Removal of a section of the west jetty needed to accommodate the installation of new vinyl sheathing. Removal of existing 22 L. F. of wood bulkhead re- turn at west property line. Installation of 22' of a new navy-style vinyl sheet piling bulk- head return. The lower beach stair is to be removed and reinstalled after the new bulk- head is constructed. The portion of the upper wood plank terraced stair removed for in- stallation of the tiebacks and deadmen will be reconstructed in kind. The damaged lower rubble stone wall will be reconstructed to the same height and length that existed prior to the storm. Re-vegetation of the disturbed slope areas will consist of rosa virginia, rosa rugosa or equal planted at four to five foot or center. The level four-foot ground area be- tween the top of the bulkhead and base of the lower rubble stone wall will have filter fab- ric installed, ballasted with a blend of 1" to 6" beach stones. DEVELOPED COAST POLICIES Policy 1 Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location and minimizes adverse effects of development. The existing wood bulkhead on the property has been extensively damaged by Hurricane Sandy. This has caused partial failure of the steep slope behind it due to erosion. The east edge of the house above the erosion area is within four-feet of the top of the slope. Portions of the top half existing wood bulkhead are missing. The previously reinforced lower half is generally in fair condition. The main pilings have wet rot and have also been damaged by the impacting waves. We are proposing to build a new vinyl sheet piling bulkhead immediately in front of the existing wood bulkhead sheathing and whalers. This to limit the amount of excavation and prevent further subsidence. Failure of the toe of the slope due to removal of the existing sheathing would cause the upper steep portion of the slope to fail, possibly undermining the house's foundation footings. The existing large deep-rooted trees and rose bush vegetation remaining on the slope would also be lost. Policy 2 Preserve historic resources of the Town of Southold. The center core of the house appears to date to the early 1900s and may have been a fisherman's shed or an accessory structure to the ice houses that once surrounded Mari- on Lake. A large number of millstones have also been found throughout the property. Policy 3 Enhance visual quality and protect scenic resources throughout the Town of Southold. The old mature trees on and at the top of the slope root systems, which protrude into the slope, are less likely to be disturbed by leaving the existing bulkhead in place. The visual quality and scenic resources will remain the same as they have existed in the past. Note: The new bulkhead would be consistent with those on the adjoining properties. The bulkhead to the east was approved and bumped out in 2007 for similar reasons. The bulkhead of the house to the west is 22-feet seaward of the proposed bulkhead. NATURAL COAST POLICIES Policy 4 Minimize loss of life, structures and natural resources from flooding and erosion. The existing bulkhead is needed to protect the upland property and house itself. The new bulkhead will not increase flooding and will prevent erosion. Policy 5 Protect and improve water quality and supply in the Town of Southold. The project will have no impact on the ecosystem. Policy 7 Protect and improve air quality in the Town of Southold. The project will not impact the air quality. Policy 8 Minimize environmental degradation in the Town of Southold from solid waste and hazardous substances and wastes. The project will not degrade the environment. PUBLIC COAST POLICIES Policy 9 Provide for public access to and recreational use of coastal waters, public lands and public resources of the Town of Southold. Our proposal will not limit public access to the coastal waters or public resources of the Town of Southold. There is a bulkhead presently existing and we are proposing to con- struct a new bulkhead immediately in front of the existing bulkhead. The new bulkhead will be 25' landward of the apparent high-water mark. WORKING COAST POLICIES Policy 10 Protect the Town of Southold's water-dependent uses and promote siting of new water-dependent uses in suitable locations. Our proposal is to reconstruct a new bulkhead and prevent failure of the steep slope be- hind it. It will allow continued use of the beach and does not in any way prevent public access through the property. Policy 11 Promote sustainable use of living marine resources in the Town of Southold. There will be minimal disturbance of the slope behind the bulkhead and it will be re- vegetated. Policy 12 Protect agricultural lands in the Town of Southold. There will be no impact on agricultural lands. None are in the vicinity of the house. Policy 13 Promote appropriate use and development of energy and mineral resources. C. approval for constructing a new vinyl sheathing bulkhead in front of my existing bulkhead and pilings. The approval was given after a thorough review of the attached design and site visits, which included D. E. C. marine biologists. It would be less disruptive to my slope and my neighbor to the east to have a new bulkhead placed in front the existing bulkhead. The slope and vegetation, which includes mature trees, would remain undisturbed. The existing bulkhead, which is still mostly structurally sound, would be an additional protective barrier in future storms. This is most critical, as my house is only within four-feet of the top of the bluff. The additional 9-inches seaward needed to leave the existing piles in place would have no adverse impact on my neighbors or the environment. The new bulk- head's pilings on the property to the east are presently 27-inches in front of the face of my original sheathing. The property to my west, whose bulkhead is currently being re- constructed, will be in excess of 21-feet in front of my bulkhead when completed. My beach is also separated from the adjacent properties by groins at the east and west sides. They project out 50 and 70-feet respectively from my existing bulkhead. So, the additional 9-inches needed would have no effect on my neighbors or the high-water mark, which is normally at least 20-feet down slope away from the face of my bulkhead. Removal of the existing piles would result in loss of the bulkhead when the new vinyl sheathing is water-jetted into place. This as they presently brace the whalers and sheathing against outward movement. Page 2 I am only requesting this variance as a logical added protective measure. This as the property is frequently subjected to high-velocity waves. If my bulkhead wasn't damaged in Storm Sandy this work would not be necessitated. But as the bulkhead needs to be replaced at great expense, I want to construct it in the least disruptive man- ner to the vegetation remaining. Also the most effective measures that can be taken to protect my house from possible total destruction in future storms due to slope failure. Precautions Against Contamination of Waters All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project. 7. No Construction Debris in Wetland or Adjacent Area Any debris or excess material from construction of this project shall be completely removed from the adjacent area(upland) and removed to an approved upland area for disposal. No debris is permitted in wetlands and/or protected buffer areas. 8. Storage of Equipment, Materials The storage of construction equipment and materials shall be confined to the upland area landward of the bulkhead or on a barge. 9. Seeding Disturbed Areas All areas of soil disturbance resulting from the approved project shall be stabilized with appropriate vegetation(grasses, etc.) immediately following project completion or prior to permit expiration, whichever comes first. If the project site remains inactive for more than 48 hours or planting is impractical due to the season, then the area shall be stabilized with straw or hay mulch or jute matting until weather conditions favor germination. 10. Clean Fill Only All fill shall consist of clean sand,gravel, or soil (not asphalt, slag, flyash, broken concrete or demolition debris). I. No Beach Excavation For Fill No excavation of the beach is authorized for the purpose of obtaining fill or stone materials. 12. Grade to Match That Adjacent to Bulkhead All fill must be graded to match the elevation of the land immediately adjacent to the bulkhead. 13. Backfilling All peripheral berms, cofferdams, rock revetments, seawalls, gabions,bulkheads or other approved shoreline stabilization structures shall be completed prior to placement of any fill material behind such structures. 14. Bulkhead Height The new bulkhead height shall not exceed the height of the adjacent bulkheads. 15. No Equipment below Apparent High Water Equipment operation below (seaward) apparent high water is strictly prohibited. 16. Bulkhead Replacement The new bulkhead shall be constructed within a maximum of 24" seaward of the existing structure, measured from the seaward face of the existing sheathing to the outermost seaward face of the new sheathing(as shown on the approved cross-section). 17. No Structures on Bulkhead No permanent structures shall be installed on the authorized bulkhead without first obtaining written department approval (permit, modification, amendment). Notice of Commencement At least 48 hours prior to commencement of the project, the permittee and contractor shall sign and return the top portion of the enclosed notification form certifying that they are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion of project, the bottom portion of the form must also be signed and returned, along with photographs of the completed work. 20. Post Permit Sign The permit sign enclosed with this puuiit shall be posted in a conspicuous location on the worksite and adequately protected from the weather. GENERAL CONDITIONS - Apply to ALL Authorized Permits: 1. Facility Inspection by The Department The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation (the Department)to determine whether the permittee is complying with this permit and the ECL. Such representative may order the work suspended pursuant to ECL 71- 0301 and SAPA 401(3). The permittee shall provide a person to accompany the Department's representative during an inspection to the permit area when requested by the Department. A copy of this permit, including all referenced maps, drawings and special conditions,must be available for inspection by the Department at all times at the project site or facility. Failure to produce a copy of the permit upon request by a Department representative is a violation of this permit. 2. Relationship of this Permit to Other Department Orders and Determinations Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind any order or determination previously issued by the Department or any of the terms, conditions or requirements contained in such order or determination. 3. Permit Transfer Permits are transferrable unless specifically prohibited by statute,regulation or another permit condition. Applications for permit transfer should be submitted prior to actual transfer of ownership. NOTIFICATION OF OTHER PERMITTEE OBLIGATIONS Item A: Permittee Accepts Legal Responsibility and Agrees to Indemnification The permittee, excepting state or federal agencies, expressly agrees to indemnify and hold harmless the Department of Environmental Conservation of the State of New York, its representatives, employees, and agents ("DEC") for all claims, suits, actions, and damages,to the extent attributable to the permittee's acts or omissions in connection with the permittee's undertaking of activities in connection with, or operation and maintenance of, the facility or facilities authorized by the permit whether in compliance or not in compliance with the terms and conditions of the permit.
