Our first order of business is to set Monday, May 6, 2013 at 6:00 p.m. at the Southold Town Hall, Main Road, Southold, as the time and place for the next Planning Board Meeting. Jim Rich: So moved. Southold Town Planning Board Pa.qe Two April 8, 2013 SUBDIVISIONS - SKETCH DETERMINATIONS Fohrkolb, Andrew - This proposal is for a Standard Subdivision of a 5.89-acre parcel into two lots where Lot 1 equals 0.93 acres and Lot 2 equals 4.96 acres in the R-40 Zoning District. The property is located at 1050 Greton Court, Mattituck. SCTM#1000- 107-3-2 Pierce Rafferty: WHEREAS, this proposal is for a Standard Subdivision of a 5.89 acre parcel into two lots where Lot I equals 0.93 acres and Lot 2 equals 4.96 acres, located in the R-40 Zoning District; and WHEREAS, on November 20, 2012, the agent submitted the required Sketch Plan Application and Sketch Plans; and WHEREAS, on December 17, 2012, the Planning Board at their Work Session agreed to the following: 1. Accepted the Sketch Plan and ERSAP; 2. Found the application incomplete with a condition that the agent must submit proof that the parcel meets lot recognition pursuant to §280-9 of the Southold Town Code; 3. Agreed to waive the Yield Plat requirement subject to a covenant and restriction to be placed on the property that will prohibit further subdivision of the parcels; and WHEREAS, on February 19, 2013, the agent submitted proof that the parcel meets lot recognition; and WHEREAS, on February 25, 2013, the Planning Board at their Work Session found the application complete and that all requirements have been met pursuant to Article V Sketch Plat; be it therefore RESOLVED, that the Southold Town Planning Board hereby grants Sketch Plan Approval upon the map prepared by Peconic Surveyors, P.C. entitled "Sketch Plan for Andrew T. Southold Town Planning Board Pa.qe Three April 8, 2013 SUBDIVISIONS - FINAL DETERMINATIONS New Suffolk Waterfront Fund, Inc. & Robins Island Holdin.q, LLC - This proposed Lot Line Change will transfer 1.12 acres from SCTM#1000-117-8-18 to SCTM#1000- 117-8-19. SCTM#1000-117-8-19 will increase from 0.46 acres to 1.58 acres, and SCTM#1000-117-8-18 will decrease from 3.43 acres to 2.31 acres in the M-II Zoning District. The property is located at 650 & 380 First Street on the e/s/o First Street, approximately 32.20' s/o King Street in New Suffolk. Jim Rich: WHEREAS, this proposed Lot Line Change will transfer 1.12 acres from SCTM#1000-117-8-18 to SCTM#1000-117-8-19. SCTM#1000-117-8-19 will increase from 0.46 acres to 1.58 acres, and SCTM#1000-117-8-18 will decrease from 3.43 acres to 2.31 acres in the Mil Zoning District; and WHEREAS, a Lot Line Modification Application was submitted on November 19, 2012; and WHEREAS, the Zoning Board of Appeals (ZBA) requested comments from the Planning Board regarding Area Variances for Lots 1 and 2; and WHEREAS, on December 18, 2012, the Southold Town Planning Board at their Work Session reviewed the application, responded to the requested ZBA comments and found the application incomplete. The Planning Board supported the requested Area Variances for Lots 1 and 2 because future development of the above-referenced property will be limited and the view shed to the water will be preserved through the Conservation Easement placed over key areas of the properties. These goals are consistent with the Town's Comprehensive Plan; and WHEREAS, on January 10, 2013, the agent submitted the requested items at the December 18, 2012 Work Session; and WHEREAS, on January 10, 2013, the agent submitted a draft Conservation Easement on Lot 2; and WHEREAS, on February 13, 2013, the agent submitted a copy of the Zoning Board of Appeals' Findings and Deliberations where they granted the requested variances; and WHEREAS, on February 21, 2013, the agent submitted revised plans as per the Board's request at the December 18, 2013 Work Session; and WHEREAS, on February 25, 2013, the Planning Board at their Work Session reviewed the revised submissions and found the application complete; and Southold Town Planning Board Pa,qe Four April 8I 2013 WHEREAS, on March 8, 2013, the agent submitted a DEC permit; and WHEREAS, on March 18, 2013, the Planning Board held and closed the Public Hearing; and WHEREAS, on April 8, 2013, the Planning Board at their Work Session reviewed comments from the Public Hearing; and WHEREAS, the Southold Town Planning Board, pursuant to Town Code §240-56 Waivers of Certain Provisions, may waive certain elements of the subdivision review if in its judgment they are not requisite in the interest of the public health, safety and general welfare. After reviewing the information submitted for this application, the Planning Board has determined that it is eligible for a waiver of the Environmental Resources Site Analysis Plan (ERSAP), the Primary and Secondary Conservation Area Plan, the public hearing, and the Sketch Plan and Preliminary Plat steps of the subdivision process for the following reasons: 1. No new lots are being created; 2. No changes will occur as a result of this lot line change that would adversely affect the character of the neighborhood; and WHEREAS, the Planning Board performed an uncoordinated review of this Unlisted Action pursuant to 6 NYCRR Part 617, Section 617.7 of the State Environmental Quality Review Act (SEQRA); and WHEREAS, pursuant to the Lot Line Modification Policy set by the Planning Board in February 2011, this application is eligible for decision from the Planning Board prior to receiving approval by the Suffolk County Department of Health Services (SCDHS) as it meets the following criterion set forth in that policy: Where no new development potential will be created in the parcel to which the land is transferred; and WHEREAS, on April 8, 2013, the Planning Board has at their Work Session determined that the proposed action meets all the necessary requirements of Town Code §240 for a Lot Line Modification; be it therefore RESOLVED, that the Planning Board, pursuant to SEQRA, hereby makes a determination of non-significance for the proposed Lot Line Modification and grants a Negative Declaration; William Cremers: Second the motion. Southold Town Planninq Board Pa,qe Six April 8, 2013 SITE PLAN DETERMINATIONS Laurel Links Maintenance Building Addition - This Amended Site Plan is for a proposed 5,000 sq. ft. addition to an existing 4,204 sq. ff. maintenance building & pump house on 154.7 acres in the A-C Zoning District. The property is located at 6400 Main Road, _+1,000' w/o Bray Avenue and NYS Rte. 25 in Laurel. SCTM#1000-125-4-24.23 Martin Sidor: WHEREAS, this amended site plan is for a proposed 5,000 sq. ft. addition to an existing 4,204 sq. ft. maintenance building & pump house on 154.7 acres in the A-C Zoning District, Laurel; and WHEREAS, on October 15, 1998, the Southold Town Zoning Board of Appeals reviewed the application for a golf course, golf club house and related golf facilities and amenities, tennis courts, pool on 62 acres, whereby granting a Special Exception Permit in this A-C Zone as applied for with three (3) conditions; and WHEREAS, on October 4, 2012, Jeffrey T. Butler, agent to the applicant, submitted an application for site plan review; and WHEREAS, on November 8, 2012, the Planning Board reviewed the application and determined it incomplete; requiring further information and revisions to the site plan; and WHEREAS, on December 3, 2012, the Planning Board received the required information and accepted the application for review; and WHEREAS, the Planning Board performed a coordinated review of this Unlisted Action pursuant to 6 NYCRR Part 617, Section 617.7 of the State Environmental Quality Review Act (SEQRA); and WHEREAS, on December 5, 2012, the Southold Town Fire Inspector reviewed and determined that there was adequate fire protection and emergency access for the site; and WHEREAS, on December 10, 2012, the Southold Town Engineer reviewed the above- referenced application and has determined that the proposed drainage meets the minimum requirements of Chapter 236 for Storm Water Management; and WHEREAS, on December 12, 2012, the Planning Board, pursuant to Southold Town Code §280-131 C., distributed the application to the required agencies for their comments; and Southold Town Planninq Board Page Seven April 8, 2013 WHEREAS, on December 13, 2012, the Mattituck Fire District determined there was adequate fire protection for the site; and WHEREAS, on December 13, 2012, the Southold Town Architectural Review Committee reviewed the proposed project and approved of its design as submitted; and WHEREAS, on January 11, 2013, the Town of Southold LWRP Coordinator reviewed the above-referenced project and has determined the proposed project to be consistent with Southold Town LWRP policies; and WHEREAS, on January 14, 2013, a public hearing was held and closed; and WHEREAS, on January 28, 2013, the Southold Town Planning Board determined that all applicable requirements of the Site Plan Regulations, Article XXlV, §280 - Site Plan Approval of the Town of Southold, have been met; and WHEREAS, on February 11,2013, the Southold Town Chief Building Inspector reviewed and certified the proposed site plan as a permitted use in the A-C Zoning District pursuant to the ©ctober 15, 1998 ZBA Decision #4624 granting a Special Exception; and WHEREAS, on March 18, 2013, the Planning Board, pursuant to the State Environmental Quality Review Act §617.6, established itself as lead agency for this Unlisted Action; and WHEREAS, on March 18, 2013, the Planning Board, pursuant to SEQRA, made a determination of non-significance for the proposed action and granted a Negative Declaration; therefore, be it RESOLVED, that the Southold Town Planning Board has determined that this proposed action is consistent with the policies of the Town of Southold Local Waterfront Revitalization Program; Bill Cremers: Second. Also on the property are a 1,140 sq. ft. single-family dwelling; a 1,965 sq. ft. frame barn; and a 700 sq. ft. frame building on 10.004 acres in the A-C Zoning District. The property is located at 1375 Ackerly Pond Lane, 1,100'+ w/o Lower Road and Ackerly Pond Lane in Southold. SCTM#1000-69-5-7.1 William Cremers: Mr. Chairman, I will offer the following: WHEREAS, this site plan is for the proposed construction of a 5,200 sq. ft. horse barn connecting to a 14,400 sq. ft. indoor arena for the keeping/breeding/raising and training of horses and a riding academy with 10 parking spaces. SCTM#1000-96-2-10.1 & 10.2 Southold Town Planninq Board Pa.qe Eleven April 8, 2013 Pierce Rafferty: Mr. Chairman, I'd like to offer the following resolution: WHEREAS, this site plan is for the proposed construction of a 60' x 120' (7,200 sq. ft.) metal barn on a 25.69 acre Town of Southold Development Rights parcel and the conversion of an existing 4,200 sq. ft. barn to a farm stand on the adjacent 1.84 acre reserved parcel that includes a two-story dwelling in the A-C Zone, Cutchogue; and WHEREAS, on January 16, 2013, Thomas Geppel, owner, submitted an application for site plan review; and WHEREAS, on February 7, 2013, the Southold Town Land Preservation Committee reviewed the above-referenced application for a 60'x 120' Morton-style building to be located within the area of the property subject to a Town Development Rights Easement. The recorded easement for this property allows land within the easement to be used for the purpose of agricultural production, and as such, the application was approved as follows: (1) construction of a 60'x 120' Morton-style building to be located within the easement area, approximately 200' from Cox's Lane, as shown on the sketch submitted January 8, 2013; (2) building use is for animal housing, storage of hay and agricultural equipment and; (3) installation of two (2) 10'x 10' drywells with 8'6" effective depth in area sketched on survey; and WHEREAS, on February 11, 2013, the Planning Board formally accepted the agricultural application for review with revisions; and WHEREAS, on February 14, 2013, the applicant submitted the required revisions to the site plan; and WHEREAS, on February 15, 2013, the Planning Board, pursuant to Southold Town Code §280-131 C., distributed the application to the required agencies for their comments; and WHEREAS, the Southold Town Planning Board, pursuant to State Environmental Quality Review (SEQR) 6 NYCRR, Part 617.5 (c) (3), has determined that the proposed action is a Type II Action as it falls within the following description for 6 NYCRR, Part 617.5 (c) (3)"agricultural farm management practices, including construction, maintenance and repair of farm buildings and structures, and land use changes consistent with generally accepted principles of farming" and, therefore, not subject to SEQRA review; and WHEREAS, on February 27, 2013, the Southold Town Fire Inspector reviewed and determined that there was adequate fire protection and emergency access for the site; and Southold Town Planning Board Page Twelve April 8, 2013 WHEREAS, on February 27, 2013, the Cutchogue Fire District determined there was adequate fire protection for the site; and WHEREAS, on March 8, 2013, the Southold Town Architectural Review Committee reviewed the application, provided comments, and the plans were revised to the satisfaction of the Planning Board; and WHEREAS, on March 18, 2013, a public hearing was held and closed; and WHEREAS, on March 20, 2013, the Southold Town Engineer reviewed the application, provided comments, and the plans were revised to the satisfaction of the Planning Board; and WHEREAS, on March 21, 2013, the Southold Town Zoning Board of Appeals reviewed the application and request for variances, whereby granting the variances as applied for with no conditions in conjunction with the site plan dated January 10, 2007, prepared by Thomas Geppel; and WHEREAS, on March 25, 2013, the Town of Southold LWRP Coordinator reviewed the above-referenced project and has determined the proposed project to be consistent with Southold Town LWRP policies; and WHEREAS, on March 26, 2013, the Suffolk County Planning Commission deemed the site plan application a matter for local determination as there appears to be no significant county-wide or inter-community impact(s); and WHEREAS, on April 8, 2013, the Southold Town Chief Building Inspector reviewed and certified the proposed site plan as a permitted use in the A-C Zoning District; and WHEREAS, on April 8, 2013, the Southold Town Planning Board determined that all applicable requirements of the Site Plan Regulations, Article XXIV, §280 - Site Plan Approval of the Town of Southold, have been met; be it therefore RESOLVED, that the Southold Town Planning Board has determined that this proposed action is consistent with the policies of the Town of Southold Local Waterfront Revitalization Program; Bill Cremers: Second.
