1. That the said Board of Trustees a. nd the Town of Southold are released from any and
all damages, or claims for damages, of suits arising dixeetly or indit~o~y as a result of any oper-
ation performed pursuant to this permit, and the said Permi~tee will, at his or her own ~,
defend any and ail such suits initiated by thixd parties, and the said Permittee assumes full liability

work shall cause unreasonable obstrucnon to free navigation, the said Permlrtee will be

The following action was taken by the Board of Town Trustees during
its regular meeting held on August 1, 1991 regarding the above
matter:
WHEREAS, VINCENT J. PETROZZO applied to the Southold Town Trustees
for a permit under the provisions of the Wetland Ordinance of the
Town of Southold, application dated July 8, 1991 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on August 1, 1991 at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED THAT VINCE/gT PETROZZO BE AND HEREBY IS GRANTED PEi~4ISSION
UNDER THE WETLAND ORDINANCE TO: construct a deck 10'4" across
extending outward from bath house and 30' across. Located at Nassau
Point Road, Nassau Point.
This permit wili expire two years from the date it is signed. Fees
must be paid, if applicable, and permit issued within six months
of the date oX'this notification. Two inspections are required and
the Trustees are to be notified upon completion of said project.
Please return to the Building Department for a determination on the
need for any other permits which may be required for this project.
Permit will be issued upon payment of the following fees for work to
be done below Mean High Water Mark:

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed actions
are INCONSISTENT with LWRP Policy 6.3 (below) and therefore, INCONSISTENT with the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
Comply with Trustee regulations and recommendations as set forth in Trustee
permit conditions.
The structures described were not constructed pursuant to a Chapter 275 Wetlands and
Shorelines permit. Although a deck was permitted, the proposed deck does not conform
to the permit.

proposed actions that are subject to the Town of Southotd Waterfront Consistency Review Law. This
