RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Wetland Permit#8058 to reconstruct a 10.2'±L x 24.5'±W (200sq.ft.) deck between the
bulkhead and bluff staircase; and as depicted on the revised site plan prepared by
Suffolk Environmental Consulting, Inc., received on February 27, 2013 and stamped
approved on April 17, 2013.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

AUTHORIZATION
Pursuant to the provisions of Chapter 275 of the Town Code of the Town of Southold and in
accordance with the Resolution of the Board of Trustees adopted at the meeting held on February 20,2013,and `
in consideration of application fee in the sum of$250.00 paid by Suffolk Environmental Consulting Inc. and
subject to the Terms and Conditions as stated in the Resolution, the Southold Town Board of Trustees
authorizes and permits the following:
Wetland Permit to repair the existing bluff staircase that was damaged by
Hurricane Sandy; to construct a 5 foot high retaining wall, roughly 16 feet landward of
the existing bulkhead; and reconstruct damaged bluff stairs; construct a 6'x4' wooden
platform on top and seaward of the existing bulkhead which will allow for the
installation of 2' wide retractable aluminum beach access stairs; in total there will be
115' f of new retaining wall; after construction of the retaining wall and stairs has
finished, roughly 100 cubic yards of fill will be deposited behind the retaining wall and
in the space between the retaining wall and existing bulkhead; and as depicted on the
site plan prepared by Suffolk Environmental Consulting, Inc., received on January 30,
2013 and stamped approved on February 20, 2013.
IN WITNESS WHEREOF,the said Board of Trustees hereby causes its Corporate Seal to be affixed,

TERMS AND CONDITIONS
The Permittee Barbara Kelsey,residing at 4000 Great Peconic Bay Blvd., Laurel,New York as
part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permttee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Pennit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in
the location of the work herein authorized, or it, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the'rown of Southold.
8. That the said Board will be notified by the Pennittee of the completion of the work
authorized.
9. That the Pennittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Mr. Laird:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, February 20, 2013 regarding the above matter:
WHEREAS, Suffolk Environmental Consulting, Inc. on behalf of BARBARA KELSEY
applied to the Southold Town Trustees for a permit under the provisions of Chapter 275
of the Southold Town Code, the Wetland Ordinance of the Town of Southold,
application dated January 30, 2013, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be
found Consistent with the Local Waterfront Revitalization Program policy standards,
and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on February 20, 2013, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,

WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees have found the application to be Consistent
with the Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of BARBARA KELSEY
to repair the existing bluff staircase that was damaged by Hurricane Sandy; to construct

As you may remember, this matter was heard before your Board on February 20, 2013 for
approval to repair the existing bluff staircase (storm-damaged) and construct a retaining wall,
wooden platform and retractable aluminum access stairs thereon. As you may also remember,
we had mentioned that we wish to include for the reconstruction of the storm-damaged
bulkhead Decking as part of the Board's determination. However, your Board requested that
we instead amend the pending wetlands permit to clarify for the inclusion of the decking.
Consequently, attached please find:
(1) Project Plans, prepared by Suffolk Enwronmental Consulting; Inc., last dated January
Is, 2013, indicating for the inclusion of the decking(three [3] sets); and
(2) Check made payable to the Town of Southold in the amount of$ 50.00 to cover the
requisite application fee.
By way of this correspondence, kindly include this item onto the March, 2013 agenda for permit

Applicant had obtained approval from the Board of Trustees on February 20,
2013 for approval to repair the existing bluff staircase (storm-damaged) and
construct a retaining wall, wooden platform and retractable aluminum access
stairs thereon.
In the interim, the property owner wishes to reconstruct/re-configure the
original Decking located between the bulkhead and bluff staircase which was
destroyed during Hurricane Sandy on October 29, 2013.
The proposed Decking will be constructed on top of grade, and measure 10.2' L t

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C,the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area(which includes all of Southold Town).
3. If any question in Section C on this form is answered"yes", then the proposed action may affect the
achievement of the LWRP policy standards and conditions contained in the consistency review law.
Thus, the action should be analyzed in more detail and, if necessary, modified prior to making a
determination that it is consistent to the maximum extent practicable with the LWRP policy
standards and conditions. If an action cannot be certified as consistent with the LWRP policy
standards and conditions, it shall not be undertaken.

Suffolk Environmental Consulting, Inc. on behalf of BARBARA KELSEY requests a Wetland Permit to
repair the existing bluff staircase that was damaged by Hurricane Sandy; to construct a 5 foot high
retaining wall, roughly 16 feet landward of the existing bulkhead; and reconstruct damaged bluff stairs;
construct a 6'x4' wooden platform on top and seaward of the existing bulkhead which will allow for the
installation of 2' wide retractable aluminum beach access stairs; in total there will be 115' t of new
retaining wall; after construction of the retaining wall and stairs has finished, roughly 100 cubic yards of
fill will be deposited behind the retaining wall and in the space between the retaining wall and existing
bulkhead. Located: 4000 Great Peconic Bay Boulevard, Laurel. SCTM# 128-6-2
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed actions
are CONSISTENT with the Policy Standards and therefore CONSISTENT with the LWRP.
The Board issued a grandfathered permit (128-6-2) for the staircase and bulkhead in 1993.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

Hurricane Sandy caused significant damage to the existing bluff stairs on
the property. More than damaging the bulkhead, the storm damaged the
Integrity of the bluff, which is located less than 20'from the existing
house at its closest point. In order to maintain stability for the house in
the coming years,the applicant has proposed the reconstruction of the
existing bulkhead, the construction of a retaining wall landward of the
existing bulkhead, and the modification and reconstruction of existing
beach access stairs in order to maintain use of the adjacent Great
Peconic Bay.
No environmental impact is anticipated from the proposed structure as
much of the vegetation on the bluff was killed by Hurricane Sandy.
Furthermore any construction taking place on the site will be govemed
by Best Maintenance Practices in order to reduce the temporary
environmental impact as much as possible. V
