Requires Immediate Attention: Nothing at this time Board and Office Policies, Practices, and Activities: Section §280-123, Non-Coutbrmiug Buildings with Non-Conforming Uses On April 3, 2013 the Code Committee discussed the ZBA's suggestion to the Town Board to add non-con~'ormiug residential structures with non-conforming uses to this section of the code, which currently only addresses commercial structures. The Town Attorney is working on draft language fbr further discussion. Recoirnmendations on Possible Code Changes to Section §280-13(B) 13 Accessory Apartments in Accessory Structures At the request of the Town Board, the ZBA evaluated the implications of cha~ges to Section §280-13(B) 13 of the current Accessory Apartments in Accessory Structures code, by permitting additions to existing accessory structures for the purpose of creating an accessory apartment by Special Exception of the Board of Appeals. A written report was submitted at the April 23, 2013 work session of the Town Board, and a discussion took place about inherent conflicts with code section §280-15, which limits the size of accessory structures through a bulk schedule that ties the size (squaxe fbotage), height and setbacks of accessory structures to lot sizes to keep accessory structures from becoming "over-scaled" relative to the size of existing "principal" structures and the size of a property. The matter was sent for further review and discussion to the Affordable Housing Advisory Commission. Financial/Budget/Personnel Issues: The Board of Appeals welcomes Eric Dautes who was appointed by the Town Board on April 23, 2013 to fill the vacancy on the ZBA that was created by former Member Dinizio's appointment to the Town Board.
