Project Description: To cut down one tree; four (4) tree stumps to be cut to
ground; all area from house to berm to be covered with mulch/wood chips; install
a post and rail fence on seaward side of berm, and area beyond the berm is to
remain naturally vegetated.
Findings: The project meets all the requirements for issuance of an
Administrative Permit set forth in Chapter 275 of the Southoid Town Code. The
issuance of an Administrative Permit allows for the operations as indicated on the
project plan prepared by DKS Ltd. Partnership C/O Susan Aiello, received on
September 13, 2012, and stamped approved on October 17, 2012.
Special Conditions: None
Inspections: Final Inspection.
If the proposed activities do not meet the requirements for issuance of an
Administrative Permit set forth in Chapter 275 of the $outhold Town Code, a
Wetland Permit will be required.
This is not a determination from any other agency.

Dear Mr. Jim King and Board:
I had been down to the Trustee Office today to fmd out what the findings of the Board
were in regard to the clearing of additional property within the Wetlands in back of the
above residence.
Please note, in the past, the builder John Hurtato had a falsified survey or a survey
done in error where the Wetlands were improperly marked. This was brought up to the
Trustees,including Mr. Al Krupski at the time of the house building. The Trustees were
there on site to check Wetland hay bales which were moved into Wetlands to
accommodate the unapproved changes to the rear of the dwelling that had been made.
The original house plans were approved on a falsified Survey. The True Wetlands
markers are located exactly on the berm, and not where he had them located on their
survey. The correct place for the markers and berm are 20 feet behind the house. The
staircase and 4feet of the deck behind the house is already only 16 feet to the correct
Wetland Markers. The Trustees reviewed the markers and the unapproved changes, and
decided my findings were indeed correct. Mr. Hurtato agreed to put a line of bushas
along the correct wetland line and to date this was never done. The deck was already
built but the stairs and extra 4fi of deck were added later. This would put the structure
only 16feet from the correct Wetlands as stated above and not the approved 20 feet.
In fact the present owners were found taking down trees which the Town Trustees did not
approve in the past. They told the Code Enforcer that the trees were dead. The trees
were indeed not dead,nor too close to the home. In fact at that same time they had their
landscaper remove Wetland greens and shrubs.
What remains clear is that they were informed before the fact that removing greenery
within Wetland Limits was not acceptable without Trustee approval. This is the second
time and now they took trees, shrubs and greenery clearly behind the Wetland markers to
clear the land. They have had their house for sale for a while and they bought the house
knowing their limits. The problems created with Mr. Hurtato's building of 3 houses side
by side, always reducing the distance to the Wetlands has created a disaster with the
water in a wet season. Mr Aiello is quite aware of all of this. He is moving, he does not
care.
We agree with the Trustees in putting wood chips behind the house to the berm and to
install a fence, although we feel that the original line of bushes would make it less likely
for someone buying the house to arbitrarily move the fence to beyond the burro. Also,
even though they will be given permission to remove the one damaged tree, we ask that
you emphasize that they do not remove any further brush and greenery beyond the burm,
as they have already destroyed years of Wetland growth.

Wetlands.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed as built
is INCONSISTENT with LWRP Policy 6.3 (below) and therefore, INCONSISTENT with the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees
laws and regulations for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit
conditions.
The trees were removed without the benefit of Board of Trustee review.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
