SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 19, 2012, stating that this application is considered a matter for local determination as there appears to be no significant county -wide or inter -community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated October 25, 2012. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: Subject property is located in the R40 zone and is improved with a single family dwelling and accessory shed and in -ground swimming pool. It has 171.79 feet on Nassau Point Road, 481.14 feet on the southern property line, 100.05 feet on Peconic Bay and 624.02 feet on the northern property line as shown on the site plan dated November 6, 2012 prepared by Mark K. Schwartz, Architect. BASIS OF APPLICATION: Request for Variance from Article XXIII Section 280-122A and the Building Inspector's September 20, 2012 Notice of Disapproval, updated November 8, 2012, based on an application for building permit for partial demolition and second story re -construction to an existing single family dwelling at: 1) less than the code required minimum side yard setback of 15 feet, 2) less than the code required combined side yard setbacks of 35 feet. RELIEF REQUESTED: The applicant requests variances to: 1) maintain the existing northerly side yard setback of 10.1 feet where the Code requires a minimum of 15 feet, and 2) to reduce the combined side yard setback from the existing combined of 32.2 feet to a proposed combined of 30.1 feet, where the Code requires the combined to be a minimum of 35 feet. All as shown on the site plans entitled "Thompson House", "Additions and Alterations", sheets S -I and S-2, dated November 6, 2012, prepared by Mark Schwartz, RA and stamped received Nov. 8, 2012. j • • / Page 2 of 3 — December 6, 2012 ZBA Filek6600 - Thompson CTM: 1000-118-6-6 ADDITIONAL INFORMATION: The original site plans submitted with the application were inaccurate with respect to the proposed requested side yard setbacks. The applicant was asked to correct the site plans and request a revised "Notice of Disapproval" from the Building Inspector reflecting those corrections. This appeal is based on those corrected site plans, referenced above, and the revised "Notice of Disapproval" dated November 8, 2012. FINDINGS OF FACT/ REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 1, 2012, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The small deck addition is characteristic of residential properties and the proposed increased roof pitch on part of the existing two story dwelling will improve the aesthetic value of the home while creating no significant visual impact on adjoining properties because both side yards are well screened by mature landscaping. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The dwelling exists in a nonconforming side yard setback location and any proposed partial demolition and reconstruction will require variances. 3. Town Law 4267-b(3)(b)(3). The variance granted herein for a side yard setback of 10.1 feet is mathematically substantial, representing 33% relief from the code. However, this substantiality is mitigated when considering that this is an existing setback to the dwelling and the increase in the degree of nonconformance is minimal and is the consequence of an increased roof pitch. The variance granted herein for a "Combined Side Yard Setback" of 30.1 feet is mathematically substantial, representing a 4.9 foot or 14% variance from the code required 35 feet. However, this substantiality is mitigated when considering that this side yard setback is a conforming single side yard setback to a proposed first floor 1 10 square foot deck addition. 4. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and the requirements of the Board of Trustees. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The dwelling exists in its nonconforming location and any partial demolition, additions and/or alterations within the dwelling's existing footprint will require a variance. 6. Town Law &267-b. Grant of the requested reliefs is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a partial demolition, additions and second story reconstruction while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community.
