THIS INDENTURE, made the /~'~)'~day of February, two thousand and thirteen,
BETWEEN H. CHRISTOPHER LUCE and MINER H. WARNER, as Executors of the last will
and testament of Henry Luce III and as Trustees of the Trust under Article FIRST of said will,
late of New York, New York, who died on the 8th day of September, 2005, having an address at
c/o Carter Ledyard & Milbum LLP, 2 Wall Street, New York, New York 10005, Grantor, and
AUSTIN MCPHAIL, with an address at 1183 Montauk Avenue, Fishers Island, New York
06390, Grantee,
WITNESSETH, that the Grantor, to whom letters testamentary were issued by the
Surrogate's Court, New York County, New York on September 30, 2005, and by virtue of the
power and authority given in and by said last will and testament, and/or by Article 11 of the
Estates, Powers and Trusts Law, in consideration of SIXTY FOUR THOUSAND ONE
HUNDRED N1NETY SIX AND 96/100 DOLLARS ($64,196.96) paid by the Grantee, does
hereby grant and release unto the Grantee, the distributees or successors and assigns of the
Grantee forever,
ALL that certain plot, piece or parcel of land, situate, lying and being at Fishers Island,
'Town of Southold, County of Suffolk and State of New York, more particularly described in
SCHEDULE A attached hereto.
SAID PREMISES are known by the street address of 1183 Montauk Avenue, Fishers
Island, New York, and designated as Section 010.00, Block 08.00, Lot 001.002.
BEING the same premises conveyed to the decedent referred to herein by deed made by
Lisa A. Reale, a/k/a Lisa Reale, f/k/a Lisa Oliveri, dated September 11, 2001 and recorded
September 27, 2001 in Liber 12144 Page 170.
TOGETHER with all right, title and interest, if any, of the Grantor in and to any streets
and roads abutting the above described premises to the center lines thereof.
TOGETHER with the appurtenances and all the estate which the said decedent had at
the time of decedent's death in said premises, and also the estate therein, which Grantor has or
has power to convey or dispose of, whether individually, or by virtue of said wilt or otherwise.
TO HAVE AND TO HOLD the premises herein granted unto the Grantee, the
distributees-or successors and assigns of the Grantee forever.

County of Suffolk, and State of New York, being more particularly bounded and described as follows:
BEGINNING at a point on the southwesterly line of Montauk Avenue, said point being 1944.80 feet North
mad 915.58 West ora monument marking the U.S. Coast and Geodetic Survey Triangulation Station "PROS";
and
RUNNING THENCE South 59 degrees 06 minutes 30 seconds West, 51.78 feet;
THENCE North 54 degrees 59 minutes 30 seconds West, 40.37 feet;
THENCE North 12 degrees 24 minutes 20 seconds East, 62.28 feet;
THENCE North 56 degrees 57 minutes 30 seconds East, 29.60 feet to the southwesterly line of Montauk
Avenue;
THENCE along said southwesterly line of Montauk Avenue, South 28 degrees 07 minutes 30 seconds East,
83.39 feet to the point or place of BEGINNING.
AND the Grantor covenants that the Grantor has not done or suffered anything whereby
the said premises have been encumbered in any way whatever, except as aforesaid.
AND the Grantor, in compliance with Section 13 of the Lien Law, covenants that the
Grantor will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the
improvement and will apply the same first to the payment of the cost of the improvement before
using any part of the total of the same for any other purpose.
The words "Grantor" and "Grantee" as used herein shall be construed to read in the plural
whenever the sense of this deed so requires.
