Deaz Mr. Finnegan:
The property described as Suffolk County Tax Map No. 1000-106-6-2, N/E Mill
Road, Mattituck, New York was declared as no longer being utilized for
municipal purposes and was offered for sale subject to a permissive referendum
by Southold Town Board resolution on January 17, 2012. There were no
petitions filed with the Town Clerk's office seeking a permissive referendum for
the sale of the Mill Road property.

real property described as follows: Suffolk Coun Tax Ma No. 1000-10 =6-2 N/E
Mill Road, Mattituck; and such property was formerly used by the Town r municipal
purposes and the Town has found that said property is not needed for any municipal
purpose or use and it is in the public interest to offer the real property for sale to the
public by sealed bids to the highest bidder. The premise is beine offered for sale
subiect to certain deed restrictions that currently apply to the proaerty.
The bid must be accompanied by aNon-Collusive Bid Certificate, which may be
obtained at the Town Clerk's Office, 53095 Route 25, Southold, New York 11971, 631-
765-1800.
The sealed bid(s) will be received by the Southold Town Clerk, at the Southold Town
Hall, 53095 Route 25, PO Box 1179, Southold, New York 11971, until 12:00 PM,
Thursday, Mav 2, 2013, at which time they will be opened and read aloud in public.

1. That the Owner will keep said premises and bulkhead at all times in good
repair.
2. That the Owner will not allow said premises to be used by any craft other
than private pleasure boats.
3. It is expressly understood and agreed that should that portion of Old Mill
Road running through the property of the party of the first part (George J.
Naugles) ever be abandoned as a public highway, then the right, title and
interest hereby granted to said Owner shall cease and determine and the
title hereby granted shall thereupon revert to the party of the first part, his
heirs or assigns who shall thereupon be entitled to reenter upon said
premises and repossess the same.

This parcel just north of the Old Mill Restaurant on Mattituck Creek was originally
underwater lands belonging to the Town Trustees by virtue of the Andros Patent.
Apparently, on May 8, 1937 the Trustees did release and grant to George J.
Naugles ownership of these undewater lands that adjoined his upland property,
with the stipulation these lands were filled and bulkheaded within two years. On
this same date, George J. Naugles transferred ownership to the Town of
Southold with certain conditions. Strangely, on August 1, 1956 the Board of
Trustees verified that the original grant conditions had been met.
Over time this bulkheaded property has been used by various vessels, both
pleasure and commercial. It was used for quite a few years by the Coast Guard
Auxiliary and was recently used by the Cornell Extension Marine program for a
shellfish grow-out project.
In 2001 a Mattituck Creek Watershed Analysis was conducted by EAA in
conjunction with USDA Natural Resources Conservation and Suffolk County Soil
and Water Conservation District. Ten sites were identified for run-off projects to
improve water quality.
This parcel is located in sub-watershed area #7 and was part of a recommended
run-off project. Several Treatment strategies were suggested and it was also
noted that the bulkhead appeared to be threatened by uncontrolled storm water
which had washed out soil behind the bulkhead.
Trustee James King has collected water samples for NYSDEC on behalf of the
Town for 16 years at 15 stations in Mattituck Creek. During this time period five
run-off projects have been completed. As a result, Mattituck Creek which was
completely closed to shellfishing now has seasonal and conditional shellfish
harvesting areas because of water quality improvement. Additional run-off
projects that further improve water quality would result in even more areas
certified for shellfish harvesting, greatly enhancing public, recreational and
commercial uses of these waters.
If the above mentioned property is indeed sold, the Board of Trustees strongly
urges you to place the proceeds of sale into a dedicated fund for another storm
water run-off project in Mattituck Creek.

~ The resolution states "town of Southold is the owner in fee of certain real property
described as follows: Suffolk County Tax Map No. 1000-106-6-2, N/E Mill Road,
Mattituck; and such property was formerly used by the Town for municipal purposes and
is presently not being utilized by the "town for any purpose. The Town has found that
said property is not needed for any municipal purpose or use and it is in the public
interest that said parcel be put to its highest and best use. The Town desires to fulfill this
goal by offering the premises for sale to the public by sealed bids to the highest bidder.
The said premises will be offered for sale subject to certain deed restrictions that
~ presently apply to the property.
The declaration of the property as surplus and offerin¢ it for sale and authorizing and
directing Supervisor Scott A. Russell to execute all the necessary notices and papers
declaring said premises as surplus property is subject to permissive referendum under the
procedure set forth in Article 7 of the Town Law of the State of New York.

THIS IS TO CERTIFY THAT THE. FOLLOWING RESOLUTION NO. 2012-87 WAS
ADOPTED AT THE REGULAR MEETING OF THE SOUTHOLD TOWN BOARD ON
JANUARY 17, 2012:
RESOLVED that the Town Board of the Town of Southold hereby amends Resolution No.
2011-694 adopted October 11, 2011 to read as follows:
WHEREAS, the'fown of Southold is the owner in fee of certain real property described as
lollows: SufY'olk County 7~ax Map No. 1000-106-6-2, N/G Mill Road, Mattituck; and
WHEREAS, such property was formerly used by the "Down for municipal purposes and is
presently not being utilized by the Town for any purpose; and
WHEREAS, the Town has found that said property is not needed for any municipal purpose or
use: and
WHERF,AS, it is in the public interest that said parcel be put to its highest and best use; and
WHEREAS, the Down desires to fulfill this goal by offering the premises for sale to the public
by sealed bids to the highest bidder: and
WHEREAS, the said premises will be otTered for sale subject to certain deed restrictions that
presently apply to the property.
NOW, THEREFORE., BE IT
RESOLVED that said premises is hereby declared to be "surplus"; and be it further
RESOLVED that said premises may therefore be offered for public sale; and be it further
RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs
Supervisor Scott A. Russell to execute all the necessary notices and papers declarine said
premises as surnlus property; and be it further

KESOLVEll that pursuant to the provisions of X64(2) of the Town Law, this conveyance is
subject to permissive referendum under the procedure set forth in Article 7 of the Town Law of
the State of New York; and be it further

RESOLVED that within ten (10) days after the adoption of this resolution by the Town Board
the Town Clerk in the same manner as for a notice of a special election shall post and publish a
notice setting forth the date of the adoption of this resolution and containing an abstract of this
resolution concisely stating its purpose and effect The notice shall specify that such resolution
was adopted subject to permissive referendum; and be it further
1ESOLVED that in the event that no petition seeking a permissive referendum is tiled with the
Town Clerk within thirty (30) days in accordance with the provisions of Article 7 of the Town
Law, this resolution shall be in full force and effect and the Supervisor is authorized to execute
any and all documents to effectuate the sale thereof and the conveyance shall be thereafrer
recorded in the Office of the Clerk of the County of Suffolk and shall be bindine on the parties
thereto.

premises as surplus property; and be it further
RESOLVED that the sale shall be subject to a permissive referendum and in compliance with
any and all SEQRA and other regulatory requirements.
