AUTHORIZATION
Pursuant to the provisions of Chapter 275 of the Town Code of the Town of Southold and in
accordance with the Resolution of the Board of Trustees adopted at the meeting held on March 20, 2013, and in
consideration of application fee in the sum of $250.00 paid by Michael A. Kimack or authorized waiver of
Town Board and subject to the Terms and Conditions as stated in the Resolution, the Southold Town Board of
Trustees authorizes and permits the following:
Wetland Permit for the existing wood bulkhead (lO0'&); existing staircase (9'a:),
and platform (64+sq.ft.); replace deck with 2 benches with pressure treated joists and
cedar decking o/e; replace 4'x6'6' staircase to beach with pressure treated buried wood
and cedar wood o/e for treads, stringers and railings; replace approximately 80 yards
of sand to toe of bank at various locations and against new retaining wall along
southerly line (by others); burlap bank and plant beach grass at 1' o/c; repair 3 treads
on existing staircase; replace damaged log border to deck'as needed; and remove
approximately 10 yards of debris; with the condition that the deck is not to exceed 200
square feet; and as depicted on the site plan prepared by Michael A. Kimack, last dated
March 21, 2013, and stamped approved on April 12, 2013.
IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed,
and these presents to be subscribed by a majority of the said Board as of this date.
TERMS AND CONDITIONS
The Permittee Christian R. Zimmer, residing at 7525 Nassau Point Road, Cutcho~ue, New
York as part of the consideration for the issuance of the Permit does understand and prescribe
to the following:
That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit, and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto, to the complete exclusion of the Board of
Trustees of the Town of Southold.
That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved, to provide evidence to anyone concerned that
authorization was originally obtained.
That the work involved will be subject to the inspection and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
That if future operations of the Town of Southold require the removal and/or altemtions in
the location of the work herein authorized, or if, in the opinion of the Board of Trustees,
the work shall cause unreasonable obstruction to free navigation, the said Permittee will be
required, upon due notice, to remove or alter this work project herein stated without
expenses to the Town of Southold.
That the said Board will be notified by the Permittee of the completion of the work
authorized.
That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.

Dear Mr. Zimmer:
The Board of Town Trustees took the following action dudng its regular meeting held on
Wednesday, March 20, 2013 regarding the above matter:
WHEREAS, Michael A. Kimack on behalf of CHRISTIAN R. ZIMMER applied to the
Southold Town Trustees for a permit under the provisions of Chapter 275 of the
Southold Town Code, the Wetland Ordinance of the Town of Southold, application
dated February 4, 2013, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application to for
the existing wood bulkhead (100'+); existing staircase (9'+), and platform (64:l:sq,ft,);
replace 4'x6'6" staircase to beach with pressure treated buried wood and cedar wood
o/e for treads, stringers and railings; replace approximately 80 yards of sand to toe of
bank at vadous locations and against new retaining wall along southerly line (by others);
burlap bank and plant beach grass at 1' o/c; repair 3 treads on existing staircase;
replace damaged log border to deck as needed; and remove approximately 10 yards of
debds be found Consistent with the Local Waterfront Revitalization Program policy
standards, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application to
replace approximately 300sq.ft. deck with 2 benches with pressure treated joists and
cedar decking o/e be found Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered the Local Waterfront Revitalization
Program policy 6.3 to the greatest extent possible through the imposition of the
following Best Management Practice requirements: the issuance of a permit on
structures; reconstruction of deck is not to exceed 200 square feet; and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said
application on March 20, 2013, at which time all interested persons were given an
opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the
premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirement imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
RESOLVED, that the Board of Trustees APPROVES the application of CHRISTIAN R.
ZIMMER for the existing wood bulkhead (100'+); existing staircase (9'+), and platform
(64±sq.ft.); replace deck with 2 benches with pressure treated joists and cedar decking
o/e; replace 4'x6'6" staircase to beach with pressure treated buded wood and cedar
wood o/e for treads, stringers and railings; replace approximately 80 yards of sand to
toe of bank at various locations and against new retaining wall along southerly line (by
others); burlap bank and plant beach grass at 1' o/c; repair 3 treads on existing
staircase; replace damaged log border to deck as needed; and remove approximately

Permit to construct and complete project will expire two years from the date the permit
is signed. Fees must be paid, if applicable, and permit issued within six months of the
date of this notification.
Inspections are required at a fee of $50.00 per inspection. (See attached schedule.)

At the meeting of the Southold Town Conservation Advisory Council held Wed., March 13,
2013 the following recommendation was made:
Moved by Doug Hardy, seconded by John Stein, it was
RESOLVED to SUPPORT the Wetland Permit application of CHRISTIAN ZIMMER for the
existing 100' wood bulkhead and existing 300 sf. deck; to replace 4'X 6' staircase, replace
approx. 80 cy. of sand to toe of bank at various locations and against new retaining wall
along southerly line. Burlap bank and plant beachgrass @ 1' on center; repair 3 treads on
existing staircase; replace damaged log border to deck, as needed; and remove approx.

The CAC Supports the application with a total of a 5' non-turf vegetated buffer and the
beach stairs are removable. There is also a concern with the legality of the bath house
with evidence of electricity.

The proposed actions have been reviewed to Chapter 268, Waterfront Consistency Review of the Town
of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that above actions are
CONSISTENT with the LWRP.
The Board issued a permit for the retaining wall and stair in 1993 (Figure 1).
Note that the 300 square foot deck was not referenced in the decision or shown on the plans.
Further the proposal to replace approximately 300 sq. ft. deck with 2 benches with pressure treated
joists and cedar decking o/e is recommended as INCONSISTENT with the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
Comply with Trustee regulations and recommendations as set forth in Trustee
permit conditions.
The structure described was not constructed pursuant to Southold Board Trustees
permit pursuant to Chapter 275 Wetlands and Shorelines regulations and is not
permissible under current regulations.
(6) Platforms.
[Amended 10-11-2005 by L.L. No. 17-2005; 10-9-2012 by L.L. No. 12-2012]
(a) Platforms associated with stairs may not be larger than 100 square feet.

staircase and wood posts, repair of the steps and rebuilding the toe of
the bank and against retaining wall along southerly line would take
approximately 3 weeks after receipt of the permit to proceed
(3) Purpose: to replace in kind the deck with benches, staircase to beach,
wood posts,repair damaged treads on existing staircase and rebuild toe of
bank and against retaining wall with sand and replant toe with beach grass
as a result of hurricane Sandy.

Placement of the sand would be about 80 yds. see site plan for replacement
of damaged structures.

(6) The material depth at the bank's toe would be about 2-3 feet at the
deepest point and approx. 5 feet at the retaining wall. The angle of
repose of the existing bank is approx. 30 degees.
(7) Material will be moved to the site and deposited using a rubber tracked
front end loader traveling on preplaced plywood to protect the existing
vegetation from further damage.

(10) The existing wood bulkhead was replaced with the prior owner of the
property. A permit was issued to repair the so-called retaining wall
which is the bulkhead. There existing landing,staircase and a smaller
deck was shown on an earlier survey dated Aug.16,1997.

(12) The site has not sustained significant erosion damage. The
replacement of sand and beach grass would not create any significant
erosion problems.

agree to a 30-Year Maintenance program for a structure as described:

It is my/our understanding that we are to maintain this structure with materials designed
to endure 30 years and/or equivalent to the original approved structure. Any
maintenance which involves more than 50% of the length of this structure requires
approval of the Board of Trustees. We further understand that failure to maintain the
structure could result in a requirement to post a bond and/or have the repairs ordered as
a lien against the property upon a finding by the Board of Trustees that said lack of
maintenance would dsk life, property or important natural resource features.
