W YORK STATE DEPARTMENNSTATE CO OF� AL ZONE CONSISTENCY REVEWWORKSHEET NARRATIVE STATEMENT AUGUST, 2011 DOCK FACILITY MODIFICATIONS & DRED E I V OPEN WATER DISPOSAL OF DREDGED MATE AT NLDS GENERAL IN LONG ISLAND SOUND JAN 29 2013 The objective of this application is to obtain authorization to dre ge e future docks and to take sequentially dredged sediments from the dock facility area in West Harbor for disposal at the New London Open Water Disposal Site in Long Island Sound (NLDS). This disposal area is in open water; the project requires a waterfront site. This narrative statement addresses the consistency of the proposed work in terms of the nature of the dredging project and the suitability of the NLDS for disposal. Permits for this project are being applied for by the Fishers Island Yacht Marina which manages the marina dock facility operation for the community as a non-profit organization. The NYS DEC has issued their permit, No. 1-4738-01110/00009 for this work, a copy of which is attached. The operation is located in a marine commercial zone as designated by the Town of Son old and is operated in conformance with Town zoning regulations and has done so for decades. Parking available is adequate for the dock facility. Zoning for the Town of Southold is consistent with statutory requirements set forth by the State of New York and is consistent with the Coastal Zone Management Program. The Town Trustees have adopted a Local Waterfront Revitalization Program, LWRP, for the Town. They have reviewed the development plan for the Fishers Island Yacht Club and found it to be consistent with the LWRP. This cove in West Harbor is relatively small but it represents the only area where a community dock facility can be located. Vessels are otherwise constrained by the mooring field on the east, a common travel -way with a dozen other residents of the cove immediately to the south. The cove is also host to Fishers Island Utilities as well and the Mobil fuel dock to the north. There is residential development with docking facilities north of this complex and north of the community beach which limits any further expansion in that direction. Thus, the only viable opportunity to meet current and forecast demands for boating is at this site in the in the cove. The dock system is laid out a as to provide for these slips without cutting off littoral development rights or boating access rights for the remaining residents which share the cove, and without cutting off access to the mooring field or impinging on the channel travelway. This has led to the configuration of the futurre dock facilities shown in the application drawings and the need for dredging in the precise area stipulated. Dredging is desperately needed in order to safely accommodate boats at the dock facilities in West Harbor on Fishers Island. The boats include the sole island sea ambulance, the "MV Sea Stretcher" that transports ill or injured island residents to the mainland. The dock facility is located on the southwesterly quadrant of West Harbor. The small cove is shallow and must be dredged in order to accommodate the existing fleet of boats owned by island residents plus visitors and the "Sea Stretcher". The target dredge depth has been determined based on the essentiality of access for existing boats. Vessels operating at this site are having trouble reaching their slips at this point and therefore, the dredge project must accommodate all vessels. Because of the size of the cove and the shallow waters all around, dredging contractors will have to use a small scow for this operation. I COASTAL ZONE MANAGEMENT CONSIDERATION: The dock facility is located in New York waters and is subject to the terms and conditions of the Coastal Zone Management Program for the State of New York, the site aptly fits the characterizations of the program and operates in conformance with these policies. This part of West Harbor would be characterized as Working Coast areas and would fit the definition of a Maritime Center with a long history of maritime activities and community involvement as documented in the book "Sailing at Fishers" by John Rousmaniere, published in 2004. Dredging is a part of maritime center activities as necessitated to support recreational boating and boat docking facilities for the seasonal as well as the year-round population. The dock facility and operation are an integral part of the Fishers Island infrastructure. West Harbor is not only the home port for several vessels, it is also one of the high priority destinations for coastal sailing and cruising, hosting two construction companies, a shellfish aquaculture operation, two lobstermen, a full-service marina, the fuel dock, Fishers Island Utilities, the Mobil fuel dock, the Fishers Island Marina and local resident mooring field and 100 or so waterfront sites with seawalls, revetments, beaches and private dock facilities. This is an island community and the dock facilities managed by the Fishers Island Marina are vital infrastructure. Everything that comes to Fishers Island comes by boat and much of that provisioning and essential access is through this facility. The area would certainly qualify as a Marine Center as well as Working Coast criteria set forth in the Coastal Management Program. It is also an area where concentrated development exists and should continue to exist because of these home porting and destination factors. The complex is vital to the island's economy, logistical support and emergency response capability to keep the dock facilities open and unconstrained so that they are immediately usable, regardless of weather or tide, when they are needed. Because of its unique protected location, many of the users do not live locally, drive a considerable distance to be based in this area and at this facility. Past investments by the Federal Government (the dredged channel), the State, the local utility and development company and special ventures such as the Yacht Club and Fishers Island Utility have been successful in spurring private sector redevelopment of the area. Maintenance and improvement of this specific facility is justified to meet community and regional emergency response needs, including the sea ambulance boat, and for island evacuation, should this become necessary, as well as for recreational boating access, home -port activities and essential transportation. The New York Coastal Management Program focuses extensively on the value of Maritime Centers and Working Coast areas and this project is consistent with the philosophies and the intentions of supporting maritime centers and working coast waters of the State. The justification for the dock facilities and dredging is extensive and warrants special consideration for open water disposal at NLDS under the NYS Coastal Management Program (CMP). There are other considerations in the New York Coastal Management Program that also come to bear on this project. The Working Coast policies as well as the policies of the Maritime Center sub -group consistently reflect the need to focus development in areas that are already developed. The dredging is in support of an existing dock facility properly located in a long-standing marine commercial zone and operating for decades in accordance with Town land use plans and regulations. The dock facility modifications are intended to improve the operational efficiency and viability of the dock facility. The proposed dredging is essential in order to maintain current capacity and efficiency and to bring about operational improvements. 2 Dredging is allowte under Coastal Management ProAlicies. The policies recommend against numerous, frequent or successive small projects and instead focus on complete, comprehensive larger projects that will make significant improvements and minimize disruptions to water quality both at the work site and at the disposal site for dredged materials. This project is consistent with this policy. The issue is not the dredging but the disposal of the dredged sediments. Dredging is needed because the waterborne sediments have accumulated faster than sea level rise creating diminishing water depths. Bottom sediment gouging and re -suspension is common during low tide operations creating wear and tear on the boats and constraining access to narrow travelways which limit operations. This project has been presented to the Community and has received support of the community and various civic organizations and copies of these letters are on record. Open -water and upland disposal options have been considered for this project. Open -water disposal has five possible options listed below; alternatives to open -water disposal are subsequently addressed. Ooen Water Disposal of Dredged Sediments at New London NLDS: Open Water Disposal Considerations The US Army Corps of Engineers has conducted extensive research on the suitability of the New London Open Water Disposal Site for continued placement of dredged spoil. These include the following: • Monitoring at the New London Disposal Site 1992-1998, Volume I, dated January 2001, SAIC Report No. 515 • Observations of Physical Oceanographic Conditions at the New London Disposal Site 1997-1998, dated October 2001, SIAC Report No. 453 • Monitoring Cruise at the New London Disposal Site August 2000, dated December 2001, SAIC Report No. 512 • Monitoring at the New London Disposal Site 1992-1998, Volume II, Seawolf Mound, dated December 2001, SAIC Report No. 525 • Post -Storm Monitoring Survey at the New London Disposal Site Seawolf Mound October 2002, dated December 2003, SAIC Report No. 632 • Monitoring Survey at the New London Disposal Site June 2001, dated March 2004, SAIC Report No. 578 Their most recent publishing of summary data was in. the "Memorandum For the Record" dated April 15, 2005 of the first CAD cell project for the United States Naval Submarine Base. The following excerpts from that report are contained and referenced herein as follows: The New London Disposal Site (NLDS) is selected as the disposal site for disposal of dredged materials, NLDS is just over a mile square, 3.4 km2 (1.85 km by 1.85 km), with center at 41°16.3' N, 72°04.6' W (NAD 83), and sides running true north -south, east - west. From the center, Bartlett Reef Lighted Horn bears true 276 degrees at 5,600 yards and Black Ledge Lighted Buoy N "2" bears true 13 degrees at 4,000 yards. NLDS is in a depositional area with a gradually sloping bottom ranging from a depth of 14 m mean low water in the north to 24 m in the south. The management approach at NLDS has been to place mounds in rings to create bowl -shaped structures to confine future projects and to preserve site capacity. The site is primarily in CogWticut waters, however, the Connecticut-Ne*rk state boundary crosses through flWtheastern third of NLDS. • NLDS is host to such species as tautog, flounder, bluefish, weakfish, oysters and lobster. Although these resources cannot be avoided, interference will be minimized through application of seasonal restrictions on the disposal of dredged materials when fishing and spawning activities are highest and through other permit conditions and management practices at the disposal site that minimize impact on these resources. To minimize potential impacts to these resources, dredging and disposal operations are suspended from June through September. • A 300 in wide submarine transit corridor runs through NLDS to facilitate the navigation of commercial and military traffic. The movement of deep draft naval vessels in and out of the Thames River requires that disposal operations be closely monitored and controlled to maintain a minimum depth of approximately 14m. In 1996, 2,049 thousand short tons of traffic were recorded in New London Harbor, 633 thousand short tons of which were attributed to petroleum and petroleum products. Seventy-seven thousand short tons of traffic were for crude materials. Traffic since then has increased and come to include cruise ships. Along the Thames River, which empties into New London Harbor, 1,414 thousand short tons of traffic were recorded (USACE, US Waterborne Commerce Statistics, 1996). The minimum depth of 14m provides adequate room for navigation. In addition, transportation to and disposal at NLDS can be tuned to minimize interference with commercial navigation. • Because NLDS is located within commercial shipping lanes, it is not conducive to trawling activities. Lobstering does not generally occur at NLDS, but rather in shallow rocky areas to the north of the site in the spring and in deeper water due east and south of the site in mid -summer. Therefore, disposal activities do directly interfere with these activities. Other recreational activity includes sailing and power -boating. NLDS is closely monitored and controlled to maintain a depth of at least 14 in, a depth adequate for avoiding conflicts with recreational vessels. Skippers, pilots and operators of recreational vessels who follow good nautical procedures use current National Ocean Survey nautical charts to avoid the possibility of damaging their vessels. Sport fishing for finfish occurs in the southwest comer and to the northeast of NLDS. In addition, Bluff Point Coastal Reserve, Ocean Beach State Park and Harkness Memorial State Park are located near the mouth of the Thames River (approximately 5 km), north of NLDS and there are thousands of recreational boating operations in and out of the Thames River every year. Since disposal occurs during the off-season, interference with these recreational uses can be minimized. Interference with mineral extraction, desalination, fish and shellfish culture, as well as other legitimate uses of the area are unlikely. The site has not been identified as containing any mineral reserves nor is desalination at the site, an uncommonly used process in the United States, likely to be proposed. Fish and shellfish culture are likely to select other areas due to the historical and continuing use of this site for dredged material disposal projects regulated under the Clean Water Act. Additionally, the site has not been designated as an area of special scientific importance. • NLDS has received more than 10 million cubic yards of dredged material since 1955 (Maguire Group, Inc., 1995). The largest volumes of material have come from U.S. Navy -related dredging projects, and as such the site has experienced large fluctuations in annual volume. There are areas within the site that are known to contain historical dredged material (e.g. to the north). Specific monitoring of dredged material mounds 4 began in 1974 rioa r to a large U.S. Navy project, a site has been intensively monitored sincWt time (U.S. Navy, 1976) and still ithe US ACOE. Capping has been employed at NLDS, and the current management practice is to group disposal mounds in a ring to provide potential containment areas for future capping projects. • Results of STFATE hydrodynamic modeling have showed that temporary degradation in water quality or other environmental conditions during initial mixing caused by disposal operations would be reduced to normal ambient seawater levels or to undetectable contaminant concentrations before reaching .any beach, shoreline, marine sanctuary, or known geographically limited fishery or shellfishery. Temporary degradation in water quality would primarily result from elevated concentrations of total suspended solids (TSS), however, within a matter of hours of disposal, TSS concentration would only slightly exceed background concentration according to the modeling. • The most recent benthic in faunal survey was conducted in June 2001 (SAIL 2004). Six benthic grabs were taken from NLDS' Seawolf Mound. Species richness totaled 143 discrete taxa Of the discrete taxa found, 58 were annelids, 31 were arthropods, 25 were mollusks, I 1 were colonial cnidarians, eight were bryozoans, and five were nemerteans. Other phyla, including Porifera, Nematoda, Entoprocta, Echinodermata, and Hemichordata, were either represented by one species or were not further identified. Averaging over all stations, mean abundance (numbers/0.04 m2) was highest for the bivalve Mytilidae (558). Next most abundant was the amphipod Ampelisca vadorum (104.7). Ranking third through tenth were the polychaetes Tharyx acutus/Cirratulidae (73.1), Ampharete finmarchia (56.8), Monticellinia bapdsteae (36.2), the bivalve Nucula annulata (32.0), the polychaetes Prionospio steenstrupi (26.3), Harmothoe extenuata/Polynoidae (19.6), Exogone dispar (14.5), and Nephtys incisa/Nephytidae (13.5). Overall, results of the benthic community analysis and sediment -profile imaging indicate that benthic recolonization over the surface of the Seawolf Mound was relatively advanced, with abundant evidence of a mature or "equilibrium" community (sensu McCall, 1977) consisting of head -down, subsurface -deposit -feeding infauna (i.e., Stage III). There also continued to be a Stage 1/II community visible at the sediment surface, consisting mainly of abundant, small, tube -dwelling polychaetes and arnphipods. Compared to the results of the September 1997 survey (SAIC 2001b) conducted 1.5 years following creation of the capped mound, the benthic community in June 2001 was more abundant, had significantly more species present, and had greater diversity and evenness. These results showing an advanced benthic recolonization of the Seawolf Mound at five years postcap were consistent with previous studies of other NLDS mounds and expectations based on the standard model of benthic infaunal succession in Long Island Sound. Central Lone Island Sound Disposal Site —US ACOE Managed Site • The Central Long Island Sound Disposal Site is located approximately 10.9 km south of South End Point, East Haven, Connecticut with center coordinates 410 08.905' N, 720 53.073'W (NAD 83). The distance from the West Harbor to CLIS would increase travel time and costs to make use of this site economically prohibitive. In view of the fact that this project could be self -capping, it would make little sense to travel further to CLIS. • There is approximately 15,000 cubic yards to dredge R • The Western Long Island Sound Disposal Site (WLIS) is centered at 400 59.406' N, 73° 28.674' W (NAD 83) and is located 5.1 km south of Long Neck Point, Noroton, Connecticut. WLIS has been used as a dredged material disposal site regularly since 1982. The distance from Fishers Island to WLIS would increase travel time, roughly twice the distance to CLIS, and costs to make use of this site economically prohibitive. Since the dredging capping requirements for WLIS are significantly the same as for CLIS, it would make no sense to travel further to WLIS. Rhode Island Sound Disposal Site — EPA Managed Site • The Rhode Island Sound Disposal Site (RISDS) is designated and monitored by EPA New England. The RISDS is located approximately nine nmi south of Point Judith, Rhode Island and approximately 6.5 nmi east of Block Island, Rhode Island, with depths from 115 tol28 feet (35 to 39 m). The sediments at the site range from glacially derived till to soft, silty sand. The corner coordinates (North American Datum 1983: NAD 83) for the RISDS site, are as follows: 41' 14'21"❑N, 71° 23'29"❑W; 41° 1421"❑N, 71° 22'09"❑W; 41° 13'21"❑N, 71° 23'29"❑W; 41' 1321"❑N, 71° 22'09"❑W. The distance from the Mystic River would increase travel time and costs to make use of this site economically prohibitive. The trip is through open ocean waters of Block Island Sound which would be treacherous for small dredge scows and they would therefore have to go out with half loads with similar time requirements to the CLIS model referenced above. Massachusetts Bay Disposal Site — EPA Managed Site • The Massachusetts Bay Disposal Site is designated by EPA New England. The MBDS is centered about 22 km southeast of Gales Point, MA, in waters ranging from 82 to 92 m in depth. The site is a 3.7 km diameter circle centered at 420 25.106' N, 700 34.969' W (NAD 83). The distance from the Mystic River across open waters of the ocean would make this trip treacherous for the small dredge scows required to conduct this dredging. And would increase travel time and costs to make use of this site economically prohibitive. In addition, transportation of dredged material to the MEDS would require regulation by the Commonwealth of Massachusetts. Use of these alternative sites also offer no environmental advantages to NLDS and would result in greater use of fossil fuels, greater potential for transportation accidents, and more likely encounters with endangered or threatened marine mammals and turtles. Dredging Logistics for Open Water Disposal — NLDA versus CLIS Comparison • To grasp the significance of the logistical impact required to get dredged oils from New London disposal site to Central Long Island Sound, consider the following. • The dredge scow will have the capacity of approximately 250 cubic yards of sand/mud and yet provide an adequate free board to deal with typical wave conditions in Long Island Sound. C • This loading critdb(draft of scow when full versus she& water depths at the dock facility) indicates t approximately four barge loads will required for every thousand cubic yards of material to be dredged. • At 15,000 cubic yards of dredging proposed, this would require approximately 60 dredge disposal trips. It takes approximately eight hours to dredge 250 CY, one barge full; It takes approximately six hours to take that barge from West Harbor at Fisher's Island to the New London disposal area, dump the load, and get back to the Fisher's Island Yacht Club to resume dredging. This is a 14 -hour round-trip and very close to following optimum tide cycles. • At 60 trips required and 14 -hour trips intervals to NLDS, a total of 840 hours is required to conduct this dredging (35 days of non-stop operation); Approximately 360 of these 840 hours are transmit time. (Approximately 15 days of transit time.) To go to Central Long Island Sound with the same eight hour dredge requirement to load the barge, it takes 26 hours to travel to CLIS and dump the load and return to Fisher's Island. Disposal at CLIS requires a total of 34 hours per round-trip; At 60 trips, this is 2,040 hours of continuous operation (85 days); of this time, approximately 1,560 hours would be dedicated strictly to transit time. The transit time to CLIS will be apmnximately five times the transit time to NLDS. approximately 65 days of transit time ... just transit time. This is 50 days of continuous transit time at full power beyond what is necessary for disposal at NLDS and would account for tons of hydrocarbon emission into the atmosphere. Alternatives to Open Water Disposal There are two issues that relate to hydraulic dredging. One is the characterization of the material to be dredged and its ultimate disposal and the second is the logistics of de- watering hydraulically dredged materials. In hydraulic dredging the equipment utilizes a vacuum technique to sucking the sediments off the harbor bottom and 90% of the material taken through the vacuum system is water, only 10% is solids (the muddy, fine- grained sediments). This means that a de -watering area generally has to be fairly close by and significant in size. 6,000 cubic yards of dredging is the "in situ" volume in place as it exists on the harbor bottom. The silts that need to be dredged at F.I.Y.C. are approximately 50% water and therefore the 6,000 yards of material to be removed will ultimately constitute approximately 3,000 yards to be disposed of as fill, somewhere on the island. The nature of the material is fine-grain silts and mud with organics. During the dewatering process it will be odious. As mentioned before, 50% of the "in situ" volume is water. Silts, by their nature, do not make good fill for construction sites or even for lawns and they have almost no value as top soil because they are saturated with salt and relatively few species of vegetation can grow in than, certainly not the type of vegetation that most people on Fishers Island are utilizing for their lawns or landscaping. 7 Beach nourishmPaand near shore disposal are not suitab e o tions for disposal because the material to be dredged is comprised primarily of heterogeneous glacial material including mud, fine sands and coarse sands. In addition, the resulting increased turbidity and change in bottom sediment characteristics from customarily fine grained beach sand to the silt -laden coarse sand would have an impact on the recreational and habitat use of any beach or near shore disposal area. The mud and the coarse sand would be entirely unsuitable for recreational beaches and the fine sand is very limited; observed in only one core strata. Upland disposal does not appear to be a suitable option based on scrutiny of the NYS DEC Marine Habitat Protection Bureau and the Regulatory Permit Section. Because the dredged material is muddy, sandy material, it would need to be de -watered before it could be loaded into trucks and/or moved to its final place of deposition. Because of the site constraints, this could take months to cant' out the dredge, off-loading, and the dewatering operations. There are no nearby upland areas that could be utilized for disposal of the material to be dredged. In addition, the dewatered dredged material would tend to revert to its muddy characteristics with every exposure to precipitation and would create a mess and killing non -salt tolerant vegetative species along the haul routes where ever it was transported, and wherever it is ultimately disposed of unless it is buried. • Hydraulic Dredging Disposal Issues Hydraulic dredging could utilize several different upland disposal techniques. One would be to deposit the discharge into an open basin. Dredging would be terminated upon reaching a certain critical elevation in the basin and then the material will be allowed to de -water by seepage into the ground and evaporation. Subsequently the dredged mud and silts must be collected in a loader and transported off site in a dump truck. A second method would be to utilize a goo -tube which was an initial recommendation of the NYS DEC, during one of several pre -application site visits five years ago. A "geo-tube" is a fabric sewn into a tube, like a large sock, that is designed with microscopic pores which allow water to ooze out through osmosis and yet the tube retains the dredge sediments within the confines of the fabric. With silts such as those materials at the site, the sediments are so fine-grained that they will have a tendency to clog the pores of the geo-tube or in some cases even flow through the fabric from the geo-tube. Therefore, when these types of materials are to be dredged, the process must include injection of a coagulant which is mixed into the discharge waters so that the silty sediments will tend to flocculate together and settle out of solution inside the geo-tube. The combined particle size is such that they will not generally clog the pores. But this process takes much more time and costs more than de -watering even more granular sediments. Ultimately the goo -tube with de -watered sediments is cut open and the material can be removed by loader and dump truck and utilized for fill or disposed of as necessary. An option to the geo-tube approach is to discharge the dredge fluid into an open, graded basin with an erosion and sediment control berm and possibly special controls such as a partial impermeable berm liner or hay bales around the perimeter to assure that sedimentation does not become a problem for wetlands or the open waters into which the dredged effluent and decanted water flows. In this case, as previously mentioned, the dredge fluids wo ave to be disposed of in a very lar -watering basin or else the work would have proceed progressively over a period o years where a portion of the dredged material would be temporarily de -watered and removed prior to proceeding with the next phase of the project. It is important to realize that the dilution of dredge sediments by 1,000% is a significant impact on the process of the work. For every cubic foot of dredge material removed, 10 cubic feet of water and sediment will be transported through the discharge pipe. Therefore, the fluid that is discharged is 90% water and 10% sediments. One should also keep in mind that 1,000 cubic yards represents an area of approximately 100 feet square, 3 feet high. Therefore, the area needed to hold 1,000 yards of "in situ" sediments would be roughly 10,000 cubic yards in volume, or approximately 2 million gallons of hydraulically dredged fluid. There is no site large enough on Fishers Island to accommodate the amount of sediment and water that would be generated from this project even if the work was to proceed progressively over a period of years. Because of the logistics and odor associated with the dewatering and disposal operations, it would be best to dredge in December and dispose of the material (bury it) in the spring after Easter before the summer residents return to the island. Ultimate Disposal of Dredged Materials It is important for the permit agencies to understand how much material is to be dredged, where it is going to be handled and de -watered, transported and ultimately how it will be disposed of. This last issue represents one of the tougher considerations. My feeling is that it would be best to anticipate upland disposal at a site where space is available, access and disposal rights can be obtained and possibilities of future disturbances are minimized. For example, the Fishers Island Ferry District about disposal upland at the airport. Unfortunately, fine-grained silts and mud do not have any redeeming characteristics for fill on construction or landscaping sites. The mud would have to be mixed into existing sands or gravel at a considerable dilution rate such that the existing gravels would be 10 or more times the volume of the mud to be disposed of and this blend would have to be spread and then buried since the salt levels in the mud are not conducive to any type of vegetation growth other than tidal wetlands and the airport hydrology would not support that type of vegetation. Years ago when this process was started, it was recommended that samples be taken so that the material to be dredged could be quantified and characterized by current standards of the U.S. Army Corps of Engineers and the NYS DEC. Those test results were previously submitted for review and the dredge sediments test results will be evaluated by the Solid Waste Division of the DEC for upland disposal suitability as well. Concerns were raised that the disposal area must be clear of any ground water site which ruled out all of Fishers Island except at the airport. One option under consideration for disposal of these dredge sediments was on property of the former Mobil station. The most significant concern about this was the prospect of hydrocarbons leaching out of the soil as a result of the continuous dewatering nature of dredge sediments. 0 • Permission woohave to be obtained from the Fish*Island Utility Company for temporary de -watering of these dredge materials on an annual basis for the progressive work over a period of five years, • Design the project for upland temporary de -watering without use of geo-tubes, • Obtain permission from the Fishers Island Ferry District to dispose of the material with the final destination being a burial site on the airport out of the way of all runways and future planned improvements for taxi -ways, aprons, parking areas, buildings or other uses on the site, • Coordinate this approach with permit agencies, especially the NYS DEC Marine Habitat Protection Bureau and the Town of Southold, Board of Trustees at their up -coming site visit in August. A more inert or minimally controversial site for the ultimate disposal of these silts would be preferable. Thus the airport grounds, the only open expanse of available municipal property available for such a purpose was considered. The airport, which is operated by the Fishers Island Ferry District, would have to render a disposal site unusable for airport purposes in order to accept this fill because of its structural inadequacies for any type of load bearing applications and the expanse of area that would be required for burial or soil blending applications. Based on all of these factors, the hydraulic dredging option with upland disposal would have to resolve the beneficial re -use issues: Calls have been made to a number of upland possible upland owners and no one who responded will commit to or expressed any interest in the use of this material for upland uses. The following is typical of the responses received: Municipalities — Directors of Public Works and / or Town Engineers at a dozen local towns in Connecticut were called and asked if dredged muddy, granular marine sediments could be used in any Public Works projects, such as roads, road bases, landfills, recreational facilites, abandonment of septic systems. Without a certificate from the State Health Department indicating that the material was clean, without contamination, they could not and would not use it. The CT DEP has published "Guideline for Municipal Management Practices for Street Sweeping & Catch Basin Cleaning" for the beneficial reuse of material which is granular, not like the fine silt, sandy materials to be taken from this project, but uses are limited and the perception of liability for ground or groundwater contamination are significant. State of Connecticut — The Department of Transportation Aviation Section was contacted both at Headquarters and Groton New London Airport; neither would take the material. Contractors — Twelve Contacted, two on Fishers Island, ten in Connecticut • Without a Health Department Certificate, none of the contractors would take the material for the same reason as the Towns. This includes highway paving asphalt batch plants who also do not want mud in their asphalt or concrete products which would adversely affect stability of the bituminous concrete. 10 Vuarry VPCraW1S — 1IUM l VIIWt WU • Without a fith Department Certificate, none of Auarry operators or gravel suppliers would take the material. Municipal and Private — 12 Contacted throughout New London County Without a Health Department Certificate, none of the golf course owners or operators would take the material. Suitability of NLDS NLDS is suitable for open -water disposal and has been designated as such by the EPA and the US Army Corps of Engineers, NE District are considering the following: • There were a total of 5 core samples collected from the proposed dredged area in accordance with the USACOE sample plan, copy attached, and composited or tested individually as directed by the USACOE NER. Test results analysis indicated that that the dredging qualifies for open water disposal with capping. Dredging contractors will be required to release the dredged material at a specified buoy or set of coordinates within the designated disposal site. All disposals are to occur at a taut -wired buoy with the scow at a complete halt, except when doing so will create an unsafe condition due to weather or sea state. To minimize these occurrences, contractors will be required to pay special attention to predicted weather conditions at the disposal site prior to departing for the disposal site. NLDS is at least 2 miles away from beaches and other coastal amenities. The closest facility is Ocean Beach in New London, CT, approximately 3 miles to the north. Parks, located to northwest (Harkness and Waterford Beach), northeast (Easter Point Beach and Bluff Point) of NLDS and east being the community beach in West Harbor, are approximately 3 miles away. On the Long Island shore, the closest park is Long Beach Point, 10 miles to the southwest. The flow of ebbing tides around the site is east with a slight southern component, forcing the water offshore almost entirely through the Race and into the Atlantic Ocean. Therefore, the transportation of dredged material at NLDS would not appear to affect the use of beaches, parks, or other public amenities in the area as determined by the US ACOE studies previously referenced. It fish resources as a result 11 CONSISTENCY WITRONG ISLAND SOUND COASTAGEMENT PROGRAM It appears that the Long Island Sound dredge disposal would be most appropriately reviewed in accordance with the Special Management Areas section of the Coastal Management Program. This project is consistent with the criteria for Areas of Concentrated Development and Revitalizing Long Island Sound's Waterfront Centers which would have to include Fishers Island. This dredging is in support of boating activities for a Maritime Center. • The dock facility in West Harbor is a New Boating facility. It is a "not for profit" organization that runs the facility with pertinent accessories for docking boats encompassing an area of approximately 6 acres of surface water and land area in West Harbor at Fishers Island. The docking facility is in the midst of a maritime center area and operates as essential transportation infrastructure as well as serving as a center for recreational boating and therefore conforms to the Central Business District proximity requirement. • The proposed dredging disposal project represents maintenance of existing essential infrastructure in accordance with the Long Island Sound Coastal Management Program of the State of New York. In this case, while no visible structures will be developed in Long Island Sound, it is the dredging of the facility, with open -water disposal in Long Island Sound that maintains the opportunity for floating dock facilities which will support and benefit a water -dependent use, essential transportation and recreational boating, in the waters of Long Island Sound and Fishers Island Sound. • The docking facilities are limited in size and the seasonal restrictions are such that dredging will have to be accomplished between this October 1 and June 1; no doubt during the fall because of seasonal summertime shellfish restrictions and winter flounder spawning restrictions which have imposed in the permit. The fall is when many of the docks are vacated. The grounds are not used for upland storage of motor and sailboats. There is virtually no room to conduct the de -watering, staging, loading and transportation of this material from the site. (Local fuel and utility operators north have the same problem with space allocation wherever they are situated in the community). • Historic Maritime Communities — Fishers Island represents an historic center of marine activity in all regards dating back 100 years or more. The purpose of this section property is to foster the protection and beneficial enjoyment of historic and cultural resources associated with the maritime activities and communities on Long Island Sound and this project is consistent with these provisions. • West Harbor is unique harbor developed with a historic legacy and containing concentrations of water -dependent commercial, industrial and historical uses and essential support facilities. The harbor is a center for waterborne commerce, recreation and other water -dependent activities and is thus an important component of the regional transportation system, recreational boating and commercial fishing industries for New York. The harbor is sheltered and have suitable hydrologic land and water conditions and infrastructure essential to support these water -dependent operations. 12 • Capping — CappinfPs considered to be a beneficial re-us*tion for dredged materials. While the US ACOE Suitability Determination and the NYS DEC permit authorizes open - water disposal, the ACOE and the CT DEEP permit will probably require sequential dredging to further minimize impacts. Thus, this project is to that extent, consistent with the policies of the Coastal Management Program. • The proposed dredging will utilize best management practices and will be described and detailed in the Connecticut State Department of Energy & Environmental Protection Certificate of Permission issued under the Connecticut Structures & Dredging Act. The sediments have been analyzed scientifically by the technical staff of both the NER of the ACOE and the State of New York DEC, both in terms of chemical contaminants including heavy metal and in terms of benthic populations and assemblages in the muddy, sandy sediments as documented in attached reports and open water disposal has been authorized. A comprehensive review of upland disposal options considering municipal, commercial and industrial upland uses was explored and submitted to the State DEC as a part of this project. The NYS DEC reviewed this project for more than one year evaluating the scientific characteristics of the material including grain size, water content and contaminant levels and determined the material to be unsuitable for any upland disposal site. No municipality contacted during this process indicated any interest or prospect whatsoever in accepting these dredge sediments for some beneficial upland re -use. Many additional contacts have been made since the original application was filed but with the same results. Upland disposal options in New York as well as Connecticut will require a Health Department determination of no potential hazard or future adverse impact on drinking water quality and without that type of certification and knowing that the samples contained traces of contamination, upland options appear to be practically non-existent. No municipal agency or commercial entity contacted thus far has indicated any interest in accepting this dredged silt. SUMMARY In summary, it is difficult to state that the New London Open Water Disposal Site could be defined as a regionally important "natural resource area" since it has been used continuously for decades for this express purpose of disposing of dredge sediments for many varied dredging projects. The NLDS waters are public trust lands (waters) of both States of Connecticut and New York for the purposes of fishing, commerce, and navigation. The site is in open, unprotected waters and represents little in the way of active recreation area. There is some shellfishing (Lobsters) in parts of NLDS, but fishing is limited because of the amount of traffic in the channel and through the "Race". On the other hand, being a designated open - water dredge disposal site, NLDS has been a valuable asset to water -dependent project and uses regionally and therefore it meets the balancing requirements set forth in the NYS Coastal Management Program as well as the Connecticut Coastal Management Act. This dredging project supports a sound plan of development supported by the community as well as the Town and the NYS DEC who have issued permits for a high-priority water dependent use, an existing boating center consistent with local land harbor use development plans in a Maritime Center, part of an historic and long-standing Working Coast which has been developed with extensive Federal, State and municipal assistance and incentives. The 13 disposal of the dredged sediments will be in a long-standing federally designated open -water site which has been well -studied and will be closely monitored during the course of the work to assure that the affects of the project are localized, to be consistent with the NYS CMP as well as the NYS DEC, US ACOE, State of Connecticut and Town of Southold permits. The U. S. Army Corp of Engineers has reviewed the test results of the material to be dredged and has determined that the material to be dredged is suitable for confined, open water disposal at the NLDS. Connecticut DEP's permit for this project is likely to have a condition authorizing open water disposal using sequential dredging methods. Both will require capping. Due to the physical nature of the material, beach nourishment is not an option and there is no known upland sites or projects available for disposal or beneficial re -use of this material and the NYS DEC Marine Habitat Protection Bureau has confirmed this in their project review analysis. The sediments were tested twice to verify chemical consistency of the material. The US Army Corps of Engineers, New England District has issued a suitability determination for this project; the project is expected to be permitted by the U.S. Army Corps of Engineers, New York District as well. The additional floats (marina expansion) the dredging and disposal portion of the project are considered minor in nature and meet the terms and conditions of the US ACOE's Individual Permit standards. The Town of Southold Trustees and the NYS DEC have both issued permits for this project. Based on all of these consideration, some of which are documented in fair detail in the State and Town permits and attachments, it is felt that the dock and dredge permit application stipulating open -water disposal of sediments at NLDS is consistent with the Coastal Management Program for New York State as well as the Coastal Management Program for the State of Connecticut. In addition, I think it is important to note that much of the dredging in this project is coming from New York "Public Trust" submerged lands and waters, both the DOS and the NYS DEC have issued their respective documents affirming this project and authorizing it to proceed I think that this goes a long way to providing the necessary support for the project and demonstrate consistency. Certainly the DOS is responsible for implementing the terms and conditions of the Coastal Management Ad. Issuing their consistency determination, as they did, would in my opinion demonstrate compliance with the factor for consideration under the LWRP. Notary Public. .._ ..� NATIVE STATEMENT & SUPPLERNTAL INFORMATION FISHERS ISLAND MARINA, LLC WEST HARBOR, FISHERS ISLAND JANUARY 7, 2013 GENERAL The project is at parcel 1000-010-1-9, owned by the Fishers Island Development Company, off of Central Avenue located along the west shore of West Harbor on Fishers Island. The site is flat to gently sloped, sandy, gravel earthen materials, vegetated with grass, brush, ground cover and trees. A dock facility has existed and been operated at this site for recreational boating and transportation to and from the mainland since the 30's. The frontage of the property is approximately 300 feet along West Harbor abutted by the Goose Island Corporation to the north and Ms. Penelope Sharp to the west. The waterfront consists of a rock revetment lined shore along the east, tidal wetlands fringe vegetation at the base of the gently sloped tree -lined terrace to the south and west of the dock facilities. The objective of this project is to dredge for current operations and optimize the geometry and usefulness of the dock facilities. Attached are application drawings prepared for this project. This supplemental narrative has been prepared in accordance with the requirements of Town of Southold, Ordinance No. 6, 2004, and the Waterfront Revitalization Program related to docks and shorefront improvements. In addition, various coastal policies under the New York State Coastal Management Act are addressed herein for review by the New York State Department of State and Department of Environmental Conservation. DESCRIPTION OF WORK The project is to dredge 8650(+/-)CY of sandy silt over 63,000 (+/-) SF with a 1 foot overdredge allowance of 2,400(+/-)CY by clamshell bucket for open water disposal including the temporary removal and subsequent reinstallation of the floating docks to facilitate dredging. MOORING FACILITIES AND DOCK MODIFICATIONS In accordance with the U. S. Army Corps of Engineers Environmental Questionnaire, the following additional information is provided. I. There are no changes proposed to the existing dock facilities as shown on the attached drawings. Pier widths of 4 -feet, while suitable for residential structures are not suitable for marina type facilities where numerous vessels congregate leading to significant volumes of pedestrian access going to and from the boats during pre -launch provisioning and upon return. The floating dock facilities are also configured for a variety of recreational boating needs including small un -powered sailboats, part of the community sailing program, dinghy access to the mooring field, small skiffs and run -abouts for boating in West Harbor, cuddy cabin sailboats and small cruising motorboats for boating around Fishers Island and larger cabin cruiser type boats and sailing vessels for longer range cruising and boating needs. 1 2. The application kings depict some berthed boats to the possible at various facilities around the site possible without interfering with the necessary call -outs and dimensions for the various structures. 3. The Fishers Island Marina is a dock facility; there are no repair or storage services at the site. There are pump -out facilities at Pirates Cove providing service and fueling on Fishers Island as well as marinas along the Connecticut shoreline. There is also a pump -out boat, serving boats in the mooring field, which can serve the Club patrons as well. It is not believed that pump -out facilities are necessary at the Fishers Island Marina. 4. Adjacent marine structures including piers, docks, wharves, bulkheads, moorings are shown on the attached application drawings. 5. Wave protection is not considered to be necessary at this site. Because of the natural protection provided by West Harbor, there is no fetch over which waves can be generated from the northwest counter -clockwise all the way to the east. Nor'easters and strong northeasterly winds can generate significant waves in West Harbor however it has been generally agreed that a wave attenuator in West Harbor would not be justified to protect these facilities. This facility has operated at this site since the mid -1930's. Wave protection is provided to the shoreline facilities at the site by the revetment along the lawn and no further changes to the revetment are considered necessary at this time. 6. There is no bulkheading, bank stabilization, dock modifications, or filling activities associated with this project; revetment and non -vegetated buffer improvements were already permitted and are substantially complete. It is envisioned that the dredging will be accomplished utilizing the following general sequence and methodology. ➢ The marine contractor will arrive by water with barge -mounted crane and push boat or tug and work boats or dredge scow. ➢ The existing A Dock and B Dock structures will be disassembled as necessary for dredging and project phasing. Piles, timbers and decking which cannot be re -used will be collected in containers and removed from the site in accordance with applicable local laws and ordinances. ➢ The dredging process will need to begin first in order to work around existing dock facilities which are to remain for replacement in a later stage of the project. The contractor will have to dredge his way in to the site from east to west in order to take the most advantage of the new water depths as well as tides to complete the project with maximum efficiency. DREDGING This access of infrastructure improvement includes a significant dredging component. The following are some of the considerations that are pertinent to discussions about justification for charging a fee for dredging bottom sediments under the purview of Town of Southold codes and various Boards discretion. During the early phase of development of this project, extensive coordination was conducted within the Fishers Island community to determine the feasibility of upland disposal for dredge sediments. In order to mi*e the amount of material to be dredged yet provide a reasonable buffer to avoid maintenance dredging possibilities in the near future, a stepped dredging program has been developed. Dredging will be to 4 feet in the vicinity of Dock A, 5 feet in the vicinity of Dock B, between Docks B and D, and 8 feet on the outside around Dock D. The materials to be dredged are categorized primarily as fine -gained silts with some sand and gravel. It is estimated that almost 75% of the project is mud and about 25% is muddy sands and gravel. Upland disposal sites included considerations for hydraulic dredging being pumped to the open meadow immediately west of the site and west of property of Ms Penelope Sharp. The material could be either de -watered in the open stilling basin or pumped into geo-tubes where it would be de - watered in the confines of the tubes. Disposal options were fairly limited consisting of either burial at an open expanse of unused property such as the air field or burial and incorporation into existing site soils around various development projects on Fishers Island. After extensive interviews and meetings with various agencies including the Fishers Island Ferry District, Fishers Island Utility Company and Fishers Island Development Company as well as several contractors on the island, no one expressed any interest or foreseeable use for this material. The reason for this lack interest is the fine -gained nature of the dredge sediments. It is anticipated that unless this material is buried and worked into the gravelly substrate at several potential burial sites, the muddy sediments will become saturated and revert to a muddy consistency during any kind of precipitation. Thus, open -water disposal had to be considered as the only viable option for dredge sediments. Attached is a copy of the full narrative submitted to the NYS DOS for their CAM consistency review A dredge sediment sample plan was prepared and coordinated early on with the U. S. Army Corps of Engineers New England Division and the CT State Department of Environmental Protection since both of these agencies must approve the open -water disposal at the New London open water disposal site (NLDS). The sample plan was coordinated with USACOE NY and the NYS DEC. Samples were collected in accordance with the sampling plan and with instructions received from the NYS DEC in August of 2008. Those samples were tested in accordance with the sample plan and it was determined that elevated levels of mercury existed requiring capping. A capping plan has been determined necessary by the U.S. Army Corps of Engineers. It is therefore imperative that the dredging aspect of this project move forward as quickly as possible. LOCAL WATERFRONT REVITALIZATION POLICIES The Town of Southold, LWRP policies that are applicable to the Fishers Island Marina dock operation are a local refinement of the Long Island Sound Regional Coastal Management Program policies that apply throughout Long Island Sound under the Coastal Zone Management program administered by the NYS Department of State. The dredging issues are covered in the document referenced above. The site is in West Harbor on Fishers Island and is characterized as Developed Coast on the east shore at the Hay Harbor Club site to the parcel north and south shore and currently undeveloped coast or natural coast on the west shore. The developed coast policies are applicable as follows: ➢ Policy 1 is to foster a pattern of development that enhances community character and preserves natural resources to the maximum extent and minimizes adverse impacts on the environment, ➢ Policy 2 is to preserve historic resources, ➢ Policy 3 is to enhance and protect scenic resources and visual quality. The docks are consistent with waterfront development on Fishers Island and in coastal areas. The proposed work is to dredge the areas indicated to maintain maximum access consistent with other adjacent dock facilities and characteristics for the visual and scenic considerations in the harbor. The 3 encroachment has beentimized to the maximum possible flent to be consistent with DEC policies. The existing structures are as low profile as possible consistent with the safe and efficient use of the waters and consistent with the boating season tidal range of this site. NATURAL COAST POLICIES The Natural Coastal Policies are 4 through 8 and require consideration as follows: ➢ Policy 4 — Minimize loss of life, structures and natural resources from flooding and erosion, ➢ Policy 5 — Protect and improve water quality ➢ Policy 6 — Protect and restore the quality and function of the eco -system, ➢ Policy 7 — Protect and improve air quality, ➢ Policy 8 - Minimize environmental degradation primarily from solid waste and hazardous substances. The dock facility has existed in the current configuration for decades. As such, it provides adequate height to clear environmental resources of concern and the materials to be utilized are consistent with Town of Southold's Local Law #6 regarding environmental quality. There will be no adverse impacts on air quality as a result of these dock facilities. PUBLIC COAST POLICIES Policy 9 sets forth a priority to provide for public access and recreational use of coastal waters, public lands and public resources of the Town. This project maintains recreational boating facilities and so is consistent with this policy. WORKING COAST POLICIES The policies of this section relate to the following: ➢ Policy 10 — Protection of the Town's water -dependent uses and promoting new water - dependent uses in suitable locations, ➢ Policy 11— Promoting sustainable use of living marine resources, ➢ Policy 12 — Protect agricultural lands, ➢ Policy 13 — Promote appropriate use and development of energy and mineral resources. While most of the Working Coast Policies are not applicable to this site or this type of project, Policy 10, promoting water -dependent uses and the citing of water -dependent uses in appropriate areas is applicable and the proposed project makes the most beneficial use of the land and dock facilities. This project has been laid out with specific reference to and review of the Waterfront Revitalization Program policies and is considered to be consistent. In summary, the docks are typical of recreational boating facilities throughout the area and all along coastal New England. The structures have been minimized in size, height, and structure so as to be consistent with other facilities of a similar nature and the minimum necessary components to accommodate safe and efficient boating operations from this site. This project does not interfere with public access or use of public trust waters and lands of the State, it does not interfere with navigation, it will not create soil or sedimentation and dredging will not create erosion problems, in fact, the wood retaining structure should help minimize bank erosion. The piers do not adversely affect environmental resources in the area where the facility must span the shallow sub -tidal zone at the environmental resource the area where the facility must spAe shallow sub -tidal zone at the shore line, the facility retains its alignment in the area where environmental resources have already been diminished so as not to worsen any of these conditions. The height of the structure allows vegetation growth along the shoreline by tidal wetlands plants if other conditions are conducive to such growth. There is almost no vegetation on the muddy bottom sediments within the confines of the dock facility and the benthic habitat is probably stressed due to boating activity, as most marina basins are. While the bottom will be disrupted during dredging, it is anticipated that benthic dwellers including mollusks and crustaceans will re-establish the area within a year of the dredging, but the benthos will probably only return to its current levels of productivity and diversity. Thus it is anticipated that there will be no long term loss of valuable marine and wetland habitat and no water quality degradation as a result of this project. No natural protective features or processes will be adversely impacted as a result of the proposed dock work. This project is consistent with zoning policies and ordinances for the Town. There will be no development of the upland related to this dock facility that will create point sources of pollution or drainage. The 10 -Ft non -vegetated buffer along the lawn will help to filter rainfall runoff. The floating docks are the minimal size for stability considerations especially acknowledging the loading and waves from West Harbor and the floating docks are broadside to those waves. The float is suitably sized and adequate stable for a ramp landing and the ramp has been made no longer than necessary in order to minimize the pier structure and maximize boating access (slips). REQUIREMENTS OF SECTION 97-25 OF THE WETLANDS LAW 6 2004 The permittee acknowledges that the validity of this permit is subject to the approval of other governmental or municipal authorities. The permittee does, by the acceptance of this permit, assume all responsibility for operations undertaken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons and property resulting from such operations. By such acceptance, the permittee also agrees to indemnify and save harmless the Town of Southold and its officers. The permittee gives consent to the Town and its officers, employees and agents to enter Upon the premises where such operations are being conducted to make such inspections to determine whether said operations are being conducted in conformity with the permit. The permittee will notify the Trustees in writing one week prior to initiation of any and all operations. The permittee will notify the Trustees in writing upon completion of operations such that the site can be inspected for issuance for a certificate of compliance. In response to Sub -section 2a and the General Rules for Standards of Residential and Commercial Docks, the following additional information is offered. Permits for the work are being applied for through the Town, US ACOE, NYS DEC and a coastal zone consistency determination by the NYS DOS. 2, 3, 4. There are no changes to the dock facilities as a part of this project. 0 • Upon receipt of the permit for this project, appropriate permit numbers and a Town permit placard will be affixed to the most seaward face of the pier for identification from the water. 4. There are no permanent structures located above the pier decking, nor are any planned at this time other than the power posts and railing which are fixed by function and designed for this environment. 5. It is currently possible to provide a passage way to the upland via the south ramp to get around the pier and that access ability will be retained. There is approximately four feet of clearance to walk under the pier at low tide, however, foot traffic in this area is rare, if at all due to boulders near shore and the muddy characteristics of the gravelly substrate. NEW YORK STATE COASTAL MANAGEMENT PROGRAM These application documents include a copy of the Federal Consistency Assessment Form utilized for the New York State Coastal Management Program under the jurisdiction of the New York State Department of State. The following policies have been identified as pertinent to this application and the reason for consistency associated with this project is outlined in each respective case. Policy 2 —Water Dependent Uses — This project is to restore a fully functional water dependent use, a recreational boating dock facility at this site in support of recreational boating and sailing instruction. Policy 5 — Use of Existing Developed Shorefront There is developed shoreline on this site. This project utilizes existing shorefront which has been altered by the long-standing facilities. The project will be to accomplish maintenance dredging make dock access safe and reliably usable in most weather conditions. Policy -7 — Significant Fish & Wildlife Habitat Protection of significant fish and wildlife habitat has been considered in the development of this project layout. The pier to the shoreward point of beginning is over the rocky, vegetated shoreline fringe and above the rocky intertidal sediments and should not jeopardize the integrity of existing vegetation although such is scarce, primarily rockweed. Typically there is a slight environmental benefit to the project because of the structure in the water column which barnacles, algae and crustaceans will inhabit and the structures provide protection primarily for juvenile fish. Policy 8 — Protection & Preservation of Habitat Protection and preservation of habitat has also been considered in this project and the dock structure is being kept to its minimal configuration and of materials consistent with standards of the industry and restrictions set forth in the Wetlands Law, No. 6, 2004 set forth by the Town of Southold and standards of the NYS DEC. Policy 1 I — Minimize Damage to Natural Resources The dock facilities exist, laid out in such a way so as to minimize damage to natural resources as identified in Policy 7 above. The existing pier and floating dock facilities have existed for decades. The dredging is proposed to maintain access for current and future boating activities while minimizing adverse impacts such as bottom sediment re- suspension due to propeller contact or thrust induced erosion. Dredging has been stepped progressively; higher coming into the basin where smaller boats will dominate the mix, with shallower drafts. Policy 14 — No Measura&crease in Flooding= This project cows of dredging. The dock facility is an open wood pile and timber pier which in no way adversely affects waterflow and circulation in Hay Harbor or flooding potential of the area. Flood levels all around Fishers Island are dictated by water levels in Long Island Sound, Fishers Island Sound and Block Island Sound and the structures will have no adverse influence on those levels. Policy 15 — No New Dredging — Maintenance dredging is proposed in this project. Suspended marine silts have accumulated in this "dead end" of West Harbor for decades. The bottom depths are such that dredging is required to maintain viable access. This project has utilized a stepped configuration from the east to west to minimize the volume of material to be removed and deep water depths similar to the existing conditions. Repeated shallow water benthic studies in sandy mud to silty marina sediments have shown stressed populations of crustaceans and mollusks which inhabit these sediments and that they re -colonize and re -populate within a year or so of the dredging work. Increasing the water depth will tend to diminish the re -suspension impacts on the habitat and these colonies of creatures and so it is felt that the one-time disturbance, occurring in accordance with seasonal shellfish spawning restrictions will ultimately provide a reasonable balance between environmental concerns and the Coastal Zone Policies to foster recreational boating facilities and opportunities. The New England Regional Office of the USACOE has issued a suitability determination allowing for open -water disposal of dredge sediments from this project at NLDS (New London) with capping. Policy 19 — Impact on Public Access — Public access will not be jeopardized or impeded as a result of this project. As a matter of fact, there is almost no public access usage of the public trust lands or waters at this site. The intertidal zone in the dock facility area is significantly covered by boulders with tidal wetlands fringe marsh vegetation to the south. The Fishers Island Marina pier and floats occupy far less than the landward 25% of the waterway (West Harbor) width in accordance with US ACOE policies. Thus, public access to the State's lands and waters will not be adversely affected by the project. Policy 20 — Public Trust Compatibility with Existing Adioinine Properties and Land Uses- Public Trust compatibility with existing adjoining properties and land uses have also been considered in this project. Several nearby properties have small docking facilities and this docking facility will not interfere with existing or the likely configuration of future facilities on immediately adjoining properties or the logical allocation of littoral development rights in this part of West Harbor. These piers are long-standing structures. Policy 21 — Water Dependent Recreation — This project is consistent with water -dependent recreational opportunities policies set forth in this section. Policy 24 —Scenic Resources, Impairment or Loss - This policy is designed to prevent, impairment or loss of scenic resources. The reconstruction of the fixed wood pile and timber pier are float reconstruction and reconfiguration and will not represent a new encroachment or structure which would create a loss of scenic resources. The one property owner most likely to be impacted is the cottage of Gregory and Penelope Sharp just west of the club and they do not object to the proposed project. Policy 25 — Enhance Overall Scenic Quality - The existing pier and floats are consistent with the scenic quality of the area and will not diminish scenic resources as described in Policy 24 above. They will not be changed in this project. 7 Policy 44 — Preserve and 0tect Tidal Wetlands — It is acknowledothat the fringe marsh of spartina alterniflora along the shorefront is a valuable resource. The floating dock and fixed wood pile and timber pier emanates from the shore at the existing un -vegetated strip of the shoreline. The height of the pier should allow opportunities for the growth of tidal vegetation but that has not thus far occurred in this area naturally up to, and to an extent, beneath the wood pier. No changes to the pier are proposed SUMMARY This project proposes dredging in an existing, long-standing facility for community -wide recreational boating access, the dredging is maintenance in nature. A copy of NYS DEC permit and NYS DOS consistency determination are attached as substantiation for and in support of this project. A dredging suitability determination has been made by the US Army Corps of Engineers, New England Regional Office, for open -water disposal at the New London Open Water Disposal site (NLDS). The NYS DEC has issued their permit for this project and the NYS DOS has issued their consistency determination for the project as well. The State of Connecticut has authorized the submission of a Certificate of Permission Application to allow placement of the dredged materials in open waters of Long Island Sound. This project complies with applicable standards of the New York State Coastal Management Act, NYS / DEC Tidal Wetland Regulations and criteria for approval, the Town of Southold Waterfront Revitalization Program and Local Ordinance No. 6, 2004, and its approval is respectfully requested.
