Young, L.S., is located landward of the crest of a bank which exceeds ten feet above mean sea level in elevation. This portion of the pazcel, which includes the building envelope and the section of the pazcel landward of the building envelope, is beyond Article 25 (Tidal Wetlands Act) jurisdiction. Therefore, in accordance with the current Tidal Wetlands Land Use Regulations (6NYCRR Part 661), no pernut is required for activities conducted landward of the jurisdictional boundary, which is indicated on the survey by the line labeled "Approximate Top of Bluff'. Please be advised that no construction, sedimentation, or disturbance of any kind may take place seaward of the tidal wetlands jurisdictional boundary, as indicated above, without a permit. It is your responsibility to ensure that all precautions aze taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Article 25 jurisdiction which may result from your project. Such precautions may include maintaining adequate work azea between the tidal wetland jurisdictional boundary and your project (i.e., a 15' to 20' wide construction azea) or erecting a temporary fence, barrier, or hale bay berm. Please note that this letter does not relieve you of the responsibility of obtaining any necessary permits or approvals from other agencies or local municipalities. SincJe(~r~e~lyyt George W. DEC previously made a determination regarding the limits of Tidal Wetlands Act (Article 25) jurisdiction for this property on September 26 2005; a copy of that letter is enclosed. This office does not make repeated jurisdictional determinations for the same site. The limits of Article 25 jurisdiction are indicated in our original No-Jurisdiction letter. Therefore, your client's recent request is being returned to you. No-Jurisdiction letters remain valid indefinitely unless substantial changes in site conditions have occurred. In addition, these determinations are issued for the property and therefore it is not necessary to transfer them to new owners. The original letter for this site should be saved for your client's future reference.
