehringer, and duly carried, to GRANT, the variance as applied for, and shown on the Survey of Property prepared by John T. Metzger, L.S., dated December 5, 2012, revised March 20, 2013 (lot coverage). Subject to the following condition; CONDITION: 1. The deck shall remain open to the sky. That the above condition be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly' addressed in this action. The Board reserves the right to substitute a similar design that ia' de minimis in nature for an aheration that does not increase the degree of nonconformity. This and surrounding homes pre-date zoning. The lot is only 75 fee in width and 150 feet in length with an existing house, storage shed and existing deck. The house is in contract to be sold to Myrna Schein, however, the existing deck built 20 years ago does not have a permit and when a permit application was filed a variance is required. The buyers wishes to retain the deck because it provides a convenient seasonal outdoor seating area which is elevated to the first floor level of the house. The homes to the south have similar decks or enclosed porches (as seen in the photograph). The house is one story and a very small living area, the deck provides greater living area in the summer, when the house is occupied. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: thelot is pre-existing nonconforming. The lot is only 11,250 square feet in size. The deck conforms to the required side and rear yard setbacks, however, the lot coverage exceeds 20%. The deck could be replaced with an on grade patio, however, the rear door is elevated above grade and going up and down stairs from the kitchen to a patio is not desirable. The homes on Bayview are primarily seasonal homes and the most use of the home and outdoor area is in the summer when the deck is most used. The one story house is very small and has limited living space, the deck enhances the use of the house. (3) The amount of relief requested is not substantial because: The lot is only 11, 250 sq.ft., the deck is 26' x 20' which is large enough for outdoor seating and a grill. The relief requested of 2% is only 225 sq.ft. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The property is developed with a house and one car garage, public water is in the street. The land to the east is being subdivided but the lots are large and the Planning Board has approved a buffer between the proposed lots and the homes on Bayview Avenue.
