Kimack, last dated February 25, 2013 and stamped approved on March 20, 2013. IN WITNESS WHEREOF, the said Board of Trustees hereby causes its Corporate Seal to be affixed, and these presents to be subscribed by a majority of the said Board as of this date. Dave Bergen - Nay TERMS AND CONDITIONS The Permittee Bruce Beaney, residing at 6200 Indian Neck Lane., Peconic, New York as part of the consideration for the issuance of the Permit does understand and prescribe to the following: That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved, to provide evidence to anyone concerned that authorization was originally obtained. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. That there will be no unreasonable interference with navigation as a result of the work herein authorized. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required, upon due notice, to remove or alter this work project herein stated without expenses to the Town of Southold. That the said Board will be notified by the Permittee of the completion of the work authorized. As long as the property owner is not doing any work on the actual bulkhead or in the area seaward of the bulkhead, they may use the letter from 1999 to do any reconstruction, fill, planting or other necessary projects in the area landward of the bulkhead. It is not necessary for NYSDEC to issue a new letter or permit at this time. The Board reveived the application and took testimony from myself and an adjoining property owner, Mr. Scopaz. Certain issues were raised that resulted in the application being tabled until the next scheduled public hearing on March 20, 2013 ~ 5:30 PM. This letter and the accompanying documentation and drawings addresses the issues raised as follows: The concern of Mr. Scopaz was that, if my client's retaining wall was not extended to his property line and connected to his recently constructed bulkhead, a future storm may cause further damage to his property. Mr. and Mrs. Beaney are aware the decision to extend the retaining wall is solely their own, and would do so if the work provided a greater protection to their property, (and collaterally Mr. Scopaz), than presently exists. That is not the case with the slope in question. The area from the staircase to the Bcaney's property line is heavily overgrown with mature rooted plants that have protected the slope from failure through Sandy and arguably several past storms of equal ferocity ( see photos enclosed). To construct a continuation of the retaining wall to the property line would require the removal of the naturally compacted soils and the decades old root system that gives it cohesiveness and durability. In fact, the end result would be a slope more prone to failure. As such, the Beaney's decline to extend the retaining wall as the end result would be to make the slope more prone to future collapse than leaving the slope in its present natural condition. o The Board raised a concern regarding the size of the upper deck that exceed 100 sq. ft. and, as such could not be granted a permit. Please accept the enclosed documentation that permits a new retaining wall, the deck, as well as the stairs. a) Board of Southold Town Trustees: Permit no. 86-7-1 dated jan.14, 1993 issued to Cecilia Kemplar and Ellen Cropper b) Letter from board dated Jan.24,2007 tranferring above permit to Mr. and Mrs. Beaney to replace the existing wood deck and steps in kind and in place. c) A copy of the Jan 8, 1998 survey showing the wood platform, stairs and deck with the stairs leading to the beach in exactly the same configuration and dimensions that are present on the new survey submitted as part of the present application. It appears that all existing structures (save mention of a second retaining wall) were previously permitted. The board requested that the dimensions of the upper landing be put on a drawing. Please find the dimensions for both the landing and the deck on the 1998 survey submitted as above. 4. (4) A minimal amount of material may need to be removed (< 5 yds.). To rebuild the slope to its original configuration would require approximately 200 yards of sand. (5) Area: Standing on the upper wood platform of the descending staircase, the slope to be repaired extends approx. 66 feet to the westerly property line with a repose of approx. 45 degees and an overall work area of approx. 1650 square feet. At the base of the slope will be 2 stepped wood retaining walls approx. 66 in length with a hight of approx. 4 feet. The work area for the retaing walls adds another 350 square feet for a total work area of approx. 2000 square feet. The retaining walls will be ACQ 6"x6" faced with a sheathing material consisting of Vinyl Shoreguard 225. (6) The depth of the material reuired to rebuild the slope to its original configuration would have a deep fill area of approx. 4-5 feet with an angle of repose of approx. 45 degrees. (7) Material will be moved to the site and deposited using a rubber tracked front end loader traveling on prepiaced plywood to protect the existing vegetation from further damage. (8) Survey: See updated survey attached (9) There are no wetlands or tidal waters within the proposed work area. (10) There have been no previous operations on the property without a permit. There had been no permits previously issued for the proposed work.
