AUTHORIZATION
Pursuant to the provisions of Chapter 275 of the Town Code of the Town of Southold and in
accordance with the Resolution of the Board of Trustees adopted at the meeting held on April 17, 2013, and in
consideration of application fee in the sum of $250.00 paid by DKR Shores, Inc. and subject to the Terms and
Conditions as stated in the Resolution, the Southold Town Board of Trustees authorizes and permits the
following:
Wetland Permit to remove all portions of existing dilapidated timbers/bulkhead, sections, to
reconstruct in place a 26' section, 27' section, 17' section, 29' section and 28' section of bulkhead at the
same height as existing, utilizing vinyl sheathing, to construct a 26' section, 36' section and 39' return
with Iow sill bulkhead, to utilize either helical anchors or a double pile seawall in these areas, to dredge
area 10' off bulkhead to a depth of-4' ALW, utilize resultant spoil approx. 75 c.y.as backfill, to
reconstruct 3'x28' section of walk in place with Thru flow open grate decking, to install a cantilevered
4'x6' platform, 3'xl2' ramp and 6'x20' float secured by (3) 10" piles and to allow a 4' wide pervious
gravel/stepping stone pathway to boat basin, to allow for existing water/electric to be activated to boat
basin and for flagpole lighting, to reactivate water to cut irrigation to be directed to lawn areas only; and
as depicted on the site plan prepared by DKR Shores, Inc., last dated April 10, 2013, and stamped
approved on April 17, 2013.
IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee Thomas Dowling, residing at 1200 Broadwaters Road, Cutchogue, New York as
part of the consideration for the issuance of the Permit does understand and prescribe to the
following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions &the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and Iow water marks.
That if future operations of the Town of Southold require the removal and/or alterations in
the location &the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Ms. Rigdon:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, April 17, 2013 regarding the above matter:
WHEREAS, DKR Shores, Inc. on behalf of THOMAS DOWLING applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated February 27, 2013, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application to
remove all portions of dilapidated timbers/old bulkhead and reconstruct a 189' navy
style bulkhead in-place of existing utilizing vinyl sheathing; to reconstruct a 39' return
and an 11' return, both with vinyl; to dredge area 10' off bulkhead, in boatslip to a depth
of -4'ALW; resultant spoil (approximately 75 cubic yards) to be used as backfill for new
structure; to reconstruct 3'x40' timber walk using untreated lumber be found Consistent
with the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application to
install a cantilevered 4'x6' platform, 3'x12' ramp, and 6'x20' float secured by (3) 10"
piles be found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered the Local Waterfront Revitalization
Program Policies 6, 6.3, 9.3 & 9.4 to the greatest extent possible through the imposition
of the following Best Management Practice requirements: 26' section, 36' section and
39' section returns to be constructed with Iow-sill bulkhead and including the use of
either helical anchors or a double pile seawall; reconstruct 3'x28' section of walkway in
place utilizing thru-flow open grate decking; and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on April 17, 2013, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees APPROVES the application of THOMAS
DOWLING to remove all portions of existing dilapidated timbers/bulkhead sections, to
reconstruct in place a 26' section, 27' section, 17' section, 29' section and 28' section of
bulkhead at the same height as existing, utilizing vinyl sheathing, to construct a 26'
section, 36' section and 39' return with Iow sill bulkhead, to utilize either helical anchors
or a double pile seawall in these areas, to dredge area 10' off bulkhead to a depth of -4'
ALW, utilize resultant spoil approx. 75 c.y.as backfill, to reconstruct 3'x28' section of

Dear Agena,
Thanks so much for your continued help with our project in Cutchogue. I thought it would be useful to
highlight the primary goals for the project and to outline the background behind those goals.
First, by way of background, we have owned the house in Cutchogue for several years and have
completely enjoyed it. The natural beauty and unique environment are one ora kind, and certainly
something we are committed to maintaining. This area is truly a treasure.
After several years of owning the house, one drawback became more obvious: it became increasingly
difficult for my mother-in-law to visit. As the house was originally designed, all bedrooms were on the
second floor and climbing stairs became increasingly difficult for her due to physical limitations. For
this and other reasons we decided to renovate the house a few years ago. The architect proposed many
interesting designs, but ultimately we wanted to accommodate our needs while preserving (and even
enhancing) the unique character of the area. So you will notice a bedroom on the ground floor, a path
from the driveway to the front door which can accommodate a ramp, wider doorway in the downstairs
bedroom and bath to accommodate a wheelchair etc. You will not notice a wider house or taller house
(it is larger lengthwise!), and you will not notice one closer to the water. We did not find the permitting
process unpleasant or onerous.
The goals of that renovation are not dissimilar to the goals for this project. We have some physical
needs we'd like to accommodate and we would like to preserve the anique environment. I have a 1987
Steigercraft boat that is 25 feet long. Not a very fancy boat (1 did not mistype the year) it is primarily
used for fishing. Several of my fishing companions are older and find climbing from the bulkhead wall
to the boat increasingly treacherous. So we would very much tike to put in a floating dock with ramp to
make boarding easier and less dangerous. At the same time, we would propose replacing the bulkhead
both because the existing one is failing in some areas and because more environmentally friendly
materials are available. Finally, we would propose replacing the existing water and electric lines
running to the dock.
We have very much appreciated your suggestions and help on the project and are, of course, very
willing to work with the Town of Southold in ensuring this is done in the best way possible.

2. Conformance With Plans All activities authorized by this permit must be in strict conformance
with the approved plans submitted by the applicant or applicant's agent as part of the permit application.

the completed work.

5. Replacement Bulkhead 1Vl~imnm Height The top elevation of the replacmnent bulkhead shall be
no more than 18 inches h~gher than the existing bulkhead.
6. No Seaward Extension of Bulkhead The new bulkhead shall be conslxucted in place of the existing
bulkhead with no seaward cxtenaion of the outcat~ost bulkhead face.
7. Jet-in Bulkhead Bulkheads constructed directly adjacent to vegetated tidal wetlands shall be hand
driven or jetted in with no distm'bance to the tidal wetland. Trenching is strictly prohibited.
8. Backfilling The installation of the approved replacement bulkhead shall be completed prior to the
placement of any fill material behind the struetme.
9. Clean Fill Only All fill ahall consist of clean sand, gravel, or soil (not asphalt, slag, flTaah, broken
concxete or demolition debris).
10. No Runoff Over or Through Bulkhead or into Wet4nnd Upon completion of the bulkhead
replacement authorized herein, them shall be no discharge of runoff or other effluent over or fl~rough the
structure or into any tidal wetland or protected buffer arc~
Il. Use of Treated Wood The use of wood treated with ca~osote, pentachlorophenol or other wood
treatment not specifically approved by the dcl~utment for use in wetlands and/or marine waters, is
strictly prohibited in the constxuction of structm~ that will be in contact with tidal waters.

accomplished with a clam shell or other closed bucket equipment.
16. No Side-casting of Dredged Materhd Excavated segliment shall be placed directly into the
approved work area landward of the r~plac~ment bulkhead. No side-casting (double dipping) of dredged
material is authorized.
17. Leave a Uniform Bottom Elevation All dredging shall be conducted so as to leave a uniform
bottom elevation frce of mounds or holes.
18. Dragline Prohibited The us~ of a dra~line for dred~ng is strictly prohibited.
19. Storage of Equipment, Materials The storage of construction equipment and materials shall be
confined to the upland area landward of the bulkhead or on a barge.
20. No Disturbance to Vegetated Tidal Wetlands There shah be no disturbance to vegetated tidal
wetlands or protected buffer areas as a result of the p~mitted activities.
21. No Construction Debris in Wetland or Adjacent Area Any dchris or excess matexial from
construction of this project shall be completely removed from the adjacent area (upland) and removed to
an approved upland area for disposal. No debris is pwmitted in wetlands and/or protected buffer areas.
22. Seeding Disturbed Areas All areas of soil disturbance resulting from the approved project shall be
stabilized with appropriate vegetation (grasses, etc.) immediately following project completion or prior
to permit expiration, whichever comes first. If the project site rcwain~ inactive for more than 48 hours
or planting is impractical duc to the s~ason, then thc area shall be stabilized with straw or hay mulch or
jute matting ontil weather conditions favor germination~
z~. Temporary Mulch, Final Seeding ffseeding is impracticable due to the time of year, a temixgary
mulch shall be applied and final s~x~ling shnll be p~-q-formed at the earli~t opportxmity when we~lther

24. Post Permit Sign The p~mit sign enclosed with this p~axit shall be posted in a conspicuous
location on the worksite and adequately protected from the weather.

any vegetated tidal wetland.
27. Float Installation The float shall bc installed only at the approved location with a minimum water
depth of 2¼ feet, measured at apparent low tide.

propulsion system of a motorized vessel and/or the water-borne forces created by said propeller or
propulsion systems, to excavate or displace existing bottom sediment and benthic habitat for the di~ct or
indirect purpose of establishing or increasing water depth, is a regulated activity and is not autho~zed by
this ptannit. Prop dredging is strictly prohibited without fu~er written authorization (pem~it,
modification or amendment) from the depmlment.
29. NO Permanent Structures on Dock No permanent structures shall be installed on
dock/catwalk/float without first obtaining written Department approval (pcan~it, modification, or
amendment).
30. Docks at Property Lines Docka/eatwalk~floats must not:
a. extend laterally beyond property lines,
b. imerfere with navigation, or
c. interfere with other landowners ripatiau rights.

33. State Not Liable for Damage The State of New York shall in no case be liable for any damage.or

30. Stnte May Reqnir~ Site Restoration If upon the expiration or revocation of this p~mit, the
project hereby authorized has not been completed, the applicant shall, without expense to the State, and
to such extent and in such time and manner as the Deparlment of Environmental Conservation may
lawfully require, re, hOVe all or any portion of the uncompl~ed structure or fill and restor~ the site to its
former condition. No claim shah be made against the State of New York on account of any such
removal or alteration.
WATER QUALITY CERTIFICATION SPECIFIC CONDITIONS
1. Water Quality Certification The NYS Department of Enviromnental Conservation hereby eerlifies
that the subject project will not contravene effluent limitations or other limitations or standards under
Sections 301,302, 303, 306 and 307 of the Clean Water Act of 1977 (PL 95-217) provided that all of the
conditions listed herein are met.
GENERAL CONOmONS - Apply to ALL Authorized Permits:
1. Fac'dRy Inspection by The Department The permitted site or facility, including relevant records, is
subject to inspection at reasonable hours and intervals by an authorized representative of the Depm hnent
of Environmantal Conservation (the Department) to deka,,,ine whether the p~tmittee is complying with
this permit and the ECL. Such representative may order the work suspended pursuant to ECL 71- 0301
and SAPA 401(3).

4. Submission of Renewal Application The permittee must submit a renewal application at least 30
days before permit expiration for the following permit authorizations: Tidal Wetlands, Water Quality
Certification, Excavation & Fill in Navigable Waters.
5. Permit Moditicaflons, Suspensions and R~ocations by the Department Thc DepaO,uent
reserves the fight to exercise all available authority to modify, suspend or revoke this l~,-tit. The
grounds for modification, suspension or revocation include:
a_ materially false or inaccurate statements in the p~,mit application or supporting papers;
b. failure by the l~mfittoe to comply with any terms or conditions of the pvmfit;
c. exceeding the scope of the project as described in the permit application;
d. newly discovered material information or a material change in environmental conditions, relevant
technology or applicable law or regulations since the issuance of the existing permit;
e. noncompliance with previously issued permit conditions, orders of the cemmissioner, any
provisions of the Environmental Conservation Law or regulations of the Department related to
the permitted a~ivity.
6. Perm~ Tr~[er Pc~its are transferrable unless specifically p~olu'bited by statute, r~ulation or
another p~amit condition. Applications for pen~t tran.~fer should be submitted prior to actual transfer of
owne~hip.
Item A: Permittee Accepts Legal Responsibility and Agrees to Indemnification
The pc~'mittee, excepting state or federal agencies, expressly agrees to indemnify and hold harmless the
Department of Enviromnental Conservation of the State of New York, its representatives, employees,
and agents ("DEC") for all claims, suits, actions, and damages, to the extent attributable to the
permittee's acts or omissions in connection wi~ the permittee's undertaking of activities in connection
with, or operation and maintenance of, the facility or facilities authorized by the permit whether in
compliance or not in compliance with the tc~s and conditions of the pe~it. This indemnification does
not extend to any ¢~aims, suits, a~ions, or damages to thc extent attributable to DEC's own negligent or
intentional acts or omissions, or to any claims, suits, or actions paining the DEC and arising under
Article 78 of the New York Civil Practice Laws and Rules or any citizen suit or civil fights provision
under federal or state laws.
Item B: Permittee's Contractors to Comply with Permit
The pmmitten is responsible for informing its independent conlractors, employees, agents and assigns of
their responsibility to comply with this permit, including all special conditions while acting as the
permittee's agent with respect to the permitted activities, and such persons shall be subject to the same
sanctions for violations of the Environmental Conservation Law as those prescribed for the permittee.

At the meeting of the Southold Town Conservation Advisory Council held Wed., March 13,
2013 the following recommendation was made:
Moved by John Stein, seconded by Derek Bossen, it was
RESOLVED to SUPPORT the Wetland Permit application of THOMAS DOWLING to
remove dilapidated timber bulkhead, reconstruct 189' navy style bulkhead in place of
existing utilizing vinyl sheathing, reconstruct a 39' return, reconstruct an 11' return, both
with vinyl, dredge area 10' off bulkhead in boat slip to a depth of -4'ALW, resultant spoil
approx. 75 cy. to be used as backfill for new structure. Reconstruct 3'X 40' timber walk
with untreated lumber, install a cantilevered 4'X 6' platform, 3'X 12' ramp and 6'X 20'
floating dock secured by three (3) 10" pilings. Install electric/lighting to existing flagpole,
install irrigation line to boat basin, and install pervious path steeping stones at existing 4'
path to boat basin.

Note: the maps submitted shows the property boundary projecting into the water body and
including the "existing boat slip". Tax map records so not show this projection; the tax map line
follows the shoreline. Please have the applicant clarify the boundaries of the parcel.
The proposed action is located within a New York State Department of State Significant Fish
and Wildlife Habitat Area, a New York State Critical Environmental Area and a Peconic Estuary
Critical Natural Resource Area.
DKR Shores, Inc. on behalf of THOMAS DOWLING requests a Wetland Permit to remove all portions
of dilapidated timbers/old bulkhead and reconstruct a 189' navy style bulkhead in-place of existing
utilizing vinyl sheathing; to reconstruct a 39' return and an 11' return, both with vinyl; to dredge area 10'

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposal to
remove all portions of dilapidated timbers/old bulkhead and reconstruct a 189' navy style
bulkhead in-place of existing utilizing vinyl sheathing; to reconstruct a $9' return and an
return, both with vinyl; to dredge area 10' off bulkhead, in boatslip to a depth of -4'ALW;
resultant spoil (approximately 75 cubic yards) to be used as backfill for new structure and
reconstruct 3'x40' timber walk using untreated lumber is CONSISTENT with the LWRP.
Further, it is my recommendation that the proposed action to install a cantilevered 4'x6' platform,
3'x12' ramp, and 6'x20' float secured by (3) 10" piles is INCONSISTENT with the LWRP and
listed policy standards provided below.
The property has access to Broadwaters Cove via the waterfront location and opportunity for ~
moorinq.
Policy 6. Protect and restore the quality and function of the Town of Southold ecosystem
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees
laws and regulations for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit
conditions
The applicant fails to prove that the action meets the following requirements § 275-11 Construction and
operation standards C. 2 (d) of the Southold Town Code:
(d) Review and approval of dock applications. Before issuing a permit for a dock structure, the
Trustees shall consider whether the dock will have any of the following harmful effects:

[11] Whether the cumulative impacts of a residential and commercial dock will change the
waterway or the environment and whether alternate design, construction, and location of the
dock will minimize cumulative impacts; and
The continued construction of dock structures within a Siqnificant Fish and Wildlife
HabitatJCritical Environmental Area will affect the public use of the area, and degrade thn
ecoloqical quality of the area through introduction of contaminants, disruption of marine lifn
habits etc .... Correspondingly, physical and functional loss to wildlife has been found to occur
through the loss and/or impairment of habitat, disruption of habits and migration patterns
(structure and activity) and introduction of harmful contaminants. The most common contaminant
associated with docks is wood preservatives impregnated into the wood used to prolong the life
of a dock. Three trace metals; arsenic, chromium and copper are the most common. These
three metals have the greatest potential to increase in estuarine environments from docks
(Sanger and Holland 2002).
The materials and construction method has not been identified. § 275-11 Construction and
operation standards requires that all intertidal construction and excavation employ tho
installation of a silt boom that will retain all suspended sediments within the immediate project
area.
[12] Whether adequate facilities are available to boat owners and/or operators for fueling,
discharge of waste and rubbish, electrical service and water service.
No such facilities are proposed or discussed.
Preserve the public interest in and use of lands and waters held in public trust by the
state and the Town of Southold.
A. Limit grants, /eases, easements, permits or lesser interest in lands underwater in accordance
with an assessment of potential adverse impacts of the proposed use, structure, or facility on
public interest in public/ands under water.
The dock structure will result in a net decrease in public access to/on public underwater lands.
9.4 Assure public access to public trust lands and navigable waters.
A. Provide free and substantially unobstructed passage along public trust shorelands.
E. Provide access to, and reasonable recreational use of, navigable waters and public trust
lands under water.
3. Obstruction of navigable waters and underwater/ands is limited:
b. to the minimum necessary for access to navigable waters. The minimum is
determined by evaluating the following factors:
(vi) whether or not alternative means to gain access are available.
The applicant presently enioys access to the waterbody via the
opportunity for a moorin.q. Due to the shallow water depths and
environmental sensitivity of the area, the seasonal moorinq of vessels are,
more appropriate in this area.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

The firm of DKR Shores Corporation and/or A&ena Rigdon Hoffmann as agent has been
retained to secure the necessary approvals from the various state, county and local agencies to
perform activity at my property in question as referenced in the enclosed applications and
correspondence. All correspondence, calls and contacts shall be directed to the agent. I
shall hold agent not accountable for any renderings and or decisions by said agencies upon
their determination according to the work specified. I shall the agent not accountable or
responsible for the construction of the actual project/nor contractor faults should the project
be performed at a difference of standard from the approved plans. Agent shall not be
responsible or incur costs of additional requests unforseen and unknown that are made by the
various agencies at the time of submissions. I shall hold agent harmless for any and all potential
liabilities involving my property. I understand that fees for the agent sen~ices shall not include
disbursements, extra ordinary revisions to the site plans, extra ordinary deliveries in person
including but not limited to appearance at hearings and/or site meetings with agencies,
additional work to be performed by attorneys, engineers, architects or sunmyors requested in
relation to the scope of the project, any application fees due or additional expenditures after
that fact, included but not limited to requests for preparation of Declarations, filings with
County Clerk or otherwise directed after original submissions. Original permits shall not be
released until balance is paid in full.
