A meeting of the Southoid Town Conservation Advisory Council was held Wed., April 10, 2013 at
Down's Farm Preserve.

CALL TO ORDER
The meeting was called to order at 4:30 PM by Chairperson Peter Young.
APPROVAL OF MINUTES
Moved by Jack McGreevy and seconded by Audrey Horton, to Approve the Minutes of March 13,
2013.
REPORTS
Jack McGreevy attended the regular meeting of the Board of Trustees held on March 20th. Jack
shared with the Trustees various concerns the CAC had with storm-related reconstruction. The
Board indicated that they would be addressing issues such as the need to certify clean fill,
consideration of detached/removable stairs, and the concern with inadequate septic systems in
areas such as Rabbit Lane, East Marion.

DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION
PERMIT APPLICATIONS
Moved by Doug Hardy, seconded by Derek Bossen, it was
RESOLVED to SUPPORT the application of PETER & MARISA PATINELLA to raise house 3.5';
remove existing structural supports and replace with new concrete piers and girders for house,
deck and porch; mechanical room on grade to be rebuilt and elevated to be flush with house.

The CAC Supports the application, however, questions the adequacy of the sanitary system.

RESOLVED to SUPPORT the application of RUTH ANN BRAMSON SPOUSAL LIMITED
ACCESS TRUST to construct 142' of new retaining wall with 10' return at northeast end; fill void
area with clean trucked-in fill approx. 275 cy.; regrade area and revegetate with native plantings to
match existing; existing wood platform and stairs southwest end to be modified as needed to
accommodate new retaining wall.

The CAC Supports the application, however, recommends the Trustees identify the exposed
pipes. It's the CAC's position that it is bad management practice to have bulkheads that are
perpendicular to the littoral transport system.

RESOLVED to SUPPORT the application of BRAMSON FAMILY FIELD, LLC to construct 112' of
new retaining wall; fill void area landward with clean trucked-in fill, approx. 275 cy.; and regrade
area and revegetate with native plantings to match existing.

RESOLVED to SUPPORT the application of LUCIA & JOHN SlCA to remove and replace 89 if. of
storm damaged bulkhead of new vinyl bulkhead in same locations as existing; provide 60 cy. of
clean sand behind bulkhead to replace lost fill during storm; raise bulkhead elevation approx. 1' to
match neighboring bulkheads.

RESOLVED to SUPPORT the application of THOMAS J. APREA, JR. to maintenance dredge an
area 50'X 50' in existing boat basin to elevation -5' below mean Iow water removing 125 cy. of
spoil; dredge spoil to be placed as beach nourishment landward of mean high water; supplement
dredged spoil with an additional 200 cy. of clean trucked in sand.

The CAC Supports the application, however, there is a concern about the condition of the clean
fill.

RESOLVED to SUPPORT the application of NAOMI MULLMAN to replace the deteriorating
foundation of an existing seasonal cottage; raise the elevation 2'; reconstruct in-place existing
7.5'X 14.5' waterside room; reconstruct existing 5.5' X 6' bathroom and construct a 3.5'X 5.5'
bathroom addition; reconstruct in-place existing 6'X 6.5' entry deck and construct steps thereto;
construct a fenced outdoor shower; remove existing crawl space access; replace roof with new
roof 1' higher with same pitch and add 5.5' X 7' eyelid dormer; and install two drywells as part of a
drainage system of leaders, gutters and drywells.

RESOLVED to SUPPORT the application of MAUREEN MASSA & ALAN SCHWEITZER to
remove the proposed dock and construct 4'X 38' steps and a 10'X 10' platform at top of stairs.

relocated to save the tree. There is also a concern with an exposed tank along the southeast
corner of the property.

damaged by storm using a wire grid structure filled with sand and planted with beach grass.

together with required subsurface drainage structures.

The CAC does Not Support the application because the project was not staked. The bank is
seriously eroded and should be stabilized and there is a 6" pipe coming out of the bank.

RESOLVED to SUPPORT the application of LINDA SANFORD TRUST to construct approx. 168
If. of vinyl bulkhead in place of and 6" higher than existing storm damaged timber bulkhead;
backfill and renourish storm eroded embankment with approx. 150 cy. of clean sand/loam fill to be
trucked in from an approved upland source and replanted with native vegetation; and construct 4'X
8' steps to beach.

The CAC Supports the application, however, the upper deck is unsafe and should be moved back
to the edge of the bluff with the seaward edge of the deck in line with the top of bluff.

RESOLVED to SUPPORT the application of SEAN FAHEY to construct approx. 128 If. of vinyl
bulkhead in place of and 12" higher than existing storm damaged timber bulkhead; construct 14'
vinyl return in place of and 12" higher than existing easterly return and construct 27' vinyl return
inside westerly property line in place of existing return; backfill/renourish storm eroded area
landward of bulkhead with approx. 300 cy. of clean sandy fill to be trucked in from an approved
upland source; remove and replace storm damaged 4;X 5' platform and 3'X 6' steps to beach; and
repair as needed existing (3) wood tie retaining walls 7'X 20' steps 7'X 14' deck and 6'X 9' steps
landward of bulkhead.

RESOLVED to SUPPORT the application of PETER COSOLA to replace 100' of bulkhead with
new vinyl bulkhead, 20' returns and 10' splash pad landward of bulkhead; retain existing upper
deck; replace stairs to beach, as needed; retain lower deck and non-turf area behind bulkhead;
and re-vegetate and restore bank behind existing wood retaining wall.

STEPHEN DiMEGLIO to construct new 100' retaining wall 4' high aluminum fence, 40'X 20'
swimming pool and 1600 sf. paver patio.

property would however, benefit from the installation of a 10' non-turf buffer.

RESOLVED to SUPPORT the application of ELISSA JO KAPLAN to reconstruct in place the
existing bulkhead on the property; re-establish the grade landward of the bulkhead as it existed
prior to the damage; consequently 150 cy. of clean sand fill would be deposited landward of the
reconstructed bulkhead; the reconstructed bulkhead with rise 6'6" above the seaward grade of the
shoreline and would run 118' along the eastern edge of the property. A 10' return would be
constructed on both the northern and southern end of the reconstructed bulkhead.

bulkhead is indicated on the plan and the bulkhead should be constructed no higher than the
adjacent bulkhead.

RESOVLED to NOT SUPPORT the application of ALAN A. CARDINALE for the existing upper
wood retaining wall, repaired inkind/inplace; middle retaining wall repaired inkind/inplace; remove
4' bulkhead and returns 100' plus returns; remove lower retaining wall 100' plus returns; install
100' of vinyl bulkhead with 16' sloped returns in line with upper retaining wall; install 4' staircase
and platform to beach; and install 200 cy. of fill.

The CAC does Not Support the application because the site plan is inaccurate. A second set of
steps should not be constructed on the slope, the elevation of the bulkhead was not provided and
the bulkhead should align with the bulkhead on Lot 24 to avoid an acute angle.

RESOLVED to NOT SUPPORT the application of ALAN A. CARDINALE for the existing
swimming pool, pool house, pool fencing, slate patio and walk/stairs, rock wall, arbor, gazebo,
wood deck, upper retaining wall, middle wood retaining wall and staircase to beach; remove 4'
bulkhead and returns 100' plus returns; remove lower retaining wall 100' plus returns; remove
deck/gazebo/landing and stairs; install 100' vinyl bulkhead with 16' sloped returns inline with upper
wall; relocate and install existing deck and gazebo; install 4' staircase and landing from arbor to
deck; install 4' staircase and platform to beach; and install 200 cy. of fill.

DISCUSSION AND RECOMMENDATION OF APPLICATIONS TO AMEND WETLAND &
COASTAL EROSION PERMITS
PHYLLIS SOUSA to Amend Wetland Permit #7928 to allow for a 6' extension to the permitted
fixed dock to correspond to the dock structure permitted by the NYSDEC.
Located: 1695 Mill Creek Dr., Southold. SCTM#51-6-32
The project was not staked, therefore no recommendation was made.
MATTHEW D. VOLPE to Amend Wetland Permit #8071 to include a 6'X 55' vinyl retaining wall set
8' landward of proposed vinyl bulkhead.
Located: 1700 Oak Dr., Southold. SCTM#80-5-1.1
The CAC did not make an inspection, therefore no recommendation was made.

RESOLVED to SUPPORT the application of BARBARA KELSEY to Amend Wetland Permit
#8058 to include three (3) sets of decking.

There being no further business to come before the Council, the meeting was adjourned at 7:30
